Protection and Relocation of Existing Structures and Utilities

A.

All existing buildings, utilities, pipes, poles, wires fences, curbing, property line
markers and other structures must be preserved in place without being temporarily
or permanently relocated, shall be carefully supported and protected from damage
by the contractor. Should such property be damaged, it shall be restored by the
Contractor, at no additional cost to the Owner.

The Contractor shall determine the location of all underground structures and utilities
(including existing water services, gas lines, drain lines, electrical lines, and sewers).
Services to buildings shall be maintained, and all costs or charges resulting from
damage thereto shall be paid by Contractor.

Protection or temporary removal and replacement of existing utilities and structures as

described in this Section shall be a part of the work under the Contract and all costs
in connection therewith shall be included in the Total Price Bid in the FORM OF
GENERAL BID.

On paved surfaces the Contractor shall not use or operate tractors, bulldozers, or
other power-operated equipment with treads or wheels which are shaped so as to cut
or otherwise damage such surfaces.

All property damaged by the Contractor's operations shall be restored to a condition
at least equal to that in which it was found immediately before work was begun.
Suitable materials and methods shall be used for such restoration.

Restoration of existing property and structures shall be carried out as promptly as
practicable and shall not be left until the end of the construction period.

Maintenance of Flow

A.

The Contractor shall at his own cost, provide for the flow of sewers and drains
interrupted during the progress of the work, and shall immediately cart away and

shall be fully discussed with the Engineer well in advance of the interruption of any
flow.

All existing drainage facilities including, but not limited to: brooks, streams, canals,
channels, ditches, culverts, catch basins and drainage piping shall be adequately
safeguarded so as not to impede drainage or to cause siltation of downstream areas in
any manner whatsoever. If the Contractor damages or impairs any of the aforesaid
drainage facilities, he shall repair the same within the same day.

At the conclusion of the work, the Contractor shall remove all silt in drainage
structures caused by his operations as described in Section 01740, CLEANING UP.

Rejected Materials and Defective Work

A.

Mayor Donchess

Questions?

Alderman Klee

Thank you for taking this question. It’s a question that | ask whenever | see that there is a bid and one or two bidders are
way different than the rest. | saw that Soep Painting Corp. had a bid of $634,950.00 which is significantly higher than the

other two. | don’t know if you can actually answer this but why would their bid be so much higher?

David Boucher, Superintendent of Wastewater

| don’t know specifically why theirs but some bids are based off whether they are going to need scaffolding or if they
actually have the equipment to actually, you know, like bucket trucks to reach. | Know there was a company that was
thinking about using scaffolding, but the price of scaffolding is really high right now, so they're offering to hire trucks. That
could be one of the cases, but | don’t truly why they bid so high on this project.

Alderman Klee
Okay, thank you.

Re: Phase II Pump Station Upgrade Construction Change Order #1 in the amount not to exceed $139,313.15 funded
from 54210 Construction Services/SRF Loan (Wastewater Department)

MOTION BY ALDERMAN COMEAU TO ACCEPT, PLACE ON FILE AND APPROVE CHANGE ORDER #1 TO THE
PUMP STATION UPGRADES PHASE | CONTRACT WITH DEFELICE CORPORATION OF DRACUT, MA, FOR
ADDITIONAL WORK AT SEVERAL PUMP STATIONS IN AN AMOUNT NOT TO EXCEED $139,313.15. FUNDING
WILL BE THROUGH DEPARTMENT: 169 WASTEWATER; FUND: SRF LOAN; ACTIVITY: PUMP STATION
UPGRADES PHASE II

Mayor Donchess

Mr. Boucher.

David Boucher, Superintendent of Wastewater

This is Phase II of our pump station upgrade that involves upgrading seven pump stations in the city and one combined
sewer overflow site. Some of the (inaudible) here one of them is the emergency generator costs have increased since
the initial bids came in. Our Blackstone pump station has to be moved to another location. A location that was put in the
designs did not work with the existing wet well in our pumps so that would have caused some issues with the pump
according to the pump company, so we had to have a redesign where the building was going to be located and some
piping redesigns.

Also at the Santerre pump station. We also had a wet well modification because of the direction of the gravity sewer that
went into the existing pump station. It wasn’t going to work with the new pumps that were going to go in so it has to be
redirected. There’s also things in here that will help and aid in the cleaning of the pump station in the future and the force
mains. I'll take questions.

Mayor Donchess

Anyone?

B. Any errors, defects or omissions in the execution of the work or in the materials
furnished by the Contractor, even though they may have been passed or overlooked
or have appeared after the completion of the work, discovered at any time before the
final payment is made hereunder, shall be forthwith rectified and made good by and
at the expense of the Contractor and in a manner satisfactory to the Engineer.

C. The Contractor shall reimburse the Owner for any expense, losses or damages
incurred in consequence of any defect, error, omission or act of the Contractor or his
employees, as determined by the Engineer, occurring previous to the final payment.

Sanitary Regulations

Sanitary conveniences for the use of all persons employed on the work, properly screened
from public observation, shall be provided in sufficient numbers in such manner and at
such locations as may be approved. The contents shall be removed and disposed of in a
satisfactory manner, as the occasion requires. The Contractor shall rigorously prohibit the
committing of nuisances within, on or about the work. Any employees found violating
these provisions shall be discharged and not again employed on the work without the
written consent of the Engineer. The sanitary conveniences specified above shall be the
obligation and responsibility of the Contractor. They shall not be located on private
property unless written authorization from the property owner has been provided to the
Engineer.

Safety and Health Regulations

This project is subject to the Safety and Health regulations of the U.S. Department of
Labor set forth in 29 CFR, Part 1926, and to New Hampshire law, RSA, Title XXIII:
Labor. Contractors shall be familiar with the requirements of these regulations.

Site Investigation

The Contractor acknowledges that he has satisfied himself as to the conditions existing at
the site of the work, the type of equipment required to perform this work, the quality and
quantity of the materials furnished insofar as this information is reasonably ascertainable
from an inspection of the site, as well as from information presented by the drawings and
specifications made a part of this contract. Any failure of the Contractor to acquaint
himself with available information will not relieve him from the responsibility for
estimating properly the difficulty or cost of successfully performing the work. The Owner
assumes no responsibility for any conclusion or interpretation made by the Contractor on
the basis of the information made available by the Owner.

The Contractor shall be responsible for verifying and determining the location, size,
direction of flow (if applicable) and elevation of all existing utilities, shown or not shown
on the plans. Every effort has been made to accurately depict the existing sewer system,
including sewer services. However, due to the age of the system, there are no records for
some sewer services as indicated on the plan set. These situations, including other
unknown pipes encountered during excavation, may require additional investigations. The
City may avail staff and equipment to aid in the investigation. Considerations for delay
costs shall only be given in extreme circumstances.

SECTION 01150

MEASUREMENT AND PAYMENT

PART 1 — GENERAL

1.1

A.

SUMMARY

Under the price specified to be paid for each item, the Contractor shall furnish all
labor, materials, equipment, plant, and perform all operations to complete all work as
indicated and specified. All supervision, overhead items, bond and permit costs,
protection and precautions and all other costs, incidental to the construction work,
complete, and as specified, are also included.

.A complete, finished, working job, as intended by the general nature of these

Specifications, shall be produced whether or not any particular wording or direction is
omitted or inadvertently not clearly stated.

Measurement for payment shall be by the Engineer, except where noted elsewhere in
this Specification. Measurement for payment for lump sum items shall be on the
basis of percentage of work complete and in place.

Each unit or lump sum price stated in the Bid shall constitute full compensation as
herein specified for each item of work completed in accordance with the Drawings
and Specifications.

The prices for those items which involve excavation shall include compensation for
transportation and disposal of surplus excavated material and handling water.

The prices for all pipe items shall constitute full compensation for furnishing, laying,
jointing, and testing of pipe; chlorinating, excavation and backfill; and clean up.

In all items involving excavation, the price shall be based on doing the entire
excavation in earth. Where rock is excavated, the price thereof shall be in addition to
the cost of excavating earth, and no deduction will be made in the amount for earth
excavation.

The sewer pipe being replaced is very old, in some cases installed over 100 years ago.
Although the City does extensive sewer video and field investigations to properly
locate pipes, it is not possible to depict all field conditions accurately since some
pipes cannot be investigated and/or change alignment or configuration underground.
Inevitably, the Contractor should expect some delays as a result of the unknown or
unforeseen conditions underground. A reasonable amount of time (at least 3 hours
per occurrence) must be budgeted to allow for down time when an unknown pipe or

differing conditions are found and require additional investigation by the
City/Contractor. The City Wastewater Department will assist using camera
equipment to investigate unknown pipes, but it does take some time for them to stop
their work and arrive on site to investigate the unknown pipe(s). Should the
investigation take longer than 3 hours, the City will work with the Contractor on
negotiating a reasonable hourly compensation for the down time.

Dye tests of the sewer service line may be necessary if determined by the Engineer
where the house connections were not well defined. Such dye tests shall be
performed by the Contractor at no additional expense to the contract. The contractor
should make arrangements with the house/apartment occupants on when to enter to
perform this test.

Unit prices submitted for various items of work will be utilized for determining prices
of any additional work necessary during construction.

Owner reserves the right to delete any item or modify estimated quantities without
penalty. Contractor shall make no claim as to lost profits or added costs due to
quantity adjustments or deletions.

Unit prices listed shall be the basis of cost adjustment for additional items of work
required by a change order.

. All prices shall include transportation and disposal of excess materials as applicable.

Unit and lump sum prices shall reflect salvage value of all pipe materials and
appurtenances removed as part of the work.

All prices shall include costs related to filing and obtaining applicable permits from
local and state agencies.

PART 2 - DESCRIPTION OF PAY ITEMS

2.01 SEWERS COMPLETE IN PLACE

A.

REPLACE EXISTING SEWERS WITH NEW PVC SEWERS:

1. The length of sewers to be replaced shall be paid for under the appropriate

subdivisions of this item and shall be measured by the linear foot along the
completed sewers, including wyes and tees, from centerline of manhole to
centerline of manhole.

2. The linear foot price for this item shall constitute full compensation for

demolition/disposal of the existing sewer and installing a new PVC sewer main
complete in place as indicated on the drawings and/or as specified, including
furnishing all materials, labor, tools, and equipment necessary to complete the
work, including but not limited to handling of existing wastewater flows, bypass-
