change it regardless of what the Board of Aldermen says.

Whatever problems the City of Nashua has, the Police Department is most definitely not one of them. |
was a member of the Nashua Police Department for more than 32 years. It’s not just my opinion but the
opinion of professionals across the law enforcement spectrum that the Nashua Police Department is a

opinion that Mayor Donchess most definitely knows that yet he continues to advocate for unneeded
changes that will adversely affect the department. As Nashua voters, that fact should concern you the
most about this entire process. Thank you.

Good evening everyone. My name is Michael Carignan and I’m your Chief of the Nashua Police
Department. I'm here to voice my opposition for this legislation to be placed on the ballot and | will be brief.
There’s been a lot of discussion around the 100 plus year history of the nomination process for the Police
Commissioners. The fact that the process is that old, some calling it “archaic” has been used against it. In
reality it is a system that has proved to be effective, trustworthy, transparent, and best practice. | would put
the Nashua Police Department up against any agency in New England as a leader and an example of how
to effectively police within a community. Why would you want to change that? This process will do nothing
but hurt our ability to do that.

Much has been made about the diversity of the Police Commission. We as an agency welcome a diverse
board. | believe the actions of the Nashua Police Department have consistently demonstrated our
willingness and our desire to diversify our entire police department. So much has been said about the fact
that over the years we have had only one woman as a Police Commissioner. During those discussions, it
has been brought up several times that no names were presented to the Governor for a position on the
Commission by the Mayor or Aldermen. In checking with the Governor’s office this morning, | want to
confirm to everyone that last month one of our sitting Police Commissioners was re-nominated and
reappointed to his position. Not one female nor person of color was presented to the Governor by the
Mayor or the Aldermen for consideration. That should tell you that diversity is not as important to those
pushing this legislation as it seems.

I'd like to discuss the language on the ballot question regarding the Police Commission as it had been
presented to the citizens of Nashua. We've made it clear that we as an agency we’d be happy to sit down
to discuss the pros and cons of this topic and discover ways that we can improve. We are willing to work
with the Aldermen and community members to try and do just that. The language as it’s been presented to
the ballot has not been allowed to be changed or improved upon. There are members here tonight who
have been strong proponents of this legislation who have reached out to me and expressed the fact that
they were not happy with the verbiage of the legislation. They think it could be changed and be better. Yet
the methodology that went into getting this on the ballot prohibited them from doing that. They should tell
citizens of Nashua that the main sponsors of this legislation have rushed it through to the point that they
were not able to change it and make it a process that is best for the community even in their own eyes.

Commission are lifelong residents of Nashua or have lived here for over 35 years. They are participants in
the community be it through nonprofit or civic volunteerism. They’re all taxpayers and put their kids through
schools in Nashua, they attend events in Nashua, and patronize restaurants and shops. They understand
that they have no experience managing a Police Department. That is what they’ve elected me to do but we
work together to have the best Police Department in the State as well as...

My name is Patrick Parks. | am resident 24 Bolic Street here in Nashua. For one I’d just like to say thanks
to the police and the Police Commission for everything that they do. I’m obviously not from here. I’ve lived
in places like DC, California, North Carolina, and I’m originally from Alabama. All | keep hearing is that
people were asking for oh we need change. My question is what somebody brought up earlier. What's
broken? One of the people that’s in favor that spoke earlier said oh it can’t be any worse than it is now.
Well | lived in Sacramento. Trust me, it can be a lot worse. This is a great place to live and our Police
Department does a fantastic job.

The other thing that keeps getting brought up is diversity but it’s almost just diversity for diversity sake. |
don’t really understand it and | don’t think that anyone here and especially myself is opposed to change. |
think the change is usually a positive thing. | think that diversity is a positive thing. We're asking for it just
for change and diversity sake. Something that’s not really broken and nobody can put something
substantial for having an objection thing identified that shows how anything is broken.

The last thing I’ll say, you know, the Mayor (inaudible) so I’m (inaudible) with every political has limited
political capital. Right? | don’t understand why he’s willing to expend political capital on something like this
when obviously the opposition tonight is so much stronger than it is to the people that support this. So |

lot of members of this Board but be that as it may, you know | just want to reiterate wnat Mr. Soucy said.
You all have a job to do. Read the Charter. You don’t have enough signatures. That’s not what the
Charter says so do your job. If you don’t do your job be prepared because come election time, we’re
coming after you.

A regular meeting of the Board of Aldermen was held Tuesday, September 14, 2021, at 7:30 p.m. in the aldermanic
chamber and via Zoom teleconference which meeting link can be found on the agenda and on the City’s website
calendar.

President Lori Wilshire presided; City Clerk Susan Lovering recorded.

Prayer was offered by City Clerk Susan Lovering; Alderwoman Elizabeth Lu led in the Pledge to the Flag.

Let’s start the meeting by taking a roll call attendance. If you are participating via Zoom, please state your presence,
reason for not attending the meeting in person, and whether there is anyone in the room with you during this meeting,
which is required under the Right-To-Know Law.

The roll call was taken with 12 (2 via Zoom) members of the Board of Aldermen present: Alderman Michael B. O’Brien,
Sr., Alderman Patricia Klee, Alderwoman Shoshanna Kelly (via Zoom), Alderman Richard A. Dowd, Alderman June M.
Caron, Alderman Benjamin Clemons (arrived at 7:39 p.m.), Alderman David C. Tencza, Alderwoman Elizabeth Lu,

REMARKS BY THE MAYOR

President Wilshire

Mayor did you wish to address the Board this evening?

Mayor Donchess

Yes, Madam President. First, | just want to briefly touch on our COVID-19 status. Of course Public Health continues to
monitor this on a daily basis. We're still in substantial transmission, although things seem to have stabilized a bit. The
positivity rate - in other words, the number of people who test and come out with COVID, the positivity rate has been
5.5%. That's a little less than the last time | spoke to you and the number of new cases per 100,000 for 14 days is still
over 200 but again, in the last few days, there have been a few less cases than in the previous weeks. So we continue to
look at all that carefully.

Madam President there were two very nice ceremonies and events which | wanted to mention to you and to the
community. | want to thank the Fire Department for sponsoring and hosting the 9/11 Memorial that was held on Saturday
at the fire station on East Hollis Street. A number of people attended. Our Fire and Police Departments, of course, and
others and it was just you know, a sad day because we were thinking back to what occurred 20 years ago and all the lives
that were lost in the 9/11 attacks. But it was great that the Fire Department put that entire ceremony together.

Also, Madam President on Sunday there was a Welcoming Week celebration at the at Greeley Park at the band shell put
on by our Cultural Connections Committee and | want to thank Deepa Mangalat and our entire committee for working on
that. There was some really beautiful dancing by and other entertainment, music, drums, other things by a whole group of
people and it seemed everybody had a good time and everybody did a really good job on that event. So | wanted to thank
all of them.

And finally Madam President, | wanted to mention the escrows which | Know we're up for final vote tonight. Of course that
has gone to the Budget Committee. As | said before, | won't go through it in the same level of detail but over half the
money is being allocated into equipment purchases. Without this allocation, there would be no equipment purchase this
year and this is the practice that we've adopted over the last number of budget years to use unappropriated, unused
funds, unspent funds to make equipment purchases. So this would be equipment that's required by the Public Works,
Fire, Police, and our other departments to make sure that our fleet of vehicles and equipment remains in good repair and
up to date. A lot of the other money is being allocated into various trust accounts to save future taxes or reserve accounts
against the need for unexpected building repairs and other things. | know that the Budget Committee discussed it in quite
some detail and of course their usual thorough review and therefore | think it is ready to be passed. That's it for my
remarks Madam President.

My name is Bob Keating, 5 Coburn Woods. A member of Granite State Organizing Project. The reason I'm here tonight
is to thank a number of people, including Economic Director Mr. Cummings, and the Mayor, and many of almost everyone
that spoke in regards to the American Recovery Act. The money is the $16 million and the amount of support for the
number two option, | guess it was called V for the Affordable Housing Trust and up to $10 million, and | just thank you is
that's my main message. Thank you President Wilshire. Likewise for your support and | know there's going to be three
more public meetings you know about it. | like that it's happening quicker too. | mean we've got a lot more time to be able
to do it but | think that clearly to be able to get that money distributed would be sooner would be better and | hope that
continued support so that number B becomes number one in terms of when the vote comes out. So again, this is thank
you for the support.

My name is Brad Westgate. I'm a lawyer with Winer Bennett in Nashua, 111 Concord Street. | represent Harbor Homes.
Harbor Holmes operates the Harbor Clinic at 45 High Street, which I'm sure the Board is aware of, has operated it since
approximately 2009. Harbor Clinic serves about 70% or so of its patients and the last numbers | saw our Nashua
residents, it says basically an at risk population who gets no cost or low cost medical care.

I'm speaking tonight briefly Madam President relative to proposed Resolution R-21-156 which pertains to an option
agreement which would enable Harbor Homes to lease potentially 15 spaces in the Factory Street lot adjacent to 45 High
Street the Harbor Clinic. The reason we have been working with the city relative to this proposed legislation is because of
the School Street project and the closing of the School Street parking lot in connection with Lansing Melbourne group's
development on that project. When we became aware of the project, we had concerns because patients used the School
Street lot and the initial design of the Lansing Melbourne project would have involved elimination of the School Street lot
entirely. So we were we contacted the city. Tim Cummings reached out to us very kindly. We began working with him
relative to possibility of creating this option agreement to enable us to have an ability to lease 15 spaces in the Factory
Street lot. That led to very wonderful cooperation involving both all aspects of the city boards and officials, as well as
Lansing Melbourne Group in permitting a redesign of their project to allow some surface parking under the proposed
private complex they would be building.

So that has led to this legislation. We would respectfully hope that the Board tonight would consider approving it. What it
boils down to is it would give Harbor Homes a one-year option commencing with the closure of the School Street lot to
determine whether to exercise the right to lease for five years 15 spaces in the Factory Street lot. It gives Harbor Homes
a little bit of time to determine how those needs may play out and then can make that determination and enter into the
lease if so needed. So we thank the Mayor and the other co- sponsors of the legislation. Thank the Committee on
Infrastructure for its recommendation of approval. Especially thank Mr. Cummings and Celia Leonard who | worked with
with some detail to create this documentation. We appreciate it.

There being no objection, President Lori Wilshire declared that the Board of Aldermen meet in joint convention
with the Edgewood Cemetery Board of Trustees for the purpose of electing a trustee and called for a nomination.

Good evening Madam President. My name is Tom Maffee. I’m on the Board of Trustees — the Edgewood Cemetery.
Tonight we would like to nominate Robert McIntosh, Douglas Gagne, Mike Lozeau, Carl Andrade, and Tom Maffee.

Trustee Maffee nominated incumbent Thomas Maffee for a five year term to expire March 31, 2026.

Trustee Maffee nominated incumbent Carl Andrade for a five year term to expire March 31, 2026.
Trustee Maffee nominated new Trustee Michael Lozeau for a four year term to expire March 31, 2025.
Trustee Maffee nominated new Trustee Robert McIntosh for a one year term to expire March 31, 2022.
Trustee Maffee nominated new Trustee Douglas Gagne for a one year term to expire March 31, 2022.

President Wilshire declared the appointments of the following to the Edgewood Cemetery Board of Trustees: Thomas
Maffee and Carl Andrade with terms to expire March 31, 2026; Michael Lozeau with a term to expire March 31, 2025;
Robert McIntosh and Douglas Gagne with terms to expire March 31, 2022.
Oath of Office administered by Corporation Counsel.
There being no objection, President Wilshire declared that the Joint Convention now arise.
