Thank you Mr. Mayor. | just wanted to clarify for those that aren’t familiar with the area that we are looking at, it
is over by the old Nimco Building, the Industrial park entrance there. At certain points the Sculpture
Symposium work would happen over in that area and so on. And in the Purchase & Sale Agreement, maybe
this for Mr. Cummings or Ms. Chizmas, at one point we were negotiating with the entire group. Is that not

correct to try to put the dog park in there because the property was more or less owned by the entire, | don’t
know what you would call it, consolidated group?

Mayor Donchess

The Mill Yard Association. So initially we were just trying to get their permission to locate but some members of
the Association were not absolutely supportive of that. So in the end, the decision was made to negotiate an
outright purchase, which is better anyway because then we will own the land and control it absolutely.
Alderman Klee

And | agree, thank you very much. | just wanted to make that clear for where the location of it was so that

those that are listening would understand and | wanted more clarification on the Purchase & Sale versus
“trying to work it out”. Thank you. | think this is a better way of doing it.

Yes thank you Mr. Mayor. Just two things. | thought when we first started talking about this that this piece of
land was land that the City owned. So the choice, the best parcel is a piece of land that the City doesn’t own?

Yes. The City does not own this land.

Huh, OK. | didn’t realize we had to purchase land. So one other question | have is we are not sure this is
feasible so we are going to do a feasibility study, correct? But we’ve decided to buy the land regardless of the
results of the feasibility study? That’s my question, why would we do that?

Director Cummings

If | may Mr. Mayor?

Yeah.

Director Cummings

Yes, thank you. So | think the point is a good one raised and essentially the question previously or the
statement previously made actually answers the question. | think most people are already under the
impression that that land is city owned and most people treat it and think of it and use it as a trailhead for the
entrance or the gateway to Mine Falls Park. Technically that is inaccurate and what this does is just kind of
correct that. So despite whether a dog park is actually achieved, which | hope it is, nonetheless you'll have a
gateway, an entrance to the Mine Falls Park entrance with this property that has been already traditionally
thought of or used culturally as such. So this is just really cleaning up something that | think the community
has already used and treated in such a way.

So there are two things; number one — as Tim just said, people do think of this as part of Mine Falls Park and it
is actually not owned by the City. Number two | think the name of the study, this title was arrived at before the
idea of really purchasing this parcel was arrived at. So | think those involved, Ms. Chizmas, Alderwoman Klee
would say that the likelihood that a dog park can be established here is a very high probability that might be an
understatement. But the feasibility had to do with looking at different places and how could it be done. So |
don’t think there’s much or any doubt that a dog park can be established here is that correct?

Ms. Chizmas

That’s correct. And one thing that this study is doing is in addition to looking at the land it will provide us with a
design for a dog park in this location that fits the land that it can work in. It will also provide us with an
operations and maintenance plan for operating the dog park, making sure that it is done environmentally
soundly because it is in a wet area so we want to make sure that the waste management is taken care of and
done responsibly. It will help us identify opportunities for grants and funding to make sure that we can do this
successfully. So the land is one thing but there’s a whole bunch of other components to the study that will help
us make sure that we can operate it.

| wanted to make it clear, unless | am mistaken, the City is part of the Mill Yard Association is that not correct?
Mayor Donchess

That is correct.

Alderman Klee

So we are kind of a member of that Association which is another reason why we chose this. It works better to

buy it but it is not like the City wasn’t already part of the Association because of the Nimco Building and so on. |
just wanted to get that clarification out there for you Alderwoman Lu.

So | just wondered, | understand, | mean even if you feel certain that you still feel that a $50,000.00 investment
in a feasibility study is a good idea and | just, you know, it just seems unusual that you would — this piece of
property probably doesn’t have a lot of other people trying to buy it so why you wouldn’t wait until after you had
the report done and then bought it. But a purchase of property goes through the Board of Aldermen?

Mayor Donchess

This is not to approve the purchase. This will require an appropriation of money to make the purchase take
place. Now as it happens there were other people that wanted to buy this parcel. As soon as the City
indicated that we wanted to acquire it, and again, even if weren’t for the dog park, this should be acquired as
part of the park to prevent the following. The competing potential purchaser and there may have been more
than one, wanted to buy it in the hopes of establishing a private parking lot down there. And the word
purchase by a private owner could exclude members of the public. So this purchase, if that had gone in that
direction it would not have been good for Mine Falls Park. So this purchase either way is a good thing for the
park and for the City and for the downtown, in my opinion anyway. Alderman O’Brien.

Thank you Mr. Mayor. | think this is a wonderful idea. So that everyone else don’t misconstrue my question but

if Mr. Cummings wants to come back or Ms. Chizmas if you can answer it as well, equally as well. Basically
from my information, | got to choose which comes first the chicken or the egg?

And in this case we are talking about a PSA Purchase & Sale Agreement yet we haven't done the feasibility
study which will test for the brown fields. So is that contingent in the PSA? You know, | am just concerned
with an industrial area if we find something.

Mayor Donchess

Yes, thank you. So yes the Purchase & Sale Agreement does have our standard due diligence period where
we could review various aspects of the land before we close on it.

And | would like to reiterate this was titled “feasibility study” when we didn’t have a definite parcel; we didn’t
know where or how to do it. The title remains but in a way the title is a little bit obsolete. This has been
pending for a long time. | mean at this point, what they are doing is advising us as to how to establish a dog
park on that parcel. You know, how it can be located so as to not interfere with any of this underground work,
how big it should be, how it should be run, what the fence should look like. So it is really no longer a feasibility
study but a recommendation as how to establish the park in this location. And Ms. Chizmas is nodding so |
think she agrees.

Thank you Mr. Mayor. Dave Boucher, Wastewater Superintendent. So part of our wastewater process is to
provide oxygen to microorganisms for their survival. We do this through three turblox blowers, they are high
efficiency blowers. They are serviced by the company BCV. Historically we have had seasonal problems
providing air, especially during the summer months. Recently we had BCV in to do an audit of our system and
determined that we have an older program that doesn’t allow certain controls to our blower system and we
need an updated program. This would allow our blowers to be operated differently and help to resolve the
issue that we have during the summer months.

The cost we are requesting covers the cost of the program, the installation and the training of the program as
well. | can answer any questions if you have any.

| wasn’t planning on it but | saw it on the Agenda so | thought | should stick around. So yes these are low or no

emission funds that were achieved, it’s a discretionary grant that was applied for us and successfully awarded.
This vehicle will replace an ancient Chevy Lumina, | think it is a — | want to say it is like a 2001.

It is a very old vehicle and this will continue towards the goal of reducing our emissions. It will also bring their
vehicles into compliance with the Transit Asset Management Goal that says we’ve got to keep, not only our
buses, but our support vehicles and our facilities in a state of good repair.

And this 85% federal?
Ms. Chizmas

| believe it is, | think it and | am sorry | didn’t have this in front of me but | want to say this one is 85% and then
15% local or it may be 7 %, if you give me a second | can look that up.

It does state that it is 85% federal transit administration.

Yeah it is just we have some grants that the State helps us fund with some of the match. So | just want to pull
that up.

This is an electric vehicle, right?

So the City’s share of this is $4,700.00.

Yes the City is contributing the full 15% matching funds.

12 months the trends app usage is about 30% to 40% of all downtown meter transactions and actually just in
the last month it is at 50% so it is a very popular payment method for visitors of the downtown.

Good evening Mayor. So back in September we awarded the original contract with DL King for a little bit over
$900,000.00. In December we came to the Finance Committee with change orders totaling a little over
$26,000.00 and those were approved. These additional change orders 4, 5 and 6 have been incurred since
then. | am happy to say we are just finishing up the Tax Office as of this Friday. These are through that part of
the project as well as changes that are already being made in the planning of starting the City Clerk’s Office.
So these additional changes total $21,481.27 which would bring the change orders for this project to a total of
$48,033.48 in total.

We did our best to identify the changes on each change order but | am here and will provide any additional
information to the Committee as it sees fit.
