Executive Summary

This document has been prepared to provide a description of the safety program plan to be
routinely utilized by Sealcoating, Inc., a roadway repair and reconstruction firm based in
Hingham, Massachusetts. Typical work activities consist of Pavement Seals, Crack Repair and
Sealing, Bridge Deck Repairs and Surface Treatments. This work activity will be performed as
an individual contractor working directly for the client/owner or as a designated subcontractor
to a project general contractor.

The purpose of the Sealcoating, Inc. safety program plan is to provide an outline of the policies,
practices and procedures that will be utilized on a routine basis for implementation of its safety
program. This document will identify a structure and delivery system that will result in the
highest level of safety performance to be achieved for the operational business entity. The basis
for the program will be a core business philosophy as well as strict compliance with all
applicable federal, state and local regulatory policy. The anticipated outcome from use of the
program will be minimal regulatory and financial liability exposure.

Sealcoating, Inc. has an overall corporate philosophy that all accidents are preventable. This
serves as a guide to its safety program which will engage at all levels of activity, to achieve that
desired outcome.

Based upon this philosophy Sealcoating, Inc. will employ a two level safety program that will
interact with all company personnel to produce operational situations that minimizes high
hazard risk workplace activity and conditions. The first level will be at a corporate level and the
purpose is to assure a uniform approach throughout the Sealcoating, Inc. corporate structure.
Key components identified with this level of the safety program are: an identified safety support
staff organizational structure; a comprehensive training program for all company personnel; and
communication/ feedback network to allow for the free flow of information associated with both
positive and negative safety situations. The second level will be at the project/ site level to
assure that site specific conditions and activities have proper planning and preparation to assure
the safe completion of all relevant tasks. Key components associated with this level of the
safety program are: dedicated safety support personnel individually assigned to each contract;
individual site specific safety plans with development based upon the contract specifications and
schedule; and the use of the job hazard analysis planning tool to identify safe work procedures
for high risk tasks.

The construction business environment is one that allows for rapid modification to type and
operational practices to occur. The safety program to be employed by Sealcoating, Inc. is
designed to be a dynamic system that will change to modified operational conditions. In the
event that changes to the amount or type of work activity may occur, the processes identified in
the safety program will be adjusted to reflect a safety approach that will be consistent with the
overall corporate safety philosophy. It should be noted that, the zero accident tolerance
philosophy will always remain a constant core value of the Sealcoating, Inc. business entity.

INTRODUCTION

This document has been prepared to provide a written description of the safety program to be
used by Sealcoating, Inc. during routine business operations. As part of routine construction
activity, safety related hazards are generated as consequential issues. In order to adequately
address these hazards, a full service contractor needs to have a program that readily identifies,
rapidly evaluates, and expediently determine appropriate corrective actions to either eliminate
or mitigate the hazard that may result in worker injury or general liability exposure. The
program described in this plan identifies the organization structure, activity level,
communication methods and a program effectiveness evaluation process that will be utilized by
Sealcoating, Inc.

1.0 CORPORATE SAFETY PHILOSOPHY

This section has been prepared to provide a description of the philosophy to be routinely
employed by Sealcoating, Inc. personnel (both management and craft) with respect to safety
related issues that arise as part of business practice. Sealcoating, Inc. views the safety of both
employed personnel and the affected public as a core value of its business charter. With that in
mind, Sealcoating, Inc. will commit the resources and time necessary to assure successful
performance on this topic, as it will with all other aspects of its business activity. This section
contains a brief description of the message to be used to define this philosophy and the
approach to properly communicate this core value to all Sealcoating, Inc. employees.

The foundation of Sealcoating, Inc. corporate safety philosophy is the Zero Accident
Tolerance concept. This concept is based upon the belief that all accidents are preventable if
the appropriate effort is expended in the elimination of hazards that are a primary factor in
accident/ loss incidents. Analysis of accident/ loss incidents has identified that the primary
factors is hazards associated with designated activity, and unfortunate timing/ circumstances.
Unfortunate timing/ circumstances are uncontrollable situations in which chance plays the
primary contributor to impact. Therefore, in order to prevent accidents/ incidents that result in
injury and negative consequences from occurring, the Zero Accident Tolerances concept is
implemented with focus on hazard identification, evaluation and either hazard elimination or
control.

Analysis of workplace hazards has identified that hazards can be classified as one of three (3)
types: unsafe acts, unsafe conditions, and acts of nature. To understand these basic
classifications can serve as a guide to the hazard identification process. Sealcoating, Inc. will
utilize all routine construction activity safety practices for hazard recognition, evaluation and
control on the understanding of the primary hazard classification. Specifically, in order to assure
that hazards are addressed to eliminate impact to workforce personnel or surroundings, an
element of pre-planning with a focus on existing or generated hazards will be incorporated all
task activities.

2.0 CORPORATE SAFETY PROGRAM ELEMENTS

At a corporate level, Sealcoating, Inc. is committed to implementing a program consistent with
the corporate philosophy described in Section 2.0 of this document. In order to address the
characteristics identified within the philosophy, a program containing multiple elements is to be
utilized. This section has been prepared to provide a brief description of those elements that are
to be implemented at a corporate level. The basic objective of having a program implemented
at the corporate level is to assure consistency within the organization.

The primary components for the corporate safety program are: an identified safety support staff
organizational structure; a comprehensive training program for all company personnel; and
communication/ feedback network. It is Sealcoating, Inc.’s belief that by having implementation
of these components conducted at the corporate level will assure the proper commitment of
resources and personnel for success. The following is an expanded description of the corporate
program components:

A) Safety Support Staff Organization — Sealcoating, Inc. has identified a structure
to meet its immediate needs from a safety perspective. A position has been
identified to serve as corporate safety director within the Sealcoating, Inc.
organization. This position reports to the president of Sealcoating, Inc. with
immediate access for full resource support. Based upon the nature of the corporate
activity, this position is to be staffed on an as needed basis with an evaluation to be
made with respect to adequacy to meet corporate needs. With respect to individual
project site needs, a site safety representative will be assigned to each project
undertaken by Sealcoating, Inc. This representative will coordinate interaction with
the corporate safety director on both a periodic and as needed basis. At this phase
of the Sealcoating, Inc. operation, the individual site safety representative may have
other responsibilities but has a clear understanding of the site safety representative
requirements.

B) Comprehensive Training Program — A training program with all company
personnel will be conducted both at the beginning of employment and periodically.
The intent of this training program is to assure proper transfer of company
requirements, rules and proper work practice. In general, all company personnel will
undertake initial training that will consist of:

e Orientation to Corporate Requirements

e Corporate Disciplinary Policy

e Activity Specific Safety Program Plan Elements

e Pre-task Planning Requirements

The periodic training that will be undertaken at various intervals dependent upon job
function will consist of the following elements:

e OSHA 10-Hour Outreach
e OSHA 30-Hour Outreach — Foremen and Supervisors
e Activity Specific Training Requirements

Additional training will be undertaken for specific task requirements as well as other
applicable topics on an as needed basis prior to undertaking any tasks with unique
hazards.

C) Communication/ Feedback System — In order to address hazard situation which
may arise associated with undertaking project activity, a communication system will
be employed on a routine basis to allow for feedback and the free flow of
information from all individuals involved in work function. This system will consist of
multiple elements to assure that information can transfer in both a “top down” as
well as a “bottom up” direction, so that clear communication on hazardous activity or
conditions are able to occur. Elements of the communication system will consist of
the following:

e Periodic corporate safety meetings

Labor/management safety committee

Project management audit teams

Foreman directed tool box talks

Job Hazard Analysis pre-activity instruction sessions

Other additional components associated with effective communication among company
personnel at various levels will occur on an as needed basis.

3.0 INDIVIDUAL CONTRACT/ PROJECT SPECIFIC SAFETY PROGRAM ELEMENTS

At the contract/ project specific level, Sealcoating, Inc. is committed to implementing a program
consistent with the corporate philosophy described in Section 2.0 of this document. In order to

B) Project Safety Plans — An individual contract/ project specific safety plan will be
developed and used on each individual project undertaken by Sealcoating, Inc. The
plan will be developed based upon provisions contained in company safety programs
and procedures as well as the unique contract specifications and other project
specific requirements. Each project specific safety plan is to be prepared prior
to undertaking any project activity and is to be reviewed and approved by the
corporate safety director. Elements of the plan will consist of but not be
limited to:

e Project organization

Roles and responsibilities

Emergency action planning

Task identification

Hazard evaluation

Corporate disciplinary policy

General safety requirements

Safe work practice methods

Reporting and documentation requirements

C) Job Hazard Analysis Planning — In order to address high hazard situations which
may arise associated with undertaking either unique or routine project activity, the job
hazard analysis planning system will be employed an as needed basis to assist in the
identification of task hazards and the appropriate methods of elimination or control. A
standardized process will be employed in which the task steps will be identified, the
associated hazards will be determined, the preferred elimination or control method will
defined, and the individual within the company organization with responsibility to assure
successful implementation is recognized. This process will be documented and modified
based upon changes to task activity or conditions. The initial or modified document will
be used to undertake training of personnel to engage in the task prior to undertaking
the task and retraining will occur if any additional changes to the document happen.

4.0 FUTURE MODIFICATION PROCEDURES

The Sealcoating, Inc. safety program is designed to be a dynamic process that will adjust to
changes in the corporate scope or mission. Periodic evaluations will be undertaken to assess if
the program addresses the needs of the company and if formal changes to processes or
procedures need to be undertaken. This section provides a brief description of the evaluation
and modification process.

An evaluation of the Sealcoating, Inc. safety program effectiveness will be undertaken on a
scheduled basis to determine if modifications are required. The assessment process will be
directed by the corporate safety director and will be reviewed by senior management. This
review will consist of the evaluation of the program elements and overall safety performance of
the company through the evaluation period. Based upon review of performance reporting items
as well as other indicators, adjustments and or addition to program elements may be
recommended. Any changes to the program plan will then be agreed to and committed to by
senior management and a revised safety program plan will be prepared and issued to all
affected entities. This assessment and modification process may also be undertaken at more
frequent intervals or on an as needed basis if corporate conditions arise that warrant the

5.0 CORPORATE SAFETY PROGRAM ELEMENTS

This section and the attachments that follow thereafter are descriptive plans of the unique task
activity methods that will be employed by Sealcoating, Inc. on a routine basis. All personnel
employed by Sealcoating, Inc. will be instructed in applicable plan requirements and
management personnel will monitor both activities and conditions to assure compliance. The
purpose of this safety process is to assure a consistent approach is employed during routine
construction activity. The following is a listing of the topic specific program plans that are
contained in this document and whose contents are to be utilized by Sealcoating, Inc. on a
