I virtually attended the Board of Aldermen Meeting this evening. I prepared a written 3 minutes
statement for public input regarding my RTK lawsuit heard in court in December. The meeting
lasted under 30 minutes. I was the only one to give public comment. The time started and I hit my 3
minutes with another sentence and half to finish. I lost 10 seconds announcing my name and
starting my own stopwatch to track my time. Witchy Wilshire scolded me because I had exceeded
my time by 15 seconds. This is not how public input should be treated, The City allocates 15
minutes for a public comment period according to policy and if no one is there to speak, there
shouldn't be such a rude outery from the President to shut down a member of the public. I have
watched friends of Wilshire speak at public input and exceed their time by almost a minute. She
graciously accepts the indulgence. I believe I have been extraordinarily compliant with the 3
minute rule but receive an unjustified hostile interruption and objection.

I guess I should be thankful that WIlshire doesn't control the button to my chair. I could be floating
in a tank of cold water!

My Public Comment read into the record on January 11, 2022

| finished a RTK lawsuit regarding Nashua’s Assessing records in December in Superior Court.
One of the challenges involved the records returned by the contracted appraisal company
responsible for creating the 2018 assessments. The contract signed by the City and the
company is a boilerplate document developed by the Department of Revenue and widely used
by municipalities around the state.

The contract calls for all documents and property record cards used to create the new values
to be returned to the city when the contract ends.

| filed a RTK to inspect these documents and was denied by the City under the 91-A exemption
for draft material and confidential information. | contacted many chiefs throughout the state,
the DRA and attended the assessing standards board’s meetings in Concord. | questioned

everyone on the confidentiality and draft nature of this information. Not one qualified person
backed Nashua decision to make all those records exempt from public disclosure

| wrote back to the City three times, presenting a new argument each time on the importance
of these materials being public. These records provided an audit trail for the work done by the
hired company and they allowed a property owner to verify that Nashua created equity in
these new assessments.

After three months of denials, | added this to my lawsuit. | then wrote formal RTK requests to
4 Towns to request to inspect the records returned by their hired appraisal company. Unlike
Nashua, my requests were answered in a matter of hours. One request was to the town of
Moultonborough where | own a home. Chief Hughes, who served as the Director for the DRA,
invited me up to inspect the records, expounding that these are “your” records. Chief Michaud
from Hudson, granted written access to the records, the Wolfborough assessing clerk also
welcomed me in to inspect the records and finally, | contacted the assessor in Littleton. Why
did | pick Littleton? Because the Littleton assessing office is contracted to KRT, the company
we hired to do our 2018 assessment. The contract language for the returned data was
identical and KRT did the same type of 2018 update as was done in Nashua. When | called
Littleton assessing Chief Dorsett from KRT, | wondered how far my reputation had reached.
Mr. Dorsett immediately stated these records, if we still have them available, are public
records and affirmed his remarks in a written response. This information was presented in my
case to the court. WHY DID NASHUA DENY THESE RECORD?

When Ms. Kleiner was placed as acting Chief of the Assessing office, | objected strongly. She
did not have the skill set to be qualified for such a technical position. Ms. Kleiner assured the
Board that she would consult with chiefs around the state to verify that her work was
compliant. In the December, under cross examination, Ms. Kleiner stated that she never spoke
with other state experts about the public nature of these records. Had | lived in any other
place in NH, | would have had access to these records. Ms. Kleiner deliberately acted to shut
down the audit trail that allowed me to verify my property assessment and defend it in court
as well as KRT’s work.

This matter is now in the hands of a Judge and should not be. This was a needless, costly legal
challenge based on City incompetence, vengeance and retaliation.

Dear Honorable members of Nashua’s Boards,

| wanted to share my thoughts on the Board of Health meeting on Wednesday, January 19, 2022,
regarding reaffirming the Nashua mask ordinance.

As acitizen paying attention to the “science” and information, | feel the Board of Health and
Board of Alderman have sent mixed messaging and eroded public trust.

Under the City Charter, the Board of Health is empowered to:
§ 81. Board of Health, to make rules
The board of health may make such rules and regulations relating to plumbing, sanitation
and drainage of buildings and connection with public sewers, as in their judgment the
health and safety of the occupants or the public may require. They may also make such
rules and regulations relating to the public health as in their judgment the public health
and safety may require. All such rules and regulations shall be subjected to the action of the
board of aldermen approving the same.

| have heard, repeatedly, from members of the Board of Health that they don’t make the rules,
only recommendations, but, in fact, | believe it is your job to make the rules. The Board of
Alderman has the final authority to enact and adopt those rules.

Here are some thoughts on data collection and messaging:

[1] Stop providing national statistics in your reports. It is a droning message that is not effective.
Develop more data that is centered on Nashua.
