P320 grip modules

The one trigger assembly pictured above can be utilized in any of the three grip module sizes, and
even across different calibers. The latter not being a need of the Nashua Police department at this

time.

The advances in design of the Sig Sauer P320 present a similar situation that we experienced with
the M&P as compared to the Glock almost ten years ago. A constant complaint with the Smith and
Wesson M&P has been the trigger pull and reset. This was improved over the years but remains sub
optima! in the opinion of many of our officers.

. Recent quotes received for all three pistols are within a financially acceptable range.

e Smith and Wesson $55,716.85
e Glock $44,457.89
e Sig Sauer $52,729.95

A 2015 report detailed an extensive Test and Evaluation process conducted by the Hawaii
Department of Public Safety. It identified the Sig Sauer P320 to be the clear winner of the process.
Other firearms included in the testing process were the Smith and Wesson M&P 9 and the Glock 17.
Testing categories included safety features, accuracy, reliability and performance in adverse
conditions. A copy of this report is attached.

In January of 2017 Sig Sauer was awarded the United States Army Contract te replace the M9
Beretta pistol. This is a 580 miilion dollar contract spanning ten years. The P320 is the firearm that
was selected in the extensive test and evaluation process conducted by the U.S. Army. The
evaluation process started in August 2015 and the P320 beat out both Glock and Smith and Wesson.

Caliber

As noted earlier the Nashua Police Department has been utilizing .40 caliber handguns since
approximately the mid 1990's. Advances in bullet technology have resulted in many law enforcement
agencies, including the FBI, returning to the 9mm round. A 2014 document produced by the FBI
training division in Quantico outlines the justification for this decision. The report is attached but some
highlights from the executive summary are listed below

e Handgun stopping power is simply a myth

e The single most important factor in effectively wounding a human target is to have
penetration to a scientifically valid depth (FBI uses 12 to18 inches)

* 9mm Luger now offers select projectiles which are, under identical testing conditions
are outperforming the premium line .40S&W projectiles.

e 9mm Luger offers higher magazine capacities, less recoil, lower cost (both in
ammunition and wear on the weapons) and higher functional reliability rates.

e The majority of FBI shooters are both faster in shot strings and more accurate with
shooting 9mm luger vs shooting a .40 S&W.

Although these are simply a few highlights, the full document compels me to recommend a transition
to the 9mm luger round for the Nashua Police Department

Holsters

Moving away from the Smith and Wesson Brand will require the purchase of new holsters. Our
current magazine pouches are compatible with the Sig Sauer magazines and will not need to be
replaced. A recent quote for the Sig Sauer P320 pistol totaled $52,729.95 including new holsters and
with the trade in of our current duty pistols. Of that amount approximately $25621.00 is the cost of
the holsters. Our current holsters are approximately ten years old. There is no specific life expectancy
of the holsters and it is determined by wear and tear. However because of age we are currently at a
point where we are regularly replacing holsters due not only to external damage, but to simple wear
to the interior of the holster. In essence we have reached a point where the holsters are being
replaced, just over a longer period. Furthermore our specific model holster is slated to be
discontinued in the near future due to a design upgrade. The new model will have the same features
however there may be a minor change in appearance. The financial consideration for the
replacement of the holsters is significant, however our handgun is the most important piece of
equipment we issue and proper selection cannot be overstated.

Additional Considerations

Sig Sauer's corporate headquarters and production facility are in Newington N.H. The training facility
is in Epping N.H. Access to customer service, gunsmithing services, and parts will be immediate.
Most of the relationships are already established as we attend many training opportunities at Sig
Sauer Academy and have purchased a number of Sig Sauer rifles. | feel it would be accurate to
classify the current business relationship with Sig Sauer as excellent. They provide a tremendous
amount of support to Law Enforcement in New Hampshire.

Conclusion

It is the recommendation of the Professional Standards Bureau that the Sig Sauer P320 in 9mm be
selected as the issue handgun of the Nashua Police Department during the next replacement cycle.
This firearm and ammunition recommendation is based on in house testing by Firearms Training Unit
officers as well as officers from the various divisions. The opinions developed in house are further

supported by research mentioned previously.

attorney’s fees, costs and expenses of any kind or nature in any manner caused, occasioned, or
contributed to in whole or in part by reason of any negligent act, omission, or fault or willful
misconduct, whether active or passive, of Professional Engineer or of anyone acting under its
direction or control or on its behalf in connection with or incidental to the performance of this
contract. Professional Engineer's indemnity and hold harmless obligations, or portions thereof,
shall not apply to liability caused by the sole negligence or willful misconduct of the party
indemnified or held harmless.

FISCAL CONTINGENCY All payments under this contract are contingent upon the availability to the
City of Nashua of the necessary funds. This contract shall terminate and the City of Nashua's
obligations under it shall be extinguished at the end of any fiscal year in which the City of Nashua
fails to appropriate monies for the ensuing fiscal year sufficient for the performance of this contract.

Nothing in this contract shall be construed to provide Professional Engineer with a right of payment
over any other entity. Any funds obligated by the City of Nashua under this contract that are not
paid to Professional Engineer shall automatically revert to the City of Nashua’s discretionary
control upon the completion, termination, or cancellation of the agreement. The City of Nashua
shall not have any obligation to re-award or to provide, in any manner, the unexpended funds to
Professional Engineer. Professional Engineer shall have no claim of any sort to the unexpended

funds.

. COMPENSATION Review by the City of Nashua of Professional Engineer's submitted monthly

invoice forms and progress reports for payment will be promptly accomplished by the City of
Nashua. If there is insufficient information, the City of Nashua may require Professional Engineer
to submit additional information. Unless the City of Nashua, in its sole discretion, decides
otherwise, the City of Nashua shall pay Professional Engineer in full within 30 days of approval
of the submitted monthly invoice forms and progress reports.

COMPLIANCE WITH APPLICABLE LAWS Professional Engineer, at all times, shall fully and
completely comply with all applicable local, state and federal laws, statutes, regulations,
ordinances, orders, or requirements of any sort in carrying out the obligations of this contract,
including, but not limited to, all federal. state, and local accounting procedures and requirements,
all immigration and naturalization laws, and the Americans With Disabilities Act. Professional
Engineer shall, throughout the period services are to be performed under this contract, monitor for
any changes to the applicable laws, statutes, regulations, ordinances, orders, or requirements, shall
promptly notify the City of Nashua in writing of any changes to the same relating to or affecting
this contract, and shall submit detailed documentation of any effect of the change in terms of both
time and cost of performing the contract.

. NONDISCRIMINATION If applicable or required under any federal or state law, statute, regulation.

order, or other requirement, Professional Engineer agrees to the following terms. Professional
Engineer will not discriminate against any employee or applicant for employment because of
physical or mental handicap in regard to any position for which the employee or applicant for
employment is qualified. Professional Engineer agrees to take affirmative action to employ,
advance in employment, or to otherwise treat qualified, handicapped individuals without
discrimination based upon physical or mental! handicap in all employment practices, including but
not limited to the following: employment, upgrading, demotion, transfer, recruitment, advertising,
layoff, termination, rates of pay, or other forms of compensation and selection for training,
including apprenticeship.

Without limitation of the foregoing, Professional Engineer's attention is directed to “Title 41”’Public
Contracts and Property Management” C.F.R. Subtitle B “Other Provisions Relating to Public
Contracts” Section 60 “Office of Federal Contract Compliance Programs, Equal Employment.
Department of Labor” which, by this reference, is incorporated in this contract.

ee i Test & Evaluation (T&E)

DPS conducted a comparative evaluation following specific T&E procedures
| and protocols. The T&E assessed firearm performance of four (4) models (see
» +| T&E Results), testing features and function to obtain quantitative and qualitative

“| data relevant to reliability, accuracy, ease of operation, safety, care and
“4 maintenance, and costs.

-| The T&E provided the opportunity for invaluable End User input and validation
1 at the officer level. 103 officers or approximately 6% of the uniformed staff,
-| including 66 ACO's, actively participated in 18 days of live fire testing. End
-| Users fired over 40,000 rounds in five tables of fire, testing all aspects of firearm
-| function and features.

| Department Requirements

The Departments Firearms Training Unit (FTU) relied upon a 2013 National
Institute of Justice study that revealed 92% of reporting law enforcement and
corrections agencies employed “striker fired,” “double action only” pistols. The
{ primary factor behind the transition to this type of firearm as the predominant
pistol in Law Enforcement is due to initlal purchase price, reliability, durability,
availability of parts, ease of use and maintenance.

| As a result, the FTU contacted Beretta, Colt, Glock USA, FN America, Heckler
| & Koch (HK), Kimber, Strum Ruger, Sig Sauer, Smith & Wesson, and
| Springfield Armory for information and proposals for a T&E of this type of
-| firearm. Only Glock, FN, HK, Sig Sauer, S&W and Springfield Armory
| responded. However, FN, Sig Sauer, and Glock submitted proposals that met
the cost requirement of $450.00 or fess per unit.

Acceptance of Specialized Test Documentation

The FTU accepted manufacturer documentation of Specialized Test results,
these tests comply with industry standards for Law Enforcement firearms and
ensure minimum safety features and reliability during standard and abusive
handling.

Revision A: This is an equipment standard developed by the Office of
Law Enforcement Standards of the National Institute of Standards and
Technology.

Test Criteria

Department Armorers, Firearms Instructors and End Users conducted a
| comparative evaluation of the sample weapons provided by FN, Glock, Sig
| Sauer and Smith & Wesson against the following criteria.

ANS! / SAAMI 2299.3-1993. Voluntary Industry Performance Standards
for Pressure and Velocity of Centerfire Pistol and Revolver Ammunition
for the Use of Commercial Manufacturers.

American Society for Testing and Materials (ASTM) Testing Standards
for Corrosion and Wear - MIL STD 8710 tests. Data reporied from either
test was acceptable.

Live Fire testing of all four handguns began on March 17, 2015; however, the
FNS-9 and FNS-9C were removed from the test due to numerous malfunctions,

| stoppages and safety concerns.

; At the conclusion of the T&E, the data clearly depicted the Sig Sauer P320 was
| the best firearm for the Department and our officers.
