ORDINANCE O-21-073

(4) The bonus density units do not count toward the base number of units for which an
Inclusionary Zoning requirement is calculated in this section. For example, a ten-
unit project with a ten percent inclusionary requirement and a 2:1 bonus density
ratio would be able to build eleven market rate units and one on-site affordable unit.
However, if the affordable unit is not provided on-site, or replaced with a fee- in-
lieu, the project could only build ten units.

F, Enforcement

(1) = Affordability of rental units shall be enforced through a deed restriction and lien
granted to the City of Nashua.

(2) Affordability of ownership units shall be enforced through a deed restriction.
Rental of affordable ownership units shall be permitted only upon notification of
the City of Nashua and demonstration of compliance with rental affordability
requirements as defined in this section.

G. Administration.

Q) This section shall be administered by the CDD, including establishing and updating
affordable sales prices and rents based on reasonable and documented

methodologies.

(2) | CDD shall promulgate regulations to further specify the details of this section,
which shall be approved after a hearing and vote of the Planning Board.”

This ordinance shall become effective immediately upon passage.

LEGISLATIVE YEAR 2021

ORDINANCE: Q-21-073

PURPOSE: Amending the Inclusionary Zoning Supplemental Use
Regulations

SPONSOR(S): Mayor Jim Donchess

Alderwoman-at-large Shoshanna Kelly
Alderman Patricia Klee

Alderman Thomas Lopez

Alderman Michael B. O’Brien Sr.

COMMITTEE Planning and Economic Development Committee
ASSIGNMENT: Planning Board
FISCAL NOTE: This ordinance will not result in any increases in costs to the

general fund. As units come on board, any monitoring costs
paid to a 3rd party contractor will be paid for out of the
housing trust fund.

ANALYSIS

This legislation amends the Inclusionary Zoning Supplemental Use Regulations.

State statute (RSA 675:2) and NRO Section 190-132 require a public hearing and referral to the
city planning board. The public hearing is conducted by the aldermanic planning and economic
development committee with notice published in a newspaper of general circulation and posted
in two public places at least ten calendar days prior to the date of the hearing. (Notice period
does not include the day notice is posted or the day of the public hearing. RSA 675:7,1.) A
favorable vote of two-thirds of all the members of the board of aldermen present and voting
would be required if a protest petition is filed pursuant to RSA 675:5. Under RSA 676:12 and
NRO Section 105-3, no building permit may be issued after the legal notice has been posted if
the proposed changes would, if adopted, justify refusal of the permit. This limitation applies for a
period of 120 days.

A regular meeting of the Board of Aldermen was held Tuesday, October 25, 2016, at 7:30 p.m. in the
Aldermanic Chamber.

President Brian S. McCarthy presided; Deputy City Clerk Judith Boileau recorded.

Prayer was offered by Deputy City Clerk Judith Boileau; Alderman David Schoneman led in the Pledge to
the Flag.

| would like to ask for a moment of silence in memory of Jacob Goulet who was lost over the weekend
The roll call was taken with 15 members of the Board of Aldermen present.
Mayor James W. Donchess and Corporation Counsel Steven A. Bolton were also present.

REMARKS BY THE MAYOR

Mayor Donchess

| wanted to follow-up on the moment of silence to mention the tragic accident that happened last Friday
night when Jacob Goulet was walking home from visiting a friend and who fell into an opening in the
storm water system near the Bicentennial Park and died as a result of that accident.

Everybody in the community has been deeply affected by this, particularly those in city government, it’s a
very sad and tragic event and we feel so badly for Jacob’s family; all parents understand how profound
the grief that they are feeling is in the sense that we can feel a little bit what it would be like to lose a
child, especially in that manner. Jacob was a sophomore at Nashua North High School and was 16
years old. He was on his way home during the rainstorm because he was mentoring another student
who had moved to Nashua recently from another community and was trying to get home on time. He
was a guitar player, a musician and he played in a band; he played bass. He was taking a number of
courses at the high school and he was really into punk music. He was well liked and | just spoke to one
person just outside whose children knew him. There are many in the community who will really miss him
and realize what a tragic accident this is. There is a vigil tomorrow night at Bicentennial Park at 8:00
p.m. and there is a memorial service at Nashua High School North where Jacob went to school to be
held at 3:00 p.m. on Friday afternoon. Of course you are all welcome to either or both of those events.

RESPONSE TO REMARKS OF THE MAYOR

Alderman Lopez

| would like to observe that the family and friends of Jacob were particularly impacted by this. As much
as all of us feel the sense of responsibility being public representatives, they are the ones who are really
hurting right now, especially the kids that he went to school with who knew him and might be thinking
about their interactions with him and how they parted. | would like to just comment that | hope everyone
who is suffering from this is reaching out, particularly students. It’s difficult enough being a teenager and
having to deal with adult issues like this affects all of us. | hope students are reaching out and | hope the
guidance counselors are well supported in the support that they are giving as well.
