RESOLUTION

RELATIVE TO THE RE-APPROPRIATION OF FISCAL YEAR FY2019 ESCROWS

CITY OF NASHUA

In the Year Two Thousand and Eighteen

RESOLVED by the Board of Aldermen of the City of Nashua that the sum of
$2,435,591.52 as outlined in the attached FY19 Escrow Requests document be re-appropriated as
FY19 Escrows in compliance with procedures established in NRO 5-130 and recorded in a manner
consistent with previously established accounting procedures. The sources of said escrows shall
be FY18 unexpended appropriations as follows:

General Fund Operating Budgets — Unlike (Within Specific Departments) $ 215,591.52
General Fund Operating Budgets — Unlike (Other or Multiple Departments) _ 2,220,000.00
Total $ 2,435,591.52

The approved funds will be utilized only for the purposes set forth in the attached
FY19 Escrow Requests document. Prior to final passage, if the final FY18 departmental and/or
line item balance is determined to be less than any individual escrow request, then the lesser
amount will be the amount actually escrowed.

ORDINANCE

PROHIBITING PLACING OR BLOWING YARD DEBRIS IN THE STREET

CITY OF NASHUA

In the Year Two Thousand and Eighteen

The City of Nashua ordains that Part II “General Legislation”, Chapter 285 “Streets and
Sidewalks”, Article IV “General Street and Sidewalk Regulation”, Section 285-28 “Placing snow
in street” of the Nashua Revised Ordinances, as amended, be hereby further amended by deleting
the struck-through language and adding the new underlined language as follows:

“§ 285-28. Placing snow or yard debris in street.

No person shall by himself ef or by his agent or agents throw, push, blow or put any
snow, efice, or yard debris, including but not limited to leaves, branches, and grass
clippings, into oraeress the right- of way of any way, street, lane, oralley or sidewalk.

shall not apply to the following situations: (i) placement he has been directed or requested
by the Division of Public Works: or (ii) clean-up or collection of material is
simultaneously occurring. Any person who shall violate this section shall upon
conviction be subject to punishment as provided in § 1-12.”

RE: — Report on Surplus and Overlay 2019

Although this report was due to the Board of Aldermen on or before September 1* in accordance
with NRO 5-136, I felt it best to obtain additional information on the revaluation of commercial
and industrial properties from KRT Appraisal before submitting this report.

Having received the additional information yesterday, I am providing you with our estimate of
overlay needed for FY19 ($3.0 million). Iam also providing you with the amount we have left
in the overlay from prior years ($2.7 million) and the overlay reserve ($1.5 million). See the
attached “Surplus Use and Overlay Notification.”

Also in accordance with NRO 5-135(B), I am providing the Board with an estimate of
unassigned fund balance as well as how much of that balance I propose to use to reduce the
anticipated tax rate. The unassigned fund balance 1s projected to be $34,838,600. Iam
recommending that we use $4,500,000 of the unassigned fund balance against the tax rate.

NRO 5-135(A) outlines a policy that a minimum 10% of a fiscal year’s appropriations be
maintained in undesignated general fund balance. As you can see in the “Surplus Use and
Overlay Notification” worksheet, the estimated unassigned fund balance is projected to be 11.5%
of the FY2018 fiscal year appropriations.

I will be submitting the resolution for your first meeting in September to propose the use of
$4,500,000 against the tax rate.

Pursuant to NRO § 5-74 (B), which states that a contract that extends from the current fiscal year into
succeeding fiscal year(s) in which no funds have been appropriated nor otherwise designated for this
purpose shall be approved by the full Board of Aldermen before the contract shall become binding on the
City.

The Finance Committee approved and placed on file the notification of the award of the referenced contract
at their September 5, 2018 meeting. | am requesting the concurrence and approval of the full Board of
Aldermen for the award of the following contract:

Contract for Landfill Gas Management Services — Included is the Purchasing Manager’s Memo #19-050
dated August 30, 2018 regarding the award of this contract at the Finance Committee meeting. This is a
three (3) year contract.

Please see the attached communication from Jeff Lafleur, Solid Waste Department Superintendent dated
August 23, 2018 for the information related to this contract.

Pursuant to NRO § 5-84. Special purchase procedures. A. The competitive bidding process shall not
apply to the following special purchases: (7) Purchases under extensions of contracts when no price
increase exceeds 10%.

The Solid Waste Department Superintendent, Board of Public Works (August 23, 2018 meeting) and the

Purchasing Department recommend the award of this contract in an amount of $12,000 per year to
Sanborn Head and Associates, Inc. of South Windsor, CT. This is a three (3) year contract.
