System (MS4) Support Services
AGREEMENT FOR PROFESSIONAL SERVICES
AMENDMENT Ne 1

This Amendment dated the day of ,20 to the Agreement for
Professional Services (“the “Agreement”) dated the 18th day of February, 2021 is made and
entered into between City of Nashua ("CLIENT') and Hazen and Sawyer ("CONSULTANT’),
collectively, “the Parties.”.

WHEREAS, the Parties desire to amend “Exhibit B--Hazen and Sawyer Scope of Service
Proposal, dated January 21, 2021” and paragraph 4 “COMPENSATION” of the Agreement

NOW THEREFORE, in consideration of the mutual promises herein contained, CLIENT and
HAZEN agree to modify the following paragraphs of the Agreement.

Exhibit B--Hazen and Sawyer Scope of Service Proposal, dated January 21, 2021

The Scope of Services currently authorized to be performed by HAZEN in accordance with the
Agreement, and previous Amendments, if any, is modified as follows:

Task 1 — Dry Weather Outfall Screening and Sampling
Addition of 100 outfalls to be screened and sampled, project management, and QA/QC of second
summary memorandum.

Task 7 — Annual Reports
Additional labor for second year annual report.

COMPENSATION

For the Additional and/or Changed Services to services set forth above, CLIENT shall pay HAZEN
the following additional compensation:

Task 1 — Dry Weather Outfall Screening and Sampling $28,575
Task 7 — Annual Reports $11,852
Amendment 1 increases the current Contract Agreement Maximum Amount from $187,550 by

$40,427 to a revised Maximum Amount of $227,977. The cost of the additional services shall not
exceed $40,427

provisions of the Agreement not modified by this or previous Amendments remain in effect.

This Amendment may be executed in counterparts, each of which shall be deemed to be an
original.

A regular meeting of the Board of Aldermen was held Tuesday, December 26, 2017, at 7:30 p.m. in the
Aldermanic Chamber.

President Brian S. McCarthy presided; City Clerk Patricia Piecuch recorded.
Prayer was offered by City Clerk Patricia Piecuch; Alderman June M. Caron led in the Pledge to the Flag.

President McCarthy

Before | ask the Clerk to take the roll, Alderman Cookson is participating by telephone; and under the terms of
the State law, that allows him to do that. He needs to explain why he can’t attend, if he can hear us, and who
he is with, if anyone.

Alderman Cookson stated the reason he could not attend, confirmed that he could hear the proceedings, and
stated who was present with him.

President McCarthy
Acknowledged that those present could hear Alderman Cookson as well.

The roll call was taken with 11 members of the Board of Aldermen present; Alderman Siegel, Alderman
Schoneman, Alderman McGuinness, and Alderman Lopez were recorded absent.

Alderman Cookson was not in attendance but participated in the meeting via telecommunication.
Mayor James W. Donchess and Corporation Counsel Steven A. Bolton were also in attendance.

Before we begin, | am going to ask Alderman Wilshire to make a motion so we can accept procedural motions
without the roll call vote.

REMARKS BY THE MAYOR

First, | would like to congratulate to the PAL Cheerleading team. We're going to do that more officially in a
couple of moments. I’m glad you’re all here and it was really a wonderful award to have won.

Of course, tonight is the last meeting of the Board of Aldermen before the new term. | want to thank everyone
who has served for the last two years. All have been dedicated to the good of our community, and the
contributions of each and every member of the Board of Aldermen are important and significant. | think over
the past two years, we have accomplished a number of things: We started universal full-day kindergarten; we
initiated a five-year paving plan of action to improve Nashua’s infrastructure; we initiated the Safe Stations

program; we are working with the Boston Surface Railroad Company to try to develop a plan for rail service to
Nashua; and certainly, over these and some other issues, there has been some disagreement. But | think that
one thing that can be fairly said is that at all times, even though people obviously disagree as to what is the
best course to pursue Nashua’s interest, all members of the Board of Aldermen have conducted themselves
with mutual respect and with professionalism. | think this has been very important and is very important in the
future, because people understand and accept that we will have different ideas but they rightfully expect that
we will act with professionalism. And | think all members of the Board of Aldermen in the Aldermanic Chamber
have met that standard, and | think we can be very proud of that. | think each one of you is due credit for that
significant accomplishment.

With that, I’d like to wish everybody well. For those who aren’t coming back, please keep in touch. Those who
are, | look forward to working with you in the coming term.

Just while we have the members of the PAL Force team here, I’d like to congratulate them. But | think it’s
important to recognize the parents and the coaches for all of their efforts, and thank them for what they do to

| wanted to extend my congratulations to the Nashua PAL Force Division Red Team as well. | apologize that
my daughter Alexandra was not able to join you this evening; she is traveling with me. Again, recognizing the
girls for all their hard work; the coaches; the assistant coaches; everybody just did a fabulous job this year. I’m
really excited to be part of the team, and to recognize the team and their contributions to the City of Nashua.

Under our rules and certain attendance conditions, the Board has to vote to waive the rules in
order to give the stipends out for the quarter.

Would anybody like to explain why we’re willing to waive NRO 5-6 in this case?
Mr. Bolton, Corporation Counsel

The ordinance itself specifies the conditions that it could be waived, and one of those is illness.
The Board may decide that that is what’s involved here.

I’ve asked and no one has ever said anything about a justification for absence. Would anybody

REMARKS BY THE MEMBERS OF THE BOARD OF ALDERMEN

Alderman O’Brien

First, I’d like to mention my appreciation for serving with our Aldermen who won't be coming back for the next
term. Being the first part of my term, it was a pleasure working with you all and | wish you the best of luck in
your endeavors.

Second to that, | received a lot of talk from constituents dealing with the storm. There was a comment made
earlier in Finance by Alderman Clemens. | will speak to the Mayor about it, but | do have the opinion, too, that it
was a very severe ice storm; it was tough. | would like to also give credit to the men and women who did get
out there and try to keep our streets open, with the understanding of the harsh conditions that were out there
as well. But | do understand our constituents; they do have the right and to let us Know when things aren’t
appropriate. That's how we fix the solution.

Alderwoman Melizzi-Golja

Regarding the storm, | know that in Ward 8 the issues of keeping the hills clean and safe is always a top
priority, and | would like to thank the members of DPW for their work. They were out de-icing the roads and
salting and sanding, and it was appreciated.

And for those on the Board who will not be returning, | look forward to seeing you in the community and thank
you for your efforts with reference towards moving the city forward. Happy New Year.

Alderman Caron

| would like to wish good luck to our Aldermen who are outgoing, and welcome the new members in a couple
of weeks. To that, just to remind you that the inauguration is January 7 at Nashua High School North at
noontime.

| also have a comment about the plowing. | Know that they were very busy, because they finished with the ice
storm and then you had the big storm on Christmas day, but one suggestion would be to make sure that the
community shed that has the salt and sand is properly maintained. They ran out and my husband was handing
out the little bit of salt and sand that he had picked up that morning. That’s just a reminder, because it was
quite icy on Sunday for the community at large.

And last, but not least, | wish you all a Happy New Year.

Happy New Year to everyone.

| also wanted to just shout out to the police and fire departments who went above and beyond helping the
citizens of Nashua, and worked far beyond their normal duties. It shows a lot of both groups.

| just want to take a moment to express my thanks and appreciation to the constituents of Nashua who have
honored me with being a member of the Board of Aldermen for 10 of the past 12 years. | also wanted to thank
those members of the Board of Aldermen, the current and past members that I’ve had the honor to serve with.
I’ve served with some fabulous Aldermen and I’ve learned a lot from them. | hope that we’re able to continue in
the future working together with one another; we are listening to all constituents. And | wish everyone a Happy
New Year.
