Re: _ Transit Center Retrofit project change orders

The City of Nashua was awarded grants from the Federal Transit Administration for the Nashua
Transit System to retrofit the Transit Center and surrounding sidewalks and roadway.

A contract with DL King in the amount of $1,129,710 was approved by Finance Committee on
5/19/2021 and the Board of Aldermen on 5/25/2021. The retrofit project began construction in
late July 2021.

Change Order #1 in the amount of $5,611.84 includes work completed by the contractor for the
Department of Public Works (DPW) in the amount of $5,611.84. The Department of Public Works
will pay for $5,611.84 to fix the roadwork after an underground sewer line needed to be fixed by
DPW.

Change Order #2 in the amount of $11,905.95 is due to changes in the interior tile and grout to be
used in the Transit Center as well as drainage grade and pipe changes to a manhole and catch basin
due to gas utility pipe elevations. This change order also extends the period of performance by 29
days to December 15, 2021 in order to coincide with the winter shut down from NHDOT. NTS
anticipates a progress report between December 1 and December 15 from the contractor outlining
an additional time extension for both internal and external work.

The new contract price with these changes orders 1s now $1,147,227.79.

The Contract is modified as follows upon execution of this Change Order:

Description:

1. Interior tile and grout change to provide porcelain tile in place of the ceramic wall tile. Also, substitute
polymer modified grout to a laticrete epoxy grout.

2. Drainage grade and pipe changes to drain manhole # 520 and catch basin #130.
Justification:

1. The decision to change the wall tile to a porcelain tile is to match the specified porcelain tile being installed
on the Transit Center flooring. The ceramic tile specified for the walls will not match the quality or finish of the
floor tile. With this change, the quality will be higher with a strong resistance to staining and damage. The
epoxy grout substation will also provide a significant quality upgrade as the epoxy grout has a stronger
resistance to staining and mold. Making the grout on the floor and walls easier to clean with less future
maintenance being required.

2. An existing gas utility service to City Hall was discovered to be at an underground elevation that prevented
the specified 12-inch plastic drainpipe to be installed at specified location. A change was made to change the
pipe elevations and provide a reduced size 8-inch ductile iron pipe at higher grades. The ductile iron material
was selected to provide adequate strength with the new grades for both drainage structures impacted. Both
drainage structures were adjusted to accommodate the needed changes. Any changes made were reviewed

and inspected by the gas utility owner for approval.

The City of Nashua has brought together architects, performing arts center experts, community leaders, arts and
performance organizations, private performance oriented businesses, elected officials, and the broader
community to the conversation. The City and its consultants have produced a report and plan that indicate that
the 201 Main Street Building (formerly Alec's Shoes} would be the best site, and that an audience size of 500-700

is the right fit for the region.

At this time, the City is working through the process of approval for a bond measure for this project. The total
amount of the bond is $15.5 million. This bond will support both purchasing the building, and the construction
and fit up for this modern venue. In addition, project organizers will also have to raise $4 million from private
donations to make the project possible and most importantly - truly feasible. These private funds will ensure an

endowment that will produce substantial revenue, and offset the cost of ongoing operations of the project.

We, the undersigned, petition the Nashua, NH Board of Aldermen to unanimously vote yes on the passage of

legislation relative to bonding the proposed Performing Arts Center at a meeting of the full Board of Aldermen

at 7 pm on Tuesday, September 12th.

Description:
Roadway work area expanded by approximately two feet within the City of Nashua right-of-way along the
frontage of PRG. Work items are estimated according to the current bid prices at the existing contract

specified requirements. For payment, these items will be measured and paid according to the existing
contract terms, measured-in-place.

Justification:
Nashua DPW sewer main work within the limits of City Hall Way caused water service damage to the PRG

water service connection. To repair correctly, the drive apron along PRG frontage on City right of way is in
need of repair.

SUBJECT: NTC Time Extension Recommendation
Dear Camille:

GPI has reviewed the time extension request from D.L. King & Associates, Inc. submitted and dated October 24,
2021. After review, there are some comments and recommendations GPI has on the merits of the request as are
described below:

Recommendation for Substantial Completion date

The current substantial completion date for the contract is currently October 24, 2021 and includes work
features related to the contractor binder paving City Hall Way and Garden Street. GPI recommends that this
date be extended to December 15, 2021 with no general conditions cost to the City. This date matches the
NHDOT winter shut down date. At that time, the contractor is to have the site secured, the Transit Center
exterior fully operational as per pre-construction use and bus/pedestrian movements. A future time extension in
the spring of 2022 to complete roadway work will be necessary, and the contractor shall demonstrate through an
updated schedule a new completion date for all exterior work items.

Recommendation for Final Completion and Interior work date

The current final completion date for the contract is currently November 23, 2021 and includes completion of
interior work to include the occupancy permit. GPI recommends that this date also be conditionally extended to
December 15, 2021 with no general conditions cost to the City. The Nashua Transit System (NTS) is agreeable
to a temporary occupancy permit for employee-only portions of the building such as, ticketing (without bullet
resistant glass), breakroom and employee restroom. Between December 1 and December 15, the expectation
is that the contractor can provide a progress report for outstanding items to complete the rooms by December
15. Also, it is expected that long lead items, such as the bullet resistant glass have expected arrival and
installation dates. Accordingly, a new completion date for interior work may be negotiated with the contractor
with updated schedule provided.

Understanding the contractor has requested time until May 31, 2022, there currently is no supporting
documentation provided to warrant such an extension. GPI recommends the above short-term extensions to
provide time for actual schedule impacts to be understood and documented. Also understanding the urgency to
eliminate the current displacement of NTS staff, a short-term extension leaves the possibly of liquidated
damages in place if they become necessary. If you have any questions on these issues, please do not hesitate
