RE: Thermo Fisher Scientific FTIR Grant purchase questions

Good day Dan,

I’m writing you today to provide some additional background pertaining to Nashua Fire Rescue’s recent
request to purchase a Thermo Fisher Scientific FTIR spectrometer (grant request notification 8/23/2015).

Nashua Fire Rescue houses and operates the regional hazmat team known as the Souhegan Mutual Aid
Response Team (SMART). SMART was established in the 1990's after the need for a regional hazmat
team was determined (Title III of the SARA Act of 1986, PL99-499 compliance). SMART is primary
hazardous materials team for 19 communities in the local area that is comprised the membership
communities that form the Souhegan Mutual Aid Association (SMAA). Nashua Fire Rescue was chosen
by these communities as the “Lead City” due to our staffing levels and ability to house the required team
équipment and apparatus.

Previously in 2013, Nashua Fire Rescue via SMAA, received grant funding to procure a Thermo Fisher
Scientific Raman Spectrometer. The Raman Spectrometer can identify approximately 60% of unknown
substances (aka “white powder calls”) via on scene chemical analysis and comparing that result to an
onboard chemical database. As excellent this is, there are limitation to this type of meter that do not allow
for sampling of some chemicals due to the color spectrum of certain substances (fluorescent or very dark
substances for example cannot be analyzed via Raman technology). The recently requested grant funded
FTIR meter serves as a companion meter to the Raman to provide almost complete spectrum chemicai
analysis coverage, closing the gap on the remaining 40% of unknown substance identification. While
there will still be a small gap due to the nature of chemicals, these two meters will allow us to identify
most chemicals as technology will currently permit.

Due to the nature in which the Thermo Fisher Scientific Raman and FTIR meters support each other, we
feel that in accordance with NRO SEC. 5-84 (A) (5), special purchasing procedures for sole source
procurements, we would like to contract with Thermo Fisher Scientific who is the sole source
manufacturer of the FTIR Spectrometer.

The following information is provided to assist you in determining if the foliewing products
manufactured by Thermo Fisher Scientific - Portable Analytical instruments qualify for soie
purchase justification status as a brand specific item.

Thermo Fisher Scientific, is the sole manufacturer of the TruDefender FTX FTIR handheld
spectrometer, from its sole manufacturing iocation at 2 Radciiff Rd Tewksbury, Massachusetts
USA. This system is unique as the a ruggedized, waterproof and self contained FTIR
spectrometer, only product on the market in its class to meet Mli-Spec 810F ruggedness specs
and iP67 Waterproof specs. It uses proprietary Chemometric routines to identify unknown
chemicais that are not available on any other FTIR spectrometers,

The TruDefender FTX is the oniy Spectrometer avaiiabie on the market that will run the
DecisionEngine 2.0 MX mixture analysis software for identifying and anaiyzing mixtures of
chemical compounds. There is no other system on the market that uses this combination of
Chemometrics and software routines. The TruDefender FTX is the only commercial handheid
spectrometer that contains signatures of chemical weapons and expiosives as weil as millions of
other toxic chemical combinations. These chemicals are aiso linked to chemical hazard screens

The original contract, pursuant to NRO § 5-78 Major purchases (greater than $10,000), was awarded in the amount of
$163,727. Change Order #1 was awarded in the amount of $163,912 for a new contract total of $327,639.

The Solid Waste Department Superintendent, Board of Public Works (January 21, 2016) and the Purchasing Department

recommend the approval of Change Order #2 in the amount of $164,340 from Northeast Earth Mechanics, Inc. of
Pittsfield, NH. If approved, this proposed change order will bring the contract total to $492,069.

Change Order #2 to contract with Northeast Earth Mechanics, Inc.

To approve Change Order #2 to the contract with Northeast Earth Mechanics, Inc.
(NEM) in the amount of $164,340 to continue construction of the residential
setback barrier wall in the Phase II landfill. Funding for this Change Order is
through Department: 168 Solid Waste; Fund: Solid Waste; Account
Classification: 81 Capital Improvements; Activity: Soil Wall.

NHDES Solid Waste Rules prohibit placement of municipal solid waste within
500 feet of a residential structure. The Four Hills lined expansion landfill (Phase
I & II) was designed and constructed with the footprint of the landfill encroaching
the 500-foot setback limit to residences on Farmwood Drive and Pioneer Drive.
In order to comply with the residential setback rule, a barrier must be constructed
within the footprint of the landfill to prevent waste from being placed in the
setback. The barrier wall must be expanded annually as waste elevations in the
landfill increase.

In May 2014 the City solicited bids for construction of Phase 1 of the soil wall
under IFB0593-050514. Six contractors submitted bids for the project with
Northeast Earth Mechanics (NEM) being the lowest bidder:

Under the original contract in the amount of $163,727.50 Northeast Earth
Mechanics (NEM) began initial construction in July 2014 of the residential
setback barrier wall in the Phase II/Stage I landfill. Per the NHDES approved
scope of work and contract executed June 10, 2014, NEM established a
compacted soil foundation over the primary liner drainage sand and placed four
lifts of concrete waste blocks on the foundation.

Change Order #1 in the amount of $163,912 provided for the continued
construction of the wall to an elevation of 260 feet in the Phase II/Stage 1 landfill.

Change Order #2 in the amount of $164,340 will continue the foundation
construction into the Phase II/Stage II landfill up to an elevation of 260 feet. It is
the recommendation of the Solid Waste Superintendent to continue construction
of the Set Back Barrier Wall with NEM. Upon approval of Change Order #2 the
total cost of contract is $491,979.
