Final ECPC

The streamlined preliminary design EOPC will be further developed into a Final Design
EOPC. It will incorporate comments from the preliminary EOPC review and be updated to
include changes associated with the PS&E submittai. Contingencies previously carried will
be removed and costs for construction services will be included.

Drart Plan, Soecifications, Estimate (?S2.5) Sucmittal
A draft PS&E submittal will be made to the City (electronic format only) and the NHDOT (2
hard copies & electronic format) for review and approval. This will include a complete set
of plans, final EOPC, and complete set of contract documents. In addition, the following
certifications and statements will be submitted:

® Plans, Specifications, & Estimate (PS&E) Checklist

© Right-of-Way Certificate (certifies that ROW has been cleared)

e Utility and Railroad Certificate (certifies that utilities have been cleared}

e Permits and Approvals
e Signed Significant Determination Memorandum from NHDOT’s Traffic Control
Committee (TCC)
Approval of the above documents is required under the NHDOT’s LPA process prior to
bidding.

Final PS&E Submitia!

A final PS&E submittal will be made to the City (electronic format only) and the NHDOT (2
hard copies & electronic format) to address comments resulting from the Draft PS&E
Submittal review.

Project Management

CMA project manager will coordinate regularly by email and by phone with NHDOT/City
staff, subconsultants, and project team members; and will complete monthly project
status reports and invoices (4 months assumed).

Bid Assistance
a. Construction Documents for Bidders
Prepare final plans and documents to be distributed to bidders, the Clty, and
construction informational services.

b. Advertisement
Preparation of advertising materials and assist City with publication as specified by
the LPA manual.

c. Pre-Bid Meeting
Administer a pre-bid meeting.

d. Active Bid Management (Tracking & Questions)
Coordinate with plan distributer and keep up-to-date list of plan holders. Address
questions from prospective bidders, suppliers and project advertising agencies by
compiling a list of the questions and approved responses and issuing addenda to the
contract. Up to two (2) addenda are assumed.

e. Bid Qpening
Attend and assist City with a brief bid opening.

f. Bid Evaluation
Preparation of a bid tabulation of all bidders submissions and comparison to the
final engineer cost estimate. Evaluate the bids for compliance with contract
requirements and check for unbalanced bid items. Provide the LPA and NHDOT
guidance on unbalanced conditions detected during analysis. Recommendation for
award of contract to lowest priced responsible bidder.

Task 4. - Consiruction Phase Services {Not Pari of This Conivact Phase}

The following description of expected Construction Phase Services is provided for review in
accordance with Section 14 of the LPA Manual, however, these services are not included as
part of the initial design-phase contract. It is expected that these services will be negotiated
during the Final PS&E stage of the project when the details and scope of the actual
construction of the project are better understood.

Construction phase services described herein involve all aspects of construction
administration and resident project representative inspection services. CMA Engineers offers
these services under the direction of a Professional Engineer licensed in the State of NH.

On-Site Resideni inspection
Services associated with on-site resident inspection include but are not limited to the
following:
* Construction observation/resident project representative services to monitor work
associated with the contract

® Daily records
¢ Field observation reports
¢ Worker-class field audits

Office Construction Administration
Services associated with office construction administration include but are not limited to the
following:
® Schedule, moderate, and document the preconstruction conference
® Review and approval of Contractor's SWPPP submittal
e® Notice to Proceed
e Shop drawing review and approval
® Contract clarification(s) as necessary
e Preparation and review of change orders as necessary
e Review and approval of monthly payment applications
e Documentation of LPA required documents
e Schedule, moderate, and document weekly construction meetings
e Materials testing and associated reviews
e Final inspection, punch list, and certification

ENGINEERS

Materials-testing will be in accordance with the Quality Assurance & Materials Testing
requirements of the NHDOT’s LPA Manual. This effort will require the addition of an
independent testing laboratory, which would be carried either as an allowance under our
Construction Phase Services Contract, as allowance in the Contractor’s bid, or under a
separate contract with the City.

A. SCOPE ASSUMPTIONS
° All public meetings will be attended by two CMA Engineers personnel.
e Geotechnical investigation is not included in the current scope. If the City deems it
necessary going forward, it will be added via a contract amendment.

e Alteration of Terrain, Wetland, or Shoreland Protection Act permitting is not included
in the current scope.

@

Legal and/or appraisal support for the development of any temporary or permanent
easements is not anticipated or in the current scope. If needed, it will be added via a
contract amendment.

e Traffic related data collection is not included in this scope. If additional data is needed
beyond what is provided from the City, a Contract Amendment will be needed.

@ One submission of each of the Engineering Study and Preliminary Plans is provided for
in the scope. It is assumed that review comments from each will be incorporated in
the submittal for the subsequent design phase. Resubmittals (if required) are not
included in the current scope.

2 The Final Design phase includes two (2) submittals: Draft PS&E Plans and Final PS&E
Plans. Any additional submissions within the Final Design phase are not included in the
current scope.

e Construction Phase services are listed for reference, but not included as part of this
contract. It is expected that these services will be negotiated as part of future contract
amendment as the work is better defined.

e This scope and fee estimate is predicted on a 10-month contract duration. Extended
contract duration will necessitate a corresponding increase in engineering fees for
Project Management (coordination with NHDOT/City staff and subconsultants,
monthly status reports and invoices).

e Until a detailed condition assessment of the bridge is performed, the extent of any
section loss or corrosion is unknown. Design, detailing, and specification of surface
protection/anti-corrosion treatments for the existing structure are not included in this
scope and fee.

e At the bridge structure, evaluation of substructure elements will be limited to visual
inspection of exposed portions. Subsurface exploration to determine exact size and
condition of substructure elements is not included in this scope. For the purpose of
design, it will be assumed that the substructure elements are in serviceable condition
and capable of carrying the proposed loads, unless otherwise observed.

® All assumptions and limitations expressed in subconsultant’s scopes of work shall be
considered part of this scope and apply to CMA Engineers.

B. IRONWOOD CLARIFICATIONS AND ASSUMPTIONS
Should any of the services or deliverables identified below be desired an amendment can be
provided without delay.
e The pedestrian scale lighting design will generally follow the standard set along the
westerly segment of the Heritage Rail Trail.
e Landscape treatments and amenities will be kept to a minimum. Any proposed
enhancement will correlate to a specific corridor or user need and will recognize
City maintenance limitations.
® Design explorations prepared as part of 1.08c Evaluation of design alternatives will
likely contain site enhancements considered nonparticipating in regard to the
CMAQ funding. As such plans and materials prepared in subsequent phases will
contain only essential elements required of a multi-modal corridor.
e The design of wayfinding and interpretive signage is not included in the Ironwood
budget.

e |ronwood project management efforts are included in all design phases and tasks, and
not itemized separately. Project management effort includes:
=" Coordination with the CMA Engineers team and Town staff
= Track project progress against timeline and budget
e Asurvey will be provided to Ironwood in AutoCAD .dwg format.

e The preparation of materials for meetings such as slides, precedent examples, and
exhibits not identified above are not included in the |ronwood budget.

® Promotional graphics such as photo simulations, 3d models, materials boards,
photometric rendering are not included in the Ironwood budget.

® City staff meetings and/or presentations are not included in the Ironwood budget.
it is expected that review comments will be provided in writing. One public
presentation is included in the lronwood budget.

e All work products, deliverables, and meetings to be reviewed/attended by a NH

6 CLEARSKY

1. ClearSky requires a minimum of ten (10) business days from date of signature to assign the
relevant consulting project team resources. All resources are subject to Client approval.

2. Prior to assigning an individual to replace any person in a Key Resource, ClearSky will notify Client
of the proposed assignment, introduce the individual to appropriate Client representatives (and,
upon request, provide those representatives with the opportunity to interview the individual) and
provide Client with a résumé and any other information about the individual that Client
reasonably requests. If Client in good faith objects to the proposed assignment, ClearSky and
Client will resolve City of Nashua concerns on a mutually agreeable basis.

3. If Client requires ClearSky to remove any assigned Supplier (i) for actions or behavior inconsistent
with the role or (ii) if the assigned Supplier is deemed by Client to possess inadequate expertise
or skill sets to fulfill the requirements of the role. In either of the aforementioned instances Client
shall not be liable for the time such Supplier spent on the Project.

3.3. Assumptions

The following assumptions were made for this Statement of Work.

Pricing Assumptions

e All amounts are in US Dollars and exclude applicable taxes.

° Travel and expenses will be invoiced monthly based on actuals if required. City of Nashua
shall reimburse Supplier for reasonable Travel and Expenses (“T&E”), which shall be
properly documented with receipts provided to City of Nashua upon request.

General Assumptions

© ClearSky will provide the Services for this Project during business hours; typically ranging
between 8:00AM to 6:00PM CDT time, Monday through Friday, except US federal
holidays and other holidays recognized by City of Nashua. Out-of-town personnel may
work hours other than those defined as normal business hours to accommodate their
travel schedules.

¢ City of Nashua shall provide ClearSky with access to City of Nashua personnel, related
systems and documentation deemed pertinent to the effort when required.

e When ClearSky is on-site, City of Nashua will be responsible for providing workspace,
access to the Internet via ClearSky laptop computers, and access to phones in the event
mobile signals cannot be obtained.

¢ ClearSky will abide by all written rules and security requirements while on City of Nashua
premises.
