ARTICLE 16— DISPUTE RESOLUTION

The parties shall attempt to resolve any dispute related to this contract as follows. Either party
shall provide to the other party, in writing and with full documentation to verify and substantiate
its decision, its stated position concerning the dispute. No dispute shall be considered submitted
and no dispute shall be valid under this provision unless and until the submitting party has
delivered the written statement of its position and full documentation to the other party. The
parties shall then attempt to resolve the dispute through good faith efforts and negotiation between
the OWNER Representative and the CONTRACTOR Representative. At all times,
CONTRACTOR shall carry on the work under this contract and maintain and complete work in
accordance with the requirements of the contract or determination or direction of the OWNER. If
the parties are unable to resolve their dispute as described above within 30 days, the parties may
request that the dispute be submitted to the Board of Public Works for resolution. If the parties are
dissatisfied with the decision of the Board of Public Works, the parties’ reserve the right to pursue
any available legal and/or equitable remedies for any breaches of this contract except as that right
may be limited by the terms of this contract.

ARTICLE 17— CHOICE OF LAW_AND VENUE

This contract shall be governed exclusively by the laws of the State of New Hampshire and any
claim or action brought relating to this contract, the work performed or contracted to be performed
thereunder, or referable in anyway thereto shall be brought in Hillsborough County (New
Hampshire) Superior Court Southern Judicial District or in the New Hampshire 9th Circuit
Court—Nashua and not elsewhere

ARTICLE 18— MISCELLANEOUS PROVISIONS

1. Neither party to the Contract shall assign the Contract as a whole without written consent
of the other.

2. Tests, inspections and approvals of portions of the Work required by the Contract

Documents or by laws, ordinances, rules, regulations or orders of public authorities having

jurisdiction shall be made at an appropriate time.

If additional testing is required, the CONTRACTOR shall perform these tests.

4. The OWNER shall pay for tests except for testing Work found to be defective for which
the CONTRACTOR shall pay.

SPECIALPROVISION
Item 500.03 - Temporary Superstructure Shoring
Description

1.1 This work shall consist of furnishing the necessary shoring, and/or vertically jacking of any
structure or bearing to a position immediately above its present location, holding it in
position during any construction process, lowering it to its supports, removing all shoring or
falsework, and cleaning up of the site.

Construction Requirements

2.1 Construction Drawings shall be submitted in accordance with Section 105.02 of the
NHDOT Standard Specifications. The Contractor shall submit the drawings and associated
calculations, procedures, and details to the Structures Engineer at least four weeks prior to the
anticipated start of work.

2.2 Associated details, procedures, and calculations for shoring and jacking shall be prepared
by a Professional Engineer licensed in the State of New Hampshire and shall bear their stamp
and signature. Designs shall conform to the latest version of the AASHTO LRFD Bridge Design
Specifications and LRFD Guide Specifications for the Design of Pedestrian Bridges. The
Contractor shall be responsible for the strength, capacity, and performance of the construction
method(s) employed.

2.3 When components and/or materials that are not otherwise specified for removal are
removed from the structure during shoring operations and the components and/or materials are to
be re-installed in the construction, the components and/or materials shall be carefully removed
and salvaged by the Contractor.

2.4 Components and/or materials to be retained and re-installed shall be stored at the location
specified in the Contract or as directed by the Engineer.

2.5 The Contractor shall take every precaution necessary to prevent damage to remaining
components and/or materials and those to be retained for reinstallation. Damage to remaining
structure components and/or materials and to those to be re-installed shall be repaired or replaced
by the Contractor both to the satisfaction of the Engineer and at no additional cost to the City.

Method of Measurement

3.1 Temporary superstructure shoring will be measured as a unit for each location. A unit will
consist of the design, construction, maintenance and removal of temporary superstructure
shoring. Each location will consist of all the bearings used to support one end of any given span.

Basis of Payment

4.1 The accepted quantity of temporary superstructure shoring will be paid for each location
specified at the contract unit complete in place. Payment will be full compensation for preparing
and submitting construction drawings, details, procedures, and calculations as specified,
performing the work specified including assuming all liability for the structure being shored and
for furnishing all labor, tools, equipment, materials, and incidentals necessary to complete the
work.

4.1.1 When the structure or bearing has been jacked and blocked onto its temporary
position, a payment of 75 percent of the Contract unit price will be allowed. The remaining 25
percent will be paid when all shoring or falsework has been removed and the site cleaned up.

B. The Contractor shall procure all permits required for blasting.

1.05 SUBMITTALS:
A. At least two weeks before beginning blasting operations, the Contractor shall submit
to the

Engineer for record the following data:

1. Name of Contractor or Subcontractor responsible for blasting and
monitoring operations and license number.

2. Name, affiliation, and license number of the person or persons who will be
directly responsible for designing each blast, supervising the loading of the
shot, and firing it.

B. Copies of all permits required for
blasting. C. Results of pre-blast

survey.

D. When blasting is in progress, daily reports on blasting operations and blast
monitoring results.

1.06 DELIVERY/STORAGE AND HANDLING:

Delivery, storage and handling of explosives shall conform to all federal, state
and local regulations and permits.

PART 2 - PRODUCTS - NOT APPLICABLE

PART 3 - EXECUTION

3.01 PREPARATION/PRE-BLAST SURVEY

If required, the pre-blast survey shall be conducted in accordance with state
regulations and/or local permit requirements.

3.02 EXCAVATION:

A. The Contractor shall excavate rock to the lines and grades indicated on the drawings
or as directed by the Engineer. The excavated rock shall be removed and disposed of

by the Contractor as specified for surplus excavated materials under Section 02300,
EARTHWORK.

AMENDMENT TO SECTION 544 — REINFORCEMENT FOR CONCRETE
Item 544.101 — Reinforcing Steel
Description

Amend 4.1 Reinforcing steel will be measured by the pound of reinforcing steel placed as shown
on the plans or ordered. The theoretical weight of reinforcing steel will be computed based on
Table 544-1 — Reinforcing Steel Weight — English as shown in Section 544.4.1 of the NHDOT
Standard Specifications.
Amend 5.1 The accepted quantity of reinforcing steel will be paid at the contract unit price per
pound complete in place. No allowance will be made for clips, wire, or other material used for
fastening reinforcement in place, and no allowance will be made for additional splices or
permitted substitutions.

SPECIALPROVISION
Item 1001.4 — Approach Repairs
Description

1.1 This work shall consist of pavement and subbase removal, grading, and paving the northern
approach as shown in the contract plans.

Materials

2.1 Subbase material shall be crushed gravel conforming to the requirements of Item 304.3 of
the NHDOT Standard Specifications.

2.2 Bituminous sidewalk shall conform to the requirements of Item 608.13 of the NHDOT
Standard Specifications.

Construction Requirements

3.1 Pavement saw cuts shall conform to the requirements of section 628 of the NHDOT
Standard Specifications.

3.2 Subbase placement and preparation, and pavement placement shall conform to
the requirements of section 608 of the NHDOT Standard Specifications.

3.3 The existing ground shall be compacted as directed by the engineer prior to the placement
of the subbase material.

Method of Measurement

4.1 Approach repairs will be measured as a unit. A unit will consist of the materials,
equipment, and labor necessary to complete the work, including, but not limited to, pavement
saw cuts, removal of existing pavement, subbase excavation, grading and existing ground
compaction, placement of subbase and pavement materials, and mobilization.

Basis of Payment

5.1 The accepted quantity of approach repairs will be paid for at the contract unit complete in
place. Payment will be full compensation for furnishing all labor, tools, equipment, materials,
and incidentals necessary to complete the work.

SPECIALPROVISION
Item 1001.5 — Metal Deck Form and Structural Steel Clean and Paint
Description

1.1 This work shall consist of cleaning and galvanizing/painting corroded material from the
galvanized corrugated metal deck forms and painted structural steel within approximately three
feet of the bridge supports as directed by and to the satisfaction of the engineer.

Construction

2.1 The cleaning method used shall not damage the underlying concrete deck, or structural
steel members of the truss. Any damage to the deck or truss caused by the cleaning shall be
repaired as directed by the engineer and at the contractor’s expense.

2.2 Galvanized metal deck forms shall be cleaned and the galvanizing repaired per Section
550.2.9.1 of the NHDOT Standard Specifications.

2.2.1 Amend 550.2.9.1.2 to read: Repair damaged galvanizing and bare steel surfaces in
accordance with ASTM A780, Standard Practice for Repair of Damaged Hot Dipped
Galvanized Coatings, Annex 2. Thoroughly clean damaged areas to produce a clean, bare
and dry bright metal surface with a roughened profile and feather into the edges of
adjacent undamaged galvanizing. Cleaning shall conform to the requirements of the
Society for Protective Coatings (SSPC) SP11 — Power Tool Cleaning to Bare Metal.

2.3 Structural steel cleaning shall conform to the requirements of SSPC-SP11 — Power Tool
Cleaning to Bare Metal.

2.4 Field Painting of the structural steel shall conform to the requirements of Section 556 of the
NHDOT Standard Specifications.

2.4.1 Paint System shall match the existing or an approved equal. Approved equal shall
conform to the NEPCOAT Qualified Products List A or B. Per the existing plans the
paint system consists of:

A. Primer Coat: Carbomastic 242 high-build, aluminum-filled epoxy urethane mastic as
manufactured by Carboline Coatings. Dry film thickness to be 5 mils.

B. Top Coat: Carboline 133 HB aliphatic polyurethane as manufactured by Carboline
Coatings. Dry film thickness to be 5 mils. Color to be Federal Standard 20059.

2.4.2 The paint system shall be applied per the manufacturer’s recommendations.

consist of the materials, equipment, and labor necessary to complete the work, including, but not

limited to, access, cleaning, galvanizing repairs, painting, disposal of removed/waste materials,
and mobilization.

Basis of Payment
4.1 The accepted quantity of metal deck form and structural steel clean and paint will be paid
for at the contract unit, complete in place. Payment will be full compensation for furnishing all

labor, tools, equipment, materials, and incidentals necessary to complete the work.

4.1.1 All costs for mobilization to complete repairs as needed shall be included in each
item as needed.
