ORDINANCE

UPDATING THE EDITION OF MASON’S MANUAL OF LEGISLATIVE
PROCEDURE USED BY THE BOARD OF ALDERMEN

CITY OF NASHUA

In the Year Two Thousand and Twenty-Two

The City of Nashua ordains that Part I “Administrative Legislation”, Chapter 5
“Administration of Government”, Part 2 “Board of Aldermen”, Article III “Rules and Order of
Business”, Section 5-24 “Other applicable rules”, subsection A of the Nashua Revised
Ordinances, as amended, be and hereby is further amended by deleting the struck-through
language and adding the new underlined language as follows:

“§ 5-24, Other applicable rules.
A. Except in cases covered by the City Charter or other ordinances of the City, the

rules in Mason’s Manual of Legislative Procedure, 2008-2020 Edition, shall
govern the proceedings of the Board of Aldermen.”

This ordinance shall become effective immediately upon passage.

ORDINANCE

NO PARKING ON THE EAST SIDE OF A SECTION OF EAST DUNSTABLE ROAD

CITY OF NASHUA

In the Year Two Thousand and Twenty-Two

The City of Nashua ordains that Part II “General Legislation”, Chapter 320 “Vehicles
and Traffic”, Article XII “Parking, Stopping and Standing”, Section 320-69 “No parking on
certain streets”, of the Nashua Revised Ordinances, as amended, be hereby further amended by
adding the new underlined language in the appropriate alphabetical order as follows:

“§ 320-69. No parking on certain streets.

No parking whatsoever shall be permitted on the following streets during the hours and
days indicated:

Name of Street Side Location

East Dunstable Road East From a point 410 feet south of
Spit Brook Road southerly to the
Dunstable, Massachusetts town line”

All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

This ordinance shall become effective at the time of removal and/or installation of the necessary
sign(s) and/or device(s).

A special meeting of the Board of Aldermen was held Monday, April 25, 2022, at 7:00 p.m. in the
aldermanic chamber as well as via Zoom teleconference.

President Lori Wilshire presided; Deputy City Clerk Allison Waite recorded.

Prayer was offered by Deputy City Clerk Allison Waite; Alderman Richard A. Dowd led in the Pledge to the
Flag.

Let’s start the meeting by taking a roll call attendance. When each member states their presence, please
indicate if participating via Zoom state why you are not meeting in person and whether there is anyone in the
room with you during this meeting which is required under the Right-To-Know Law.

City Clerk Lovering called the roll and asked them to state the reason he or she could not attend, confirmed
that they could hear the proceedings, and stated who was present with him or her.

The roll call was taken with 10 members of the Board of Aldermen present: Alderman O’Brien,
Alderman Sullivan, Alderman Klee, Alderman Jette, Alderman Comeau, Alderman Dowd, Alderman
Gouveia, Alderman Cathey, Alderman Thibeault, Alderman Wilshire.

Alderman Moran, Alderman Lopez, Alderman Clemons, Alderwoman Kelly, and Alderwoman Timmons
were recorded absent.

Mayor James W. Donchess, Dan Hudson, City Engineer, Mark Saunders, Senior City Engineer, and John
Griffin, CFO/Treasurer/Tax Collector were also in attendance.

President Wilshire to turn the meeting over to Chairman of Budget Review Committee Richard A. Dowd.

Mayor Donchess,

Upon signing this letter of intent to contract you are acknowledging your
intent to enter into a non-cancelable advertising agreement except as set
forth in the agreed upon Terms and Conditions attached hereto.

Based on this letter of intent OUTFRONT agrees to hold the space on
contract #3434613 until July 1, 2022 or until the City of Nashua has secured
approvals to sign off on the contract whichever occurs first. The purchase
order number will be released the second week of July for the full amount for
both Media and the Non-Space agreements.

Although this is not a typical transaction, we extend this courtesy to the City
of Nashua in the spirit of civic responsibility.

RESOLUTION

AUTHORIZING THE MAYOR AND THE CITY TREASURER TO ISSUE BONDS NOT
TO EXCEED THE AMOUNT OF THIRTY-SEVEN MILLION FIVE HUNDRED
THOUSAND DOLLARS ($37,500,000) TO FUND THE SECOND FIVE YEAR PHASE
OF A TEN YEAR PAVEMENT MANAGEMENT PROJECT

CITY OF NASHUA

In the Year Two Thousand and Twenty-Two

RESOLVED by the Board of Aldermen of the City of Nashua that the Mayor of the City
of Nashua and the City Treasurer of the City of Nashua are hereby authorized to issue and sell
general obligation bonds of the City, in an aggregate principal not to exceed Thirty Seven
Million Five Hundred Thousand ($37,500,000). The proceeds of said bonds shall be used over
the second five-year phase of a 10-year pavement management project with the goal of bringing
the average pavement condition index (PCI) of the 300-mile road network to at least 87 (which is
an ASTM standard for a good service condition) at the end of 10 years. The project will
implement various pavement treatment and repair methods including routine maintenance,
preventative maintenance, structural improvement and base rehabilitation. The project also
includes work related to periodic pavement condition surveys, analyses and reporting,
management system updating, bidding documents, construction quality control and material
testing. The t0-year pavement management project followed by maintenance as needed is
expected to extend the life of the road network by 20 years.

Pursuant to Nashua City Charter $54-a, this resolution requires a ‘‘duly advertised public
hearing.” Also sce N.H. RSA 33:9, which requires a 2/3 vote for passage of this resolution.

The bonds shall be general obligations of the City of Nashua, payable as to principal and
interest from ad valorem taxes, which will be levied without limitation as to rate or amount on all
taxable property within the territorial limits of the City of Nashua.

The bonds shall bear the manual and facsimile signature of the City Treasurer and the
Mayor. In accordance with Chapter 91 of the New Hampshire Acts of 2005, bonds issued
pursuant to this resolution shall not require an authenticating certificate of a bank or trust
company doing business in the State of New Hampshire or the Commonwealth of Massachusetts,
or the Commissioner of Revenue Administration.

RESOLUTION R-22-020

The bonds are to be issued in fully-registered form by means of a book-entry system or
otherwise and shall have such terms and conditions and be in such form, subject to the provisions
of this resolution and applicable law, as shall be determined by the Mayor and the City
Treasurer.

RESOLVED FURTHER, that the Mayor is authorized to enter into the required
contracts therefor as well as any amendments to be made thereto or any other documentation
necessary for the receipt of said funds.
