Please see attached communications from Daniel Hudson, City Engineer, dated February 24, 2022 for
project specific details related to this purchase. Below please find a summary of the purchase approval
request:

Item: Paving of approximately 14 miles of city streets to include replacing nonstandard
and broken drainage, sewer castings, catch basins and manholes, ADA ramp work
and reconstructing driveway & street transitions.

Value: $4,562,802.50

Vendor: Sunshine Paving

Department: 160 Admin/Engineering

Source Fund: 54210 Construction Services/ Bond/ Wastewater Fund

Ordinance: Pursuant to § 5-78 Major purchases (greater than $25,000) A. All supplies and
contractual services, except as otherwise provided herein, when the estimated
cost thereof shall exceed $25,000 shall be purchased by formal, written contract
from the lowest responsible bidder, after due notice inviting bids.

A competitive bidding IFBO660-020922 for this project was issued on 1/19/2022 and the following bids
were received:

2022 Paving Program - Construction Contract Award

To approve the award of the construction contract for the 2022 Paving Program to Sunshine
Paving Corporation of Hudson, NH in the amount of $4,562,802.50. Funding will be
through: Department: 160 Admin/Engineering; Funds: Bond and Trust; Activity: Paving
and Department: 169 Wastewater; Funds: Bond and Wastewater; Activities: Sewer Rehab
and Stormwater Abatement.

This 2022 Paving Program construction contract is expected to pave approximately 14 miles
of City streets utilizing shim, overlays, milling and reclamation where appropriate. Other
work required includes replacing nonstandard and broken drainage and sewer castings,
repairing/replacing catch basins and manholes (sewer and drains), ADA ramp work, and
reconstructing transitions to intersecting driveways and streets.

The contract was advertised for bids on January 19, 2022. Three contractors submitted bids
on February 9, 2022 as follows:

Sunshine Paving of Hudson, NH $4,562,802.50
Continental Paving, Inc. of Londonderry, NH $4,741 ,400.00
Newport Construction Corporation of Nashua, NH $4,827,000.00

Sunshine Paving of Hudson, NH at a bid price of $4,562,802.50 is the qualified low bidder.
Sunshine Paving has successfully completed paving program contracts in Nashua of similar
scale for the last several years.

E. Bidder does not consider that any further examinations, investigations, explorations, tests, studies, or
data are necessary for the determination of this bid for performance of the Work at the price(s) bid and

relates to the Work as indicated in the BID Documents.

G. Bidder has correlated the information known to Bidder, information and observations obtained from
visits to the Site, reports and drawings identified in the BID Documents, and all additional examinations,
investigations, explorations, tests, studies, and data with the BID Documents.

H. Bidder has given written notice of all conflicts, errors, ambiguities, or discrepancies that Bidder has
discovered in the BID Documents, and the written resolution thereof by the City is acceptable to Bidder.

|. The BID Documents are generally sufficient to indicate and convey understanding of all terms and
conditions for performance of the Work for which the BID submitted.

Bidder further represents that this BID genuine and not made in the interest of or on behalf of any undisclosed
individual or entity and is not submitted in conformity with any agreement or rules of any group, association,
organization or corporation; Bidder has not directly or indirectly induced or solicited any other Bidder to submit
a false or sham BID Bidder has not solicited or induced any individual or entity to refrain from bidding; and has
not sought by collusion to obtain for itself any advantage over any other Bidder or over the City .

The requirements of the New Hampshire Revised Statutes Annotated shall apply to this project. The Bidder is

References may be contacted as part of our preliminary bid review to assist project committee in assessing Bidder

qualifications. Current City of Nashua personnel and elected officials shall not be used as references.
