we are a very invested group of neighbors and citizens are really concerned about quality of life, quality of our
properties and how we move forward based on a history. Linda Panny in the planning office was very helpful
in pulling minutes from a Board meeting back in 1987 that stated the property owners abutting the property at
that time had risen as well. Thank you for your time.

President McCarthy

| would just like to make sure that all of you understand that subdivisions are actually the purview of the
planning board and not this board. | did have an opportunity to go out and take a look at that property. | would
encourage you to carefully think about what you are going to say at the planning board, bring up the things that
were brought up the last time that apparently a subdivision was proposed there.

REMARKS BY THE MEMBERS OF THE BOARD OF ALDERMEN

Alderman Dowd

Last night | attended the Board of Education meeting. Just a couple of points. They did pass capital reserve
requests which will be coming to this board for approval. That’s to address some of the issues they have with
some of the schools and most critically the Mount Pleasant Street School with the excessive heat you’ve heard
mentioned a number of times. | think it was on the front page of the Telegraph today. That bill will be coming
to us shortly. There is no action whatsoever on the part of the Board of Education to close any school. They
have four open classrooms in the entire district. Those four are being used for other services. Closing a
school is not even an option. Also they had some funds to redo the planetarium and update the software, put
in seats. | believe the rededication is the 25 of May. I’m not sure of the time. | will try to find the exact
information and get it out to the Board.

Alderman Siegel

I’d like to thank the members of the Senior Center and their Board for putting the Fire & Fusion dinner together.
It was very successful and an enjoyable fundraiser. | think a whole bunch of us were there. Thanks to
Alderman Caron, who did a lot of work on that? The other thing is | was asked by a letter carrier to remind
everybody that this Saturday, the second Saturday in May, as in every May, you can put out a box of
nonperishable foods or a can of nonperishable food by your mailbox prior to when your mail is picked up and it
will be distributed to a food bank in the area. So help them out this Saturday.

Alderman Schoneman

Mr. Gallagher from the Conservation Commission was in and spoke earlier tonight. He reminded me, and all
of us, | guess, of the trails opening event which is May 14 at 10:00 a.m. down at the Southwest Trails Park.

Alderwoman Melizzi-Golja

| would just like to remind everyone that this Thursday evening from 6:00 — 8:00 p.m. at Nimco will be the
kickoff for the Sculptures Symposium. This year the sculptures are from India, Greece and Lithuania.

Alderman Dowd, | believe you scheduled a meeting for May 23. That is also the evening of the County

Delegation which myself and Alderman O’Brien would be mandatory that we attend that. Could that possibly
be changed?

shelters and other outdoor advertising spaces as determined by the City in its sole discretion, in writing
prior to any marketing or Advertising Contract

Scope of Service for the Nashua Transit System:

1. To place and maintain approved advertising materials on the exterior and interior of NTS fleet vehicles.

2. To place and maintain approved advertising materials on the advertising panel of bike racks located on
the front of the busses.

3. To place and maintain advertising materials on bus shelters located throughout the City of Nashua.

4. To place and maintain approved advertising materials at the Nashua Transit Center platform
advertising boxes and other locations at the Transit Center, if applicable.

5. To place and maintain approved advertising materials on additional applications as available by NTS.

Nashua Transit System (NTS) Advertising Guidelines & Procedures
Revised August 9, 2079

Nashua Transit System (NTS) has the unqualified right to display, on or in its facilities,
advertisements and notices that pertain to NTS operations and promotions consistent with the
provisions of its agreement with the Advertising Contractor. NTS reserves the right, in all
circumstances, to require that advertisements on or in its facilities includes a disclaimer
indicating that it is not sponsored by, and does not reflect the view of NTS.

Article |. Advertising Standards

A. Nashua Transit System (NTS) buses, vans, shelters, bus stops and transit facilities
constitute nonpublic forums that are subject to the viewpoint-neuitral restrictions set forth
below. Certain forms of paid and unpaid advertising will not be permitted for placement
or display on or in NTS facilities.

B. Nashua Transit System (NTS) shall not display or maintain any advertisement that falls
within one or more of the following categories:

a. Demeaning or disparaging. The advertisement contains material that demeans or
disparages an individual or group of individual as determined by Nashua Transit
System (NTS).

b. Tobacco. The advertisement promotes the sale or use of tobacco or tobacco-related
products, including depicting such products.

c. Alcohol. The advertisement promotes the sale or use of alcohol or alcohol-related
products, including depicting such products.

d. Profanity. The advertisement contains profane language.

e. Firearms or ammunition. The advertisement promotes the sale or use of firearms
or ammunition or contains an image of a firearm or ammunition anywhere in the
overall advertisement.

f. Violence. The advertisement contains an image or description of graphic violence,
including but not limited to (1) the depiction of human or animal bodies or body parts,
or fetuses, in states of mutilation, dismemberment, decomposition, or disfigurement,
and (2) the depiction of weapons or other implements or devices used in the

advertisement in an act or acts of violence or harm on a person or animal.

g. Unlawful goods or services. The advertisements, or any material contained in it,
promotes or encourages, or appears to promote or encourage, the use or
possession of unlawful or illegal goods or services as determined by Nashua Transit
System (NTS).

h. Unlawful conduct. The advertisement, or any material contained in it, promotes or
encourages, or appears to promote or encourage, unlawful or illegal behavior or
activities as determined by Nashua Transit System (NTS).

i. Obscenity or nudity. The advertisement contains obscene material or images of
nudity.

j. Prurient sexual suggestiveness. The advertisement contains material that
describes, depicts, or represents sexual activities or aspects of the human anatomy
in a way that the average adult, applying contemporary community standards would
find appeals to the prurient interest of minors or adults in sex.

k. Political content. The advertisement promotes a political figure, candidate, party,
agenda, or advocates for the outcome of an election to public office.

|. Endorsement. The advertisement or any material contained in it, implies or declares
an endorsement by Nashua Transit System (NTS) of any service, product or point of
view, without prior written authorization of NTS (through its Transportation Manager).

m. False, misleading, or deceptive commercial speech. The advertisement proposes
a commercial transaction, and the advertisement, or any material contained in it, is
false, misleading or deceptive as determined by Nashua Transit System (NTS).

n. Libelous speech, copyright infringement, etc. The advertisement, or any material
contained in it, is libelous or an infringement of copyright as determined by Nashua
Transit System (NTS), or is otherwise unlawful or illegal or likely to subject NTS to
litigation.

o. “Adult” — oriented goods or services. The advertisement promotes or
encourages, or appears to promote or encourage, a transaction related to, or uses
brand names, trademarks, slogans or other materials which are identifiable with films
rated “X” or “NC- 17,” adult book stores, adult video stores, nude dance clubs and
other adult entertainment establishments, adult Internet sites, and escort services.

. Review of Advertisement. The Advertising Contractor shall review each advertisement
submitted for display on or in NTS facilities to determine whether the advertisement falls
within, or may fall within, one or more of the categories set forth in (B) above. If the
Advertising Contractor determines that the advertisement falls within, or may fall within,
one or more of the categories set for in (B) above, then:

a. Referral to Transportation Manager. The Advertising Contractor shall promptly
send the advertisement — along with the name of the advertiser, the size and number
of the advertisements, and the dates and locations of the display — to the
Transportation Manager for review of the advertisement by NTS.

b. Initial Review by NTS. Upon the Transportation Manager’s receipt of the
advertisement and supporting information, the Transportation Manager shall review
the advertisement and supporting information to determine whether the
advertisement falls within one or more of the categories set forth in (B) above. In
reaching this determination, the Transportation Manager may consider any materials
submitted by the advertiser and may consult with the Advertising Contractor. In the
event that the Transportation Manager determines that advertisement does not fall
within any of the categories set forth in (B) above, the Transportation Manager shall
advise the Advertising Contractor that the advertisement is in conformity with Nashua
Transit System's Advertising Guidelines.

c. Opportunity for Revision by Advertiser. In the event that the Transportation
Manager determines that the advertisement falls within one or more of the categories
set forth in (B) above, the Advertising Contractor may, in consultation with the
Transportation Manager, discuss with the advertiser one or more revisions to the
advertisement, which if undertaken, would bring the advertisement into conformity
with NTS’s Advertising Guidelines. The advertiser shall then have the option of
submitting a revised advertisement for review by NTS.

d. Removal of Non-Complying Advertisements. Notwithstanding the foregoing, if the
Transportation Manager determines at any time that an advertisement already
accepted for display by the Advertising Contractor falls within one or more of the
categories set forth in (B) above, he/she shall in writing, specify which of the
categories the advertisement falls within, and notify the Advertising Contractor that
the advertisement is not in conformity with its Advertising Guidelines and that the
advertisement shall be promptly removed. Upon such instruction, the Advertising
Contractor shall promptly remove the advertisement, shall provide the advertiser with
a copy of these Guidelines, and may, with the Transportation Manager, discuss with
the advertiser revisions to the advertisement which, if undertaken, would bring the
advertisement into conformity with NTS Advertising Guidelines. The advertiser shall
then have the option of submitting a revised advertisement for review by NTS. In the
event that NTS and the advertiser do not reach agreement with regard to a revision
of the advertisement, the Transportation Manager will issue a final written notice of
its decision, which shall then be relayed to the advertiser. The Transportation
Manager's determination shall be final.

PURPOSE: Relative to the transfer of $3,250 from Department #194
“Contingency”, Account #70100 “General Contingency” to the
Nashua Airport for the purpose of funding a portion of the cost
of snow removal equipment

FISCAL NOTE: Transfers funds from general contingency to the Nashua

Airport. Reduces the balance in the general contingency
account from $88,000 to $84,750 (assuming other pending
resolution transferring funds from general contingency
passes).

ANALYSIS

This resolution transfers $3,250 from the General Contingency account to the Nashua Airport for
the purpose of funding a portion of the cost of snow removal equipment. As part of the FY2019
budget, the Board of Aldermen appropriated $17,500 for the Airport’s 5% match for the
purchase of a grader with wing plow. The actual cost of the grader is $415,000. Therefore, the
5% match is $20,750, an increase of $3,250 above the initial appropriated amount of $17,500.

Charter Sec. 53 permits the Board of Aldermen to transfer any unencumbered appropriation
balance or any portion thereof from one department, fund or agency to another. NRO § 5-130, H
provides that “when proposed legislation to transfer or reappropriate a particular appropriation or

portion thereof has had its first reading, such funds shall not be expended or transferred while the
legislation is pending”.

BETWEEN THE NASHUA POLICE COMMISSION AND THE NASHUA POLICE
SUPERVISORS ASSOCIATION FROM JULY 1, 2020 THROUGH JUNE 30, 2023 AND
AUTHORIZING RELATED TRANSFERS

In the Year Two Thousand and Nineteen

RESOLVED by the Board of Aldermen of the City of Nashua that the cost items of the
attached collective bargaining agreement between the Nashua Police Commission and the Nashua

Police Supervisors Association are approved. The collective bargaining agreement covers the
period from July 1, 2020 through June 30, 2023.

In addition, this resolution authorizes the transfer of $98,000 from Department 194,
Contingency, Account #70150 “Contingency for Negotiations” into Department 150, Police,
Account #51900 “Payroll Adjustments” for the purpose of funding FY2020 base salary
adjustments contained in the agreement.
