ORDINANCE

AUTHORIZING STOP SIGNS ON BEACON, BEARD, HIGHLAND AND LOCUST
STREETS AT THEIR INTERSECTION WITH AUBURN STREET

CITY OF NASHUA

In the Year Two Thousand and Twenty

The City of Nashua ordains that Part Ii “General Legislation”, Chapter 320 “Vehicles
and Traffic”, Article II “Stop and Yield Intersections”, Section 320-4 “Stop intersections”,
subsection D of the Nashua Revised Ordinances, as amended, be hereby further amended by
adding the following new underlined language in the appropriate alphabetical order:

“§ 320-4. Stop intersections.

D. The following intersections are hereby designated as stop or through streets, and
authority is hereby granted for the erection of a stop sign at the corner so
designated in accordance with the tenor of this chapter:

Stop Sign on Sign Location At Intersection of
Beacon Street Northwest corner Auburn Street
Beard Street Southeast corner Auburn Street
Highland Street Northwest corner Auburn Street
Locust Street Southeast corner Auburn Street”

All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

This ordinance shall become effective at the time of removal and/or installation of the necessary
sign(s) and/or device(s).

PURPOSE: Authorizing stop signs on Beacon, Beard, Highland and Locust
Streets at their intersection with Auburn Street

ANALYSIS

This legislation authorizes stop signs on Beacon, Beard, Highland and Locust Streets at their
intersection with Auburn Street.

The erection, removal and maintenance of all traffic control devices must conform to applicable
state statutes and the latest edition of the manual on Uniform Traffic Control Devices. RSA
47:17 Vill (a). The Senior Traffic Engineer has provided the following information:
Each of these stop signs meets warrants. Installing a stop sign on a minor street approach
to a major street merely reinforces the appropriate yielding of the right of way by
motorists. The roads that the stop signs would be on are local roads; Auburn Street is
considered a collector road.

ORDINANCE

ALLOWING PERMITTED OVERNIGHT ON-STREET PARKING ON EIGHTH
STREET

CITY OF NASHUA

In the Year Two Thousand and Twenty

The City of Nashua ordains that Part II “General Legislation”, Chapter 320 “Vehicles
and Traffic”, Article XIII “Night Parking” Section 320-78.1 “Overnight on-street parking
program in designated downtown areas”, subsection E of the Nashua Revised Ordinances, as
amended, be and hereby is further amended by adding the following new underlined language in
the appropriate alphabetical order:

“320-78.1. Overnight on-street parking program in designated downtown areas.

There shall be a program for on-street overnight parking as described below.

E. The streets where overnight parking is permitted are as follows:

Eighth Street East side”

All ordinances or parts of ordinances inconsistent herewith are hereby superseded only to the
extent necessary to effectuate this legislation.

This ordinance shall become effective when the necessary signage and pavement markings are in
place.

Allowing permitted overnight on-street parking on Eighth
Street

Alderman Thomas Lopez

Revenue: permit fees of $10 each. Possible loss of revenue
from overnight parking tickets. Estimated cost of materials,
labor, and vehicle overhead for signage only: $156.

ANALYSIS

This legislation adds Eighth Street to the overnight on-street parking program. Pursuant to
subsection A(1) of the ordinance, residents of the streets where overnight parking is permitted
are allowed to purchase an annual permit, with a maximum number of 550 permits to be issued.
The Police and.Fire Departments did not have any objections to this request.

A Public Hearing was conducted by the Board of Aldermen on Monday, January 27, 2020, at 7:00 p.m. in the
Aldermanic Chamber.

The roll call was taken with 11 members of the Board of Aldermen present; Alderman Dowd, Alderman Caron,

OK. Forgive me | am getting my computer out. Ok | will call to order the Public Hearing for R-20-004 relative to the
supplemental appropriation of $350,000.00 of FY2020 unanticipated revenue from Department Number 152 FIRE,
Accounting Classification #44, “Charges for Services into Department #152 FIRE, Accounting Classification #151,
Salaries & Wages’.

We will take these one at a time. | am actually going to allow conversation on both of these at the same time. The
other is R-20-008, Authoring the Mayor and City Treasurer to issue bonds not to exceed the amount of $1,400,000.00
to purchase a new 2020 Pierce Arrow XT Red Aerial Ladder Truck for the Fire Department. Right now | will take
testimony in favor. We need an explanation.

John Griffin, Chief Financial Officer for the City. This particular request resolution is to make things easier going
forward. As you recall, when we had a spending cap we were concerned about increasing appropriations in various
departments. The Fire Department had done an excellent job in securing $350,000.00 in fees from our ambulance
service. So last year when we prepared the budget, we weren’t sure if that particular plaintiff request to overturn the
local court’s order on the spending cap was going to end the way it did, which there is no spending cap.

NHDOT Specifications, Standards, and bid item nomenclature will be used for the
construction documents.

A single construction contract will be used to complete the proposed work.

The cost of providing officers and flaggers required for traffic control during geotechnical
investigations are included.

The City of Nashua will arrange for meeting space for committee and public meetings.
Coordination with existing utility companies is anticipated and included in this scope.
The project will not impact the existing bridges over the Merrimack River.

FHVVA is the lead federal agency for the NEPA Categorical Exclusion.

Permit fees will be paid for directly by the City of Nashua and are not included in this scope
of work.

Construction services are not included in this scope.

. Further coordination with the Army Corps of Engineers is not included in this scope for a

pathway from the roadway elevation to the pathway along the levee.

So we kind of conceptualized creating a revolving fund which is allowed by State Law to put revenues in for specific
purpose; one of which is Fire Operations. As you recall in the Budget last year, we increased the number of
dispatchers in the Fiscal 20 Budget. So we were going to match the $350,000.00 with $350,000.00 in dispatcher
costs. As you recall from last year, those of you that were here, we put a $350,000.00 negative number. | know
Alderman Clemons remembers this, we put a $350,000.00 negative number to reduce the budget simultaneously
indicating that there would be a transfer to the revolving fund.

Senior Accounting Manager Evans and | were talking about this Resolution and what we should do, and we felt it was
more transparent if we don’t go forward with the revolving, keep the cost and the expenses of the dispatching
operation in the Fire Department and simply ask that this become a revenue source in the Fire Department, the way
the budget is set. So essentially we will have $350,000.00 coming in with the other revenue that the Fire Department
generated and there will be a simultaneous elimination of that minus $350 that keeps the cost in the budget. And the
good news about this is that there is no impact on taxes. So this is one of those supplemental appropriations that will
not impact the taxes, either now or going forward. So with that, that’s the explanation.

| just wanted to mention that Alderman Dowd who is supposed to be chairing tonight is not feeling well and will not be
joining us; as well as Alderman is sick. So | only mentioned two but there are actually four people that were under the
weather this evening.

That’s right.

Do you just want to give a brief explanation for 20-008?

It’s the Fire Department and perhaps Mr. Fredette will be ready to provide that testimony in favor.

While he’s talking about the $350,000..00 could | be permitted to ask a question?

Sure.

At the risk of stating the obvious it sounds to me like we are getting $350,000.00 from AMR in order to help pay for
the cost of the dispatchers who also provide dispatching services to AMR. This is just accounting for that

$350,000.00 and it’s not talking about any increase in any new money for the City. This $350,000.00 is coming from
AMR? Is that correct?

John Griffin, CFO that is correct. Whoever comes up with the Fire Department may be able to add a little bit more,
but it’s, | believe, a 10-year agreement with AMR where the $350,000.00 is for the initial year. It increases each year
thereafter so what this will do is have a place for the revenue to come in, whatever the amount is and maintain with
the Fire Department Budget for transparency purposes, the cost associated with the dispatching operation. It is not
meant to be a one-for-one, it’s not meant to cover the entire cost of dispatching, but it was a very good effort on the
part of the Fire Department to negotiate with AMR through a bidding process to come up with this particular funding
stream.

REMARKS BY THE MAYOR

Mayor Donchess

First of all Happy New Year to everybody. The first meeting of the new term 2020. I'll have to get used to this
new lineup and looking at different faces. | wanted Madam President to mention a few different items tonight.
First the community power proposal which is one of the resolutions being introduced tonight. This is an action
pursuant to enabling legislation at the State level which enables communities to purchase power on behalf of all
Eversource customers both residential and business customers.

Now there’s a procedure we have to go through to reach this community choice power. In the legislation they
call it “aggregation”. We need to form a study committee which will make a recommendation to the Board of
Aldermen and then the Board of Aldermen has to vote to proceed. The city of course is already purchasing and
selling energy. We purchase bulk for the city under a single contract and the School Department does the
same thing. We also sell power from our hydroelectric dams. We estimate that if we undertake this project, and
you will get many more details later, we can save about two cents a kilowatt on average on every Eversource
bill which for a residential consumer could mean about $150 a year depending upon their usage of course. It
could mean more for a small business or even a medium sized business. It’s everyone who is an Eversource
customer.

Now the customer does not see any difference in the way they are treated in the sense that they receive a bill
from Eversource. Eversource of course continues to distribute power. Eversource gets paid for the distribution
portion of the bill. Also the demand charge. The only thing that’s different is the charge for the kilowatt on the
bill is different and we’re saying could be on the average two cents a kilowatt less.

The word “choice” is there. Community choice power because anybody who wishes to opt out will have the
ability to do so. They can just opt to stay with Eversource. Anybody who does not make that choice would
become part of the community choice power project and this option exists not only at the beginning but at any
time during the future. A person can try it out, opt out. They can wait a year, ten years, whatever it is but
there’s always the option to leave or to come back if they want to do that. | think as we begin to get into the
