Please see the attached communication from Jeff Lafleur, Solid Waste Department Superintendent dated
April 26, 2018 for the information related to this contract.

Pursuant to § 5-78 Major purchases (greater than $10,000) A. All supplies and contractual
services, except as otherwise provided herein, when the estimated cost thereof shall exceed
$10,000 shall be purchased by formal, written contract from the lowest responsible bidder, after
due notice inviting bids.

The Solid Waste Department Superintendent, Recycling Coordinator, Board of Public Works (April 26,

2018 meeting) and the Purchasing Department recommend the approval of this contract in an amount
not-to-exceed $20,000 to Interstate Refrigerant Recovery, Inc. of Foxboro, MA.

A special meeting of the Board of Aldermen was held Wednesday, May 30, 2018, at 7:00 p.m. in the
Aldermanic Chamber.

President Brian S. McCarthy presided; Deputy City Clerk Judith Boileau recorded.

Prayer was offered by Deputy City Clerk Judith Boileau; Alderman-at-Large David C. Tencza led in the Pledge
to the Flag.

The roll call was taken with 14 members of the Board of Aldermen present; Alderman Ken Gidge and Alderman
Tom Lopez arrived after roll call at 7:02 p.m. and 7:03 p.m., respectively. Alderman-at-Large Brandon Michael
Laws was recorded absent.
PUBLIC HEARING
Amended, O-18-012
AMENDING THE FEE SCHEDULE OF THE CITY BUILDING REGULATIONS

As provided for in NRO 5-28, President McCarthy gave a brief explanation on Resolution
R-18-022 prior to hearing testimony from the public.

The sole item on tonight’s agenda is a public hearing on amended ordinance 18-012 amending the fee
schedule of the City Building Regulations. To conduct the hearing | will turn the meeting over to the Chairman
of the Budget Committee but first | will invite the Deputy City Clerk to take her leave from us if she would like
to. | ask the Budget Clerk to take over.

Let the record show that Alderman Gidge has arrived at 7:02. The Public Hearing is on the amended ordinance
O-18-012 amending the fee schedule of the City Building Regulations. Would Director Marchant and whoever
you would like to bring up come up so you can explain. Also, Alderman Lopez snuck in here at 7:03.

Good evening, thank you for having us. Sarah Marchant, Community Development Director and I'd like to
introduce Bill McKinney the Building Safety Manager. We are here before you with the update of the building
fee ordinance, it hasn’t been updated since 2007. We have had several discussions about this already and we
are happy to answer any questions you have. Itis pretty clear which fees are being proposed to be changed.

Are there any questions relative to the ordinance that you would like to ask?

If | could just ask generally how did you go about figuring the increases in cost. | am assuming, obviously, in

11 years the administrative costs go up but I’m not sure, did you use a guide or is this based on the amount of
time that the office puts into each application?

Bill McKinney, Building Official for the City. Most of our information was gained on studies through our
administrative expenses for the department; the time that it takes of in taking of permits, plan review, permit
issuance process and our inspection process. We also looked back through several years of what our costs
versus revenues for the Department were back to 2007 and we worked on our budget from there to come up to
our increases of what our threshold was to be between 15% and 20% of an increase overall. Individually you
will find that some of these fees were so drastically low that they needed to come up much higher than that.

Director Marchant, was your budget revenue calculated on this passing or does this have a slight increase in
your budget revenue?

Ms. Marchant

We would project if we could a slight increase to next year’s revenue. It was not included in the revenue
projections. | would say that the construction industry has its ups and downs regularly. So it is a very hard
thing to predict. We have been pretty steady recently so these fees we do think will bring in more revenue as
long as construction stays at the same pace yes.

AMENDING THE FEE SCHEDULE OF THE CITY BUILDING REGULATIONS

CITY OF NASHUA

In the Year Two Thousand and Eighteen

The City of Nashua ordains that Part II “General Legislation”, Chapter 105 “Building
Construction”, Article VI “Fees”, Section 105-22 “Fee Schedule” of the Nashua Revised
Ordinances, as amended, be hereby further amended by deleting the struck-through language and
adding the new underlined language as follows:

“§ 105-22. Fee Schedule.

A.

Building permit fee schedule.

A nonrefundable application processing fee shall be paid at the time of filing of
any application:

(a) Building permit: $2535.

New buildings, additions, alterations, mobile homes, in-ground swimming pools,
basements, connecting structures, future expansion areas and areas capable of
being used as living or occupiable space shall be included to calculate aggregate
floor area:

(a) Residential — 1 & 2 Family and Townhouses (per square foot of area
affected): $0.4415.

(b) Commercial — including Multi-Family (per square foot of area affected):
$0.2025.

Structures designed and certified to LEED standards shall be eligible for the
following reduction in their building permit fee:

(a) LEED standard certification: 5%.
(b) LEED silver certification: 10%.
(c) LEED gold certification: 15%.

(d) LEED platinum certification: 20%.

(5) Additional plan review for minor modifications of previously approved drawings,
including commercial tenant fit-up:

(a) Residential (per square foot of area affected): $0.90305.
(b) Commercial (per square foot of area affected): $0.0710.

(c) When, in the Building Official's opinion, the nature of the work is not
related to floor area, the permit fee may be based on a construction cost of

(6) Moving a building from lot to lot: $455180.

(7) | Demolition — the total removal and disposal of a structure:
(a) Up to 1,000 square feet: $2230.

(b) Excess beyond 1,000 square feet (fee for each additional 100 square feet
or part thereof of aggregate floor area): $2593.

(8) Hlevaters—$88- Certificate of Occupancy — existing space/owner change: $50.

(9) Special construction — not including signs, but including and not limited to
membrane structures, temporary structures, canopies and awnings, pedestrian
walkways, radio and television towers, radio and television antennas, elevators,

commercial solar energy systems, commercial wind energy systems and
commercial (other than asphalt roofing shingles) re-roofing:

(a) Fee shall be based on a construction or installation cost of 9-006-m#Hls-per
dettar$0.60 per $100.

(10) Retaining walls over four feet in height above grade G@vhicheveris-sreater):

(a) Minimunm—355—or Residential: minimum $25 or $0.10 per linear foot
(whichever is greater).

(b) Pertnearfeet—$020- Commercial: minimum $50 or $0.25 per linear foot
(whichever is greater).

(11) Minimum fee for miscellaneous equipment (each), excluding the application fee,
where not otherwise provided for by this section [for example: residential
antennas, small sheds (less than $90200 square feet), or construction trailers] or as
deemed appropriate by the Building Official or his or her designee:

(a) Residential: $4020.
(b) Commercial: $3545.
