Pursuant to NRO: § 5-74/B: A contract that extends from the current fiscal year into succeeding

fiscal year(s) in which no funds have been appropriated nor otherwise designated for this purpose
shall be approved by the full Board of Aldermen before the contract shall become binding on the

City.

The Finance Committee has approved and placed on file the notification of the award of the
referenced contract at the December 1, 2021 meeting and as such | am requesting the full Board of
Alderman approve the following contract:

Item: Streamgage installation, operation and maintenance on the
Merrimack River downstream of the confluence of the Nashua and
Merrimack Rivers and east of the Nashua levee.

Merrimack River Streamgage - U.S. Geological Survey Three-year Agreement

To approve a three-year Joint Funding Agreement with the U. S. Geological Survey,
New England Water Science Center, New Hampshire-Vermont Office, Pembroke,
New Hampshire for installation and maintenance of a Streamgage on the Merrimack
River in the amount of $25,850. Funding will be through: Department: 169
Wastewater; Fund: Wastewater; Activity: Merrimack River Levee.

Following the flooding events of 1936 and 1938, the National Weather Service
monitored changes in elevation of the Merrimack River in Nashua, NH at the Taylor
Falls Bridge, from March 1939 through September 1953. In 1964 the City of Nashua
installed a staff gage on the western most pier of the Taylor Falls Bridge (NH Route
111 west), which is still monitored by City personnel.

In 2009, with the help of NH Department of Environmental Services, the City
reinstalled a real-time monitoring station to continuously measure river elevation at the
site. This information benefited the City by providing river height during large wet
weather events such as the May 2006 Mother’s Day floods, but the streamgage fell into
disrepair and is currently inoperable and unrepairable.

The United States Geological Survey (USGS) is interested in reinstalling a streamgage
at this location, downstream of the confluence of the Nashua and Merrimack Rivers,
and east of the Nashua levee. Through a joint agreement, USGS will install new state
of the art equipment, and provide operation and maintenance on an ongoing basis. The
data collected at the streamgage will be publicly available via the USGS WaterAlert
and WaterNow systems, providing information critical to the City’s levee operation
and maintenance and emergency management efforts.

Funding for this three year joint project will be shared as follows:

Canal St Bridge Repairs - Design Amendment No. 2

To approve Amendment No. 2 of the Canal St Bridge Repairs design contract with
Fuss & O'Neill, Inc. of Manchester, NH in an amount of $5,107. Funding will be
through Department: 161 Streets; Fund: Capital; Activity: Bridge Rehabilitation.

Amendment No. 2 letter from Fuss & O'Neill, Inc.

The Canal Street Bridge over the Nashua River is part of a critical east-west arterial
roadway traversed by approximately 30,000 vehicles per day. NHDOT periodically
inspects the bridge and has given it a rating of poor for the substructure, due to
concrete issues at the east abutment and center pier. In 2018, engineering consultant
Fuss & O'Neill was contracted to complete the design of repairs and provide
construction services for $42,543. In March 2021, Amendment No. | for $24,842
was required to cover additional environmental review and for rebidding, as an
initial bidding effort resulted in high bids, due to contractor concerns with water
levels in the Nashua River, a prime wetland.

In July 2021, a vehicle crash damaged the concrete barrier at the southwest
overlook. Additional design efforts are required to detail the necessary repairs.
DPW is currently in discussions with Risk Management to recuperate this cost
($3,577) via an insurance settlement. Also, it has been determined to be
advantageous to incorporate additional minor repairs in close proximity to the
vehicle damage area. Amendment No. 2 will address the above items.

This AMENDMENT No.2 made the day of , 2021, by and between The City of
Nashua, New Hampshire, (hereinafter called OWNER), and Fuss & O’Neill, Inc. (hereinafter called
ENGINEER).

WHEREAS, an AGREEMENT was entered into on September 10, 2018 and amended on March 11, 2021
between the OWNER and ENGINEER, which AGREEMENT is entitled “Canal St. Over Nashua River
Bridge Repairs. ”.

WHEREAS, the ENGINEER is requesting supplementary funds to perform an assessment of the concrete
rail damaged from a recent vehicle impact as well as develop repair details to be added to the current project
plans in accordance with attached EXHIBIT A- Scope of Work dated September 16, 2021.

Payment will be made in accordance with the original agreement based on hours and rates by labor category
with mark-up and incidental expenses in accordance with the attached fee, as modified for this amendment.

NOW, THEREFORE, in consideration of said AGREEMENT and other good and valuable considerations, it

is hereby agreed and acknowledged by and between OWNER and ENGINEER to amend the AGREEMENT,

President McCarthy

| have just an observation to start with. There’s a background check required for the person operating the
keno establishment, who also has to have a liquor license. Does that imply that we don’t background check
people to get a liquor license?

Director McIntyre

No. It doesn't. It’s clearly duplication. In lots of cases that’s the case.

President McCarthy

We have a resolution on our agenda this evening for a first reading to put the ballot question on. | think the
reason we wanted to get that moving is, as | understand it, we can only put the question on the ballot on our
city election this November. If we didn’t do that, we couldn’t do it until 2 % years from now on the next one.

Director McIntyre

Yes. It’s good news, bad news. Yes, you would wait two years but if you go now, all the jurisdictions around
you have to wait until the spring town elections. Your businesses benefit from the traffic. Our hope is the
benefit to this to support the children in kindergarten and help you folks pay for full day kindergarten. It’s a four
hundred and some odd thousand dollars of new money that will come to Nashua which is obviously a great
benefit. It’s an additional product to sell where a town right near you already does sell, and retail behavior
knows no geography.

Alderman O’Brien

I’m very pleased to see the sellers will be able to get the largest percent. | see it’s all going to come back to
Nashua as a grant of $1,100 per kindergarten pupil. That’s fantastic. Do we get any additional monies from
the sale of kenos or is it going strictly to kindergarten fund?

Director McIntyre

The Constitution, Article 6B, all lottery funds have to go to the education trust fund. The education trust fund is
no longer funded by us. We're a part of it, but not the whole funding of it. It just goes to that and then it is
distributed by the formula by the legislature, how they suggest it every two years.

Alderman O’Brien

If a community chooses not to have keno, do they get any kindergarten funding out of this?

Director McIntyre

They would. | would submit the benefits aren’t just to kindergarten funding. Its other things. If enough
jurisdictions say that, my fear is they are going to rethink that formula because it was certainly a topic of
conversation with the law was passed. The belief is lots of towns would take this, particularly the ones that you
can drive the across the border to Mass. There’s New Hampshire plates in that parking lot who play keno. So,
the short answer is yes, but | think that would be shortsighted.

Enclosed please find Fuss & O’Neill’s revised Amendment # 2 request for the above
referenced project. This Amendment is being submitted to include assessment of the concrete
rail damaged from a recent vehicle impact as well as develop repair details to be added to the
current project plans.

Our Scope of Work shall include:

e A site visit to assess the damage and recommendation of what repairs are needed.

e Development of a cost estimate for the repairs.

¢ Repair Details and associated notes will be prepared and added to the previously
completed plans. One submission will be made to the City for review purposes
followed by Submission of the stamped Contract Plans.

e The Special Provisions will be revised as needed and the Bid Form updated.

e =©An additional section of the rail will also be repaired that is unrelated to the vehicle

find a summary of the purchase approval request:

Item: Two 2021 Ford F550 dump body trucks equipped with a plow & Motorola two-way
radios to be used by the Parks & Recreation department for hauling, towing, and
plowing/spreading road treatment.
