A regular meeting of the Board of Aldermen was held Tuesday, October 23, 2018, at 7:30 p.m. in the
Aldermanic Chamber.

President Brian S. McCarthy presided; Deputy City Clerk Judith Boileau recorded.

Prayer was offered by Deputy City Clerk Judith Boileau; Alderman June M. Caron led in the Pledge to
the Flag.

The roll call was taken with 13 members of the Board of Aldermen present; Alderman Ken Gidge and
Alderwoman-at-Large Shoshanna Kelly were recorded absent.

Mayor James W. Donchess and Corporation Counsel Steven A. Bolton were also in attendance.

REMARKS BY THE MAYOR

Mayor Donchess

| just have a couple of issues that | wanted to mention particularly because the Red Sox are on tonight.
Thursday the HRSA which is a unit of the Federal Department of Health & Human Services, is holding a
Safe Stations Academy or is sponsoring. The City and Harbor Homes and others are hosting Safe Stations
Academy down at the Sky Meadow Country Club in South Nashua. HRSA believes that the Safe Stations
programs that we are running here could serve as a model and be duplicated throughout the country in
terms of fighting the opioid epidemic.

The City’s Epidemiologist paid for by State grand funds has calculated that people who report to Safe
Stations are 60 to 70% less likely to suffer a subsequent overdose after having gone through at least the
initial intake and the treatment referral that people receive after going to Safe Stations. So we are very glad
that HRSA is coming to Nashua and will be looking at our program very carefully.

Also on the opioid front, the State has announced its plan to use the $23 million dollars a year in anti-opioid
funds to fight opioids here and that plan is a so-called Hub and Spoke Model. The so-called Hub that has
been designated for Nashua and for Manchester is Granite Pathways. We will be meeting with them later in
the week to talk about how our current participants, the City, AMR, of course the Fire Department, Harbor
Homes, Revive Recovery can together work with Granite Pathways to use the money to support what we
are doing now and to improve our opioid response. So | am looking forward to the meeting with HRSA.

Beyond that Mr. Chair, | just wanted to mention that this week is Red Ribbon Week; again with respect to
drug abuse and misuse. Red Ribbon Week is dedicated to persuading young people, educating young
people that the use of illegal drugs is dangerous and should be avoided at all costs.

On your Agenda tonight is the purchase of the BAE buses, these are two replacement buses. We received
a very substantial grant, on a competitive grant basis to buy these hybrid electric buses which include a BAE
drive train. So it is great in two respects, these will replace diesel buses so we will be a lot greener and also
will help to support and promote Nashua’s largest employer.

Finally, Mr. President, Farmer's Market was in 201 Main Street over the weekend on Sunday. | think it went
pretty well even though it is not as well-known yet as the summer Farmer’s Market; it was the first week.
There were definitely farmers and merchants there and | hope people will try to visit that and check it out.

Thank you. This grant came in to the Human Affairs Committee in May and it was for $879,760.00 to
complete the Heritage Rail Trail. Initially on the resolution we passed it said that the grant funds were
coming from the State Transportation Enhancement Funds when actually they are coming from the
CMAQ Grant which is Congestion Mitigation and Air Quality Grant. That is the only change.

Chris Griffin 56 Tyler Street, Nashua, NH. On September 17" | went in to speak with the ADA with your
Risk Manager, who is also your ADA Coordinator. | was there to ask her why | hadn’t received the
letter that | had asked for in April. In June | called and asked her why | hadn’t received it and she told
me she forgot, she’d get right on it. Three months later | came in with the letter | had to write so that |
thought that | could get a written response from her. | told her at one point that | wasn’t able to write

very well and that | needed assistance. When | held up the letter she looked at me and said, “Aha, you
can write”. Upon further discussion she told me she mailed the letter and | said, “I never received it”.
She told me, “You must've received it because | mailed it to you”. Well | never received the letter.

Further on, we were discussing things and she told me that if she hadn’t taken proper notes it was my
fault. In explaining she said that she had told me at one point in many of the months that | had come in
to talk to her about another problem, that she tried to tell me that there was a certain way Nashua did
things. | don’t remember her ever doing that; so | need you to explain to me why an ADA Coordinator
who 1) when | hold up the letter say “Aha, you can write” when | do have issues that make it very hard
for me to write and also why she would then tell me it’s my fault if she didn’t take proper notes.

| need the notes from the day she says she told me or tried to tell me that | wasn’t following procedure.
| also need the notes from the next three times | was there where she also tried to explain to me the
proper procedure, because | don’t remember it ever happening. Now after being accuses twice of
doing things which | don’t remember doing, | was getting upset. And yes my voice was raised because
| was upset | was being accused of things | hadn’t done. So | left or started to leave. She followed me
out in front of two co-workers in the front of her office and proceeded to tell me, “don’t ever come back
here, | don’t want to see you and if you come back I’m going to call the Police”. These are all things
you are not supposed to do to mentally ill people.

There is a reason why a lot of us won’t come up and speak to people, because we are afraid we are
going to be blamed for things. We are afraid we are going to have people tell us we are going to call
the cops on you. So | need you all to explain to me why this was alright for the City of Nashua to do
this to me and why | have to come before you to get an answer on a public safety question | posed
back in April. Now mind you, | have the answer in my pocket, but what | really want to know is why did
it take so long? Why was | abused in her office and what are you going to do about it. I'll hang around
if any of you would like to speak with me afterwards, that’s fine. I’d like a response to these questions
in six weeks. If you don’t think you can do that, I'll give you my name and number and you can call me.
But if you all don’t want to do this, | have been encouraged to go up to the Disability Rights Center in
Concord and file a complaint.

I’d rather that the City of Nashua take care of this problem on its own and explain to me how they are
going to take care of this problem. If you don’t think you can do it, let me know, I'll have another agency
take care of it. Thank you very much. And like | said, I’ll be here when you get done if you want to
speak to me.

Laurie Ortolano 41 Berkeley Street, Nashua, NH. Thank you for the input. | was here six weeks ago
talking about the assessing office and some concerns | had. My concerns continue to grow a bit, | had
an opportunity to look more deeply into sales verifications that we do in the City and it was Trish Klee
who pointed out that | wasn’t using a code correctly in the first round of data | generated. | did not go
after 100 records on sales verification, but | just recently finished my 100 record gathering. The
information is just very concerning, what | see.

I'd like to think that the Assessing Office is working to create equity in these assessments for
everybody. But what | am seeing and what | found most disturbing is that valuations or sales data that
comes in at a sales price, if the assessment is higher than the price that the home sold for, | believe
that in 100% of those cases, the Assessing Office will not reduce the assessment. It just stays high. If
it is 25% out, it stays $50, $60, $70 grand above it; no adjustment. | printed every property card; | have
all 100 trying to look at the notes to see what is the justification. | can’t find it. On the flip side, if an
evaluation is low and let’s say it is at 60% of the sale value, the assessment or 70%, they are willing to
move those up and many of them they only move up to 80/85. That seemed to be the general number.
But if you are at 95, 100, 105, 110, 125, 130, those are staying.

So what it tells me is that they are not looking to create equity in the data base for all of the tax payers.
| don’t understand why, because changing valuations that are simply too high, it is the same pot. You
are just redistributing to get neighborhoods equitable. So that stood out glaring to me and that was

really a disturbing piece of information on sales verifying. And also, | could not track a pattern like if you
... 2013 was an assessment year, if you bought your house in 2013/2014 and everything had been
equalized to 94% and did they take the home value if it sold that year and bring it to 94%, because that
was the equalized ratio? No they didn’t; they did some, they did us at 97 but they left other homes at
85, 82, you know, $100,000.00 differences.

In neighborhoods that you know down in Tanglewood, nice neighborhoods, big variations. So | could
not understand what was going on. | want you to know that | wrote a letter, | sent an e-mail into the
Assessing Office more than a month ago, maybe 5 weeks ago, asking for what the MLS policy was and
how are they using this sales information to adjust the data base. | was never able to get a response. |
also asked them if they had policies in general that they could provide me in an e-mail; | was never able
to get a response.

Last week your CFO gave a response to a Union Leader article that we have policies in place for the
capturing of permits and updating the cards using our mass appraisal system. That prompted a
number of us in my neighborhood to go to the Assessor’s Office and to call in and say, “We'd like
copies of your policies”. As it turned out, there are no policies. | was flat out told, we really don’t have
them. What they have is a task list in everyone’s computer that tells them what to do. | called the Chief
Assessor out and asked if he was available and he came out. | said “Hey, | want your policies, your
boss has said you have got policies, this is what | have been looking for, | want the policies”. He really
didn’t know what | wanted, he said, “We really don’t have policies’.

| think it was on a Saturday, this was a Friday | was in there, | got an e-mail back from him and he sent
me two punch lists basically out of two of the ladies in the front office’s computers that tell them what to
do when they get a permit; go into WebPro, push this button, enter this data, look to see if it has value.
If it has value, send it over to Gary. So it is a task list, that’s not a policy. When | look at your Board of
Assessor's web site, it says “The Board of Assessor’s responsibilities include reviewing the Assessment
Department's policies for compliance with statutes”. | agree with that, I’d love to find the policies,
because | really believe a big part of your problem in that office is not having any policies.

It has made my life very difficult. I’ve had some people in City Hall be very critical of the data | produced
telling me it wasn’t truthful and, in fact, | have been very open with my data and if | have a mistake in
my data, Trish called me up and said, “Oh you have got to look at the 8 in the verify column, that means
MLS verified”. | had to go to Alderman to figure that out. Nobody in the Assessing Department could
tell me that for the time I’m there, when | send an e-mail so | could understand it?

| care about my data, you really all have to stay to yourself, what would this lady’s purpose be in
producing a whole bunch of lies and throwing it out there, why would she do that? | wouldn’t. | wouldn’t
do that to myself and | wouldn’t waste your time either. One thing that really bothered me when |
moved in here and my assessment got raised, | received a letter in January from the City letting me
know it happened and it was going up $229,000.00 and | had until July to pay the bill. | discovered
looking through all your cards that | was the only one that | can find given a letter.

And, in fact, in the Assessing Office, they said “We don’t tell people when we do this, we just send them
their tax bill and if it goes up five grand, they get it and they’ve got a month to pay, come up with the
money or else”. | was shocked and | kind of resent living on Berkeley Street and being picked to be
given a letter, if it was because | was special or in a high priced neighborhood, | deserved it. I’d like to
be treated like everyone in this City and | think every person in this City deserves to receive a letter if
their assessments are changing by massive valuations that really cause hardship when you get that
information and you’ve got four weeks to come up with the money.

| find that it has been very much an obstructionist process for me and City Hall. The ladies in the front
office of the Assessor's Office are great. They really are, they are really great, but when you get to the
Assessing point it really falls apart with finding anything that makes sense.

We had a house on Berkeley Street that was kind of an interesting situation that had a fire and the
assessment was very, very low. | knew that wouldn’t be the only property | found; | managed to find
several others that fit in that profile that speak to practices that | just feel have no place in an Assessing
Office. So that deeply disturbs me and it is pretty disappointing.

| have to tell you that there were days | came into City Hall and went down to permits and | was sick to
my stomach, | was nauseous. And I’ve had nights where | got out of bed at 2:00 in the morning, put on
coffee, looked at my data and said, “Is this even possible, am | even seeing it right”. It was so mind-
blowing to me. And the whole permit thing, | understand that permits have different values, | really do. |
don’t want you to trivialize that | don’t understand that if $100,000.00 permit is pulled your assessment
doesn’t go up 100K. But let me tell you that when | see $100,000.00 permit and | see no change in the
assessment, that’s a red flag to me. I’ve been down in permits and | have pulled a lot of the records. |
have photographed them all in my phone and | am telling you, | am seeing valuations that are so
ridiculously big on permits, that don’t show up in the assessment.

| see one permit was for $100,000.00 in 2013, 2011/2012/13 assessed that shows no valuation and my
neighbor next door gets hit for a bathroom, kitchen and basement reno and his assessment goes up
$200,000.00. | have never seen anything like that anywhere, ok? And the same $100,000.00 permit
for bathrooms, kitchen, you know, cabinetry, extensive remodel generates nothing. | don’t know what
to say to that. | don’t know how to make heads or tails out of that.

It has just been really disappointing and | feel like we are not doing what we should be doing for the
citizens in this City. | don’t think we treat the young people who come in here well. | took two simple
files for garages and pools. Let’s look at 4 garages, let’s look at 4 swimming pools, it is crazy. A
double garage with an upstairs, huge build on attached to a house that had no garage, changed the
assessment $7K. That’s so ridiculously low it is mind-boggling. The young couple with a baby that
moves in from Georgia tears down an existing garage, puts up a new one and pays $10K, but the
garage was already there and it was detached, it is not an attached. So the assessment for the garage
was in there, they had to pay for a grade change because it was new. That raised their assessment
$10K.

Then | go over to a wealthy neighborhood with 1,000 square foot garage put on that | can only see
assessed for $3,000 bucks. | mean pools, in general pools run about $20 to $24K. Then you go to a
wealthy neighborhood and a $95,000.00 pool isn’t taxed. | don’t know what to say to that except it is
disturbing. | don’t know what you can do about this though | don’t know if a Board of Aldermen can
participate in policy development. But for me, from what I’ve seen, for what is in my head, | would shut
down all Assessing in that office, no assessing until we have policies. Keep them running, but there
will be no assessing done until we have policies in place. Because | don’t see how you work, | just
can’t for the life of me understand how you are establishing equity here in the City. And | wish | could.

| am meeting with John Griffin on Thursday and | will have a chance to talk to him. | am really
disappointed with the Mayor, | feel you have been extremely harsh with me about my data and not
being truthful. | think what disappoints me most about the City is there has been such an effort to
discredit the individual rather than address the issue and it is not a political issue. This has been going
on for 10 years. | am looking at 10 years of data, this has been going on along time. So it transcends
any one Mayor, any group of Aldermen; it’s just the way it has been. | think we should address it as an
issue and not a political issue.

It has been a little tiring to be discredited as an individual rather than be treated with somebody that you
want to address the issue. Thank you.

REMARKS BY THE MEMBERS OF THE BOARD OF ALDERMEN

Alderman Klee

| would just like to address something that the Mayor had mentioned about the Safe Station Program on
Thursday. | am going to be attending that, the all day program from morning until early evening.

Alderman Lopez

With regard to the first public comment | wasn’t there and | didn’t observe it and | know first-hand that
when escalation happens people see differently, say things they regret. But | will say as somebody
who is legally blind, | do not like it when people say, “Oh so you can see”. It is something that | struggle
with every day to try to overcome and to make sure that | am living my life the best life that | can. |
don’t make a huge fuss out of it and | don’t demand everybody bow down and recognize my disability
as though it is something that they are obligated to fix.

But it can be deeply felt when you tell somebody, “Oh well what you’ve been saying to me before isn’t
true, you are able to do things and you are just faking it”. | would just advise everybody to be a little bit
more sensitive to how that can be interpreted. Because that hurt particularly can color a lot of issues
and cause a lot of hurt feelings.

On a more positive note, | participated in the Awareness is Healing Walk this weekend and | have to
say it was a great time. There were a lot of people coming together to acknowledge people that we
have lost to the opioid crisis but also to really share this strength that comes from the shared
experience of that loss. In my mind, it reaffirmed my own opinion that the recovery community is our
way forward. | think if we are going to look at Safe Station as an intervention, we need to be looking at
recovery as a pathway forward, | think programs like Revive, Rise Above Hearts, they offer peer
support and community networking that people in recovery that are trying to overcome tremendous
setbacks, really benefit from.

| think the process of trying to build your life to be a more positive one and consciously self-assessing is
when we all do and we all benefit from. But to be able to take an honest look at yourself and
acknowledge something like substance use disorder, it will make you a tremendous person if you are
supported and you get the resources that you need. These are people that we can really benefit from
having in the community and not suffering from addiction or substance abuse disorder.

| definitely appreciated the Awareness is Healing Walk and there’s another walk coming up this Sunday
because it seems like my whole life is just a big long walk. The Crop Walk is an annual event that is
very nice here in Nashua and it supports Church World Service but it is to recognize people the world
around who have trouble meeting their basic needs, getting clean water, getting food, providing for their
families and the distance they have to walk in a non-industrial world. | think that is particularly relevant
this week where we are hearing so much in the news cycle about how there is a caravan of people
coming from Central America looking for hope, walking. | think it is something we can all pay attention
to that there are needy people here and there are needy people elsewhere and they are not as
unconnected as you would think. What happens in the world happens here too.

Alderwoman Melizzi-Golja

Yes | just actually have a question for you Alderman McCarthy. | had sent an e-mail regarding the
presentations for the Performing Arts Center scheduled on November 7" and November 14! around
the financial pieces, | believe the one on the 7" is with the consultant and the one on the 14" is with the
person who is going to be talking about tax credits. And when we had the meeting with Director
Cummings presentation, at the end of that meeting, | requested that those be joint BOA/PAC meetings
and the response was that would be worked on.

Southwest Park Rectangular Fields — Long Term Priority “B-3”

The need for additional rectangular fields for soccer, lacrosse, and cricket has increased dramatically
over the past 15 years. The current usage exceeds the usable capacity of our existing fields. This issue
has led to poor field conditions and the inability to take fields off-line for needed repairs. The addition
of one or two fields in the area off of Gilson Road would go a long way in spreading out the use of these
rectangular fields and would allow us to take a field off-line for a true renovation.
