Dear Board of Aldermen:

On December 6, 2017, an application for a Type IB modification to the referenced permit was
filed with the New Hampshire Department of Environmental Services (NHDES) Waste
Management Division. The modification was requested to allow 1) drilling of mini-piles through
the buried Construction & Demolition (C&D) debris, and 2) temporary disturbance of the landfill
cap and, possibly, shallow C&D debris, during construction of the associated pile caps.

NHDES regulations require notification to all affected parties, which includes the local
municipality. Your copy of the permit modification filing is attached.

Dear Ms. Colby:

Enclosed please find three copies of the signed application for a Type IB modification to the
referenced permit. The modification is requested to allow 1) drilling of mini-piles through the
buried Construction & Demolition (C&D) debris, and 2) temporary disturbance of the landfill
cap and, possibly, shallow C&D debris, during construction of the associated pile caps.

Background - Consolidation of the C&D debris underlying the site has imposed unacceptable
stresses on the structure. In 2013 and 2014, the permittee performed similar projects in other
areas within the same complex. This project, though smaller in scope and shorter in duration,
will include less landfill disturbance and restoration but similar environmental monitoring and
regulatory reporting. The location of the proposed work with respect to the limits of the landfill
cap is shown on the Site Layout Pian portion of Figure 1.

Planned Work - The structural renovation is scheduled to begin in January 2018 immediately
following award of a construction contract. A system of drilled mini-piles has been designed to
extend to bedrock, as depicted on the attached drawings. Each mini-pile group is to be
completed with a concrete pile cap or grade beam. Given the urgency, tasks related to design,
permitting, work plan development, and contractor selection are being performed concurrently.

Construction of the pile caps will require shallow excavation. Excavations at interior columns
may extend 36” into the existing cap and, potentially, buried debris. The proposed pile cap
configuration is shown on the attached plans. Existing conditions are depicted based on best
available information from the 1990 landfill closure plan; cap thickness has not been verified.

Environmental Work Plan — An Environmental Work Plan (EWP) is being prepared and will be
submitted to NHDES along with the Notice of Intent to Construct (NOIC). It will be
substantially the same as the work plan for prior work at the shopping center, but some elements
of the safety program cannot be completed until the construction contract is awarded.

The EWP will include an overview of the work, a description of the means and methods,
including management of drill spoils, safety monitoring, asbestos monitoring and management,
solid waste disposal, and site restoration.

e Where C&D debris is encountered and removed, it will be disposed off site. All wastes
will be properly characterized for off-site disposal.

¢ Though the landfill is not identified as an Asbestos Disposal Site (ADS), the general
provisions of the ADS program will be followed. Drilling and excavation work will be
performed in compliance with all requirements of Env-A 1800 Asbestos Management
and Control Rules.

* Work will be performed under the provisions of a Confined Space Entry program
meeting OSHA requirements. Ambient, work space, and personal monitoring for
asbestos exposures will be conducted daily. Drill spoils and excavated material will be
analyzed for asbestos and managed as if asbestos-containing until shown otherwise.

¢ Following completion of the pile caps, the landfill cap will be restored to match pre-
excavation conditions at each location. Any existing geo-grid and geotextile fabric, if
present, will be replaced where disturbed and the excavations will be backfilled with
granular material similar to the original cap material.

The attached design plans show the locations of the mini-piles, pile caps, and grade beam.
Excavations depths may vary based on field findings, but such changes do not affect this
application. Figure 2 - Excavation Cross Section depicts a conceptual cross-section of the crawl
space conditions and proposed excavation work.

Closeout - As-built plans will be provided to the NHDES Solid Waste Management Bureau upon
completion of work. As-builts will include volumes/dimensions of landfill cover material
removed/replaced, depth/dimensions of piles/borings, disposal documentation, etc.

SECTION VI. IMPACT EVALUATION

The effect the modification will have on facility function, capacity, life expectancy, service type and service area.
The effect the modification will have on the environment, public health and safety.

The effect the modification wilt have on the state's ability to achieve the goals and objectives specified in RSA 149-M:2, namely
achieving a 40% minimum weight reduction in the solid waste stream on a per capita basis by the year 2000 and avoiding the
disposal of recyclable materials in a lined landfill with a leachate collection system.

The effect the modification will have on establishing and maintaining integrated waste management systems consistent with the
hierarchy of waste management methods in RSA 149-M:3 [the methods, in descending order of preference as specified in RSA 149-
M:3, are: source reduction; recycling and reusing; composting; waste-to-energy technologies (including incineration), incineration
without resource recovery; and landfilling].

Consistency with the state solid waste management plan and the applicable district plan, pursuant to RSA 149-M:72,[(b). If

SECTION VI. PUBLIC BENEFIT DEMONSTRATION

Provide a “demonstration of public benefit’ based on the below fisted instructions. Check which one of the listed instructions

SECTION IX. LEGAL NOTICES

Submit proof of having provided certain legal notifications and filings, as follows:

(1) You must send by certified mail, or deliver in hand, a complete copy of this application to the host municipality, host solid waste
management district and other affected entities, with a “notice of filing,” as specified by Env-Sw 303.

(2) For a type !-A modification, you must send by certified mail, or deliver in hand, a “notice of filing" to each owner of property abutting
the facility site, as specified by Env-Sw 303. If the applicant/permittee or the owner of the facility site owns any abutting parcel of
land, the “notice of filing” must be sent te the owner(s) of the next parcel(s) not owned by the permittee/applicant or facility site
owner.

(3) You must also provide a “notice of filing” to the New Hampshire Department of Justice/Office of the Attorney General (NH
DoJ/AGO) if, pursuant to Section X(2} of this form, you are required to submit business and personal disclosure information.

(4) | You must attach to this application “proof” that notification has been provided as required by (1) through (3) above. Therefore,
attach a copy of the notice(s} of filing and the signature(s) of all required recipients, acknowledging receipt.

SECTION X. CERTIFICATION OF COMPLIANCE/COMPLIANCE REPORT

All applications for permit modification must be submitted with either certification of compliance or a compliance report, as follows:

ty Prepare and submit a separate Compliance Report as specified by Env-Sw 303.15; and

0 lf the proposed modification involves a change in organizational structure, or a change in individuals/entities holding 10% or
more of the permitiee's debt or equity, or a change in officers, directors, partners or key employees, none of which constitutes a
change in operational control of the facility or a change in ownership per Env-Sw 315.02(f, also submit completed "business and
personal disclosure forms" for each non-compliant individual and entity involved in the change. Obtain the required forms from
the P&DRS at (603) 271-2925. Submit the completed forms, with the notice of filing referenced by Section [X(3) of this form and
a copy of the Compliance Report, direct to the New Hampshire Department of Justice/Office of Attorney General, Environmental
Protection Bureau, 33 Capitol Street, Concord, NH 03301-6397. [Note: Copies of the completed disclosure forms should NOT
be attached to this application when it is submitted to DES or to the host municipality, host solid wasie management district and
other effected entities, pursuant to Section LX(1) above. Only the NH DaJ/AGO should receive copies of the disclosure forms].

COMPLIANCE STATEMENT

The applicant shall certify that each of the statements listed in (1}-(8) below are true for each of the following individuals and
entities:

The applicant, and

The facility owner, and

CX] The facility operator, and

All individuals and entities holding 10% or more of the applicant's debt or equify, and

All of the applicant's officers, directors, and partners, and

All individuals and entities having managerial, supervisory or substantial decision making authority and responsibility
for the management of the facility operations or the activity(s) for which approval is being sought.

the 5 years before the date of the application.

(2) | No individual or entily listed above has been convicted of or plead guilty or no contest to a misdemeanor for a violation of
environmental statutes or rules in any state or federal court during the 6 years before the date of the application.

(3) | No individual or entity listed above has owned or operated any hazardous or solid waste facility which has been the subject of an
administrative or judicial enforcement action for a violation of environmental statutes or rules during the 5 years before the date of the
application.
