ORDINANCE

EXTENDING THE HOURS OF ON-PREMISES SALES OF ALCOHOLIC
BEVERAGES TO 2 A.M. FOR CHARITABLE GAMING FACILITIES

CITY OF NASHUA

fn the Year Two Thousand and Twenty-Two

The City of Nashua ordains that Part II “General Legislation”, Chapter 83 “Alcoholic
Beverages”, of the Nashua Revised Ordinances, as amended, be and hereby is further amended
by adding the new underlined article:

“ARTICLE IV
Hours of Sale for Certain On-Premises Licensees

§ 83-19. Hours of Sale for Certain On-Premises Licensees.

On-premises licensees with a games of chance facilities license fer charitable
gaming pursuant toa New Hampshire RSA Section 287-D:7 shall be permitted to
sell alcoholic beverages until 2:00 a.m, Licensees shall be subject to all
conditions and requirements established by statute and the New Hampshire State
Liquor Commission.”

All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

his legislation shall take effect following its passage.

ORDINANCE: O-22-007
PURPOSE: Extending the hours of on-premises sales of alcoholic beverages

to 2:00 a.m. for charitable gaming facilities

FISCAL NOTE: None.

ANALYSIS

This legislation permits businesses with games of chance facility licenses for charitable gaming
(pursuant to RSA 287-D:7) who have on-premises licenses for the sale of alcchoi to sell alcohol
for an additional hour, until 2:00 a.m. The licensees will be subject to all conditions and
requirements established by statute and the State Liquor Commission. The city’s authority to
extend the hours for sale of alcohol by on-premises licensees until 2:00 a.m. “under conditions
authorized by the legislative body of the city or town in which the premises are located” is found
at RSA 179:17, II (b).

ORDINANCE

RELATIVE TO SEASONAL ROAD CLOSURES AND ELIMINATION OF CERTAIN
ON-STREET PARKING FOR EXTENBED OUTDOOR DINING AND OTHER NON-
VEHICULAR USE

CITY OF NASHUA

In the Year Two Thousand and Twenty-Two

The City of Nashua ordains that Part I “General Legislation”, Chapter 320 “Vehicles and
Traffic “of the Nashua Revised Ordinances as amended, is hereby further amended by adding the
new underlined article as follows:

“ARTICLE XVil
Seasonal! Road Closures and Madifications

§ 320-92. Effective Dates and Pian.

Effective from 12:01 A.M. May t* through midnight October 15'" in years 2022, 2023
and 2024, the roads and on-street parking shown on Plan 320-92 are modified as shown
on said plan. Such modifications include but may not be limited to partial closing of a
street to vehicular traffic, elimination of on-street parking spaces, changes to parking time
limits, changes to cost of parking spaces, including making them free, and handicap
parking spaces relocated or created. The modifications are to accommodate non-
vehicular traffic and uses by the public or outdoor dining.

§ 320-93. Pian Amendments.

Upon recommendation of the Director of Public Works and the Parking Manager, and
with the approval of the Committee on Infrastructure, the Mayor may adjust locations of
barriers, parking spaces, fees for parking. time for parking spaces, and location of parking
spaces as circumstances warrant. In such cases, a new plan shall be published at least 14
calendar days prior to the adjustments.

§ 320-94. Conflicts.

During the time periods set forth in Section 390-92, this Article supersedes any
inconsistent ordinances or parts of ordinances.”

This legislation shall take effect upon passage.

The redaction in meter revenue is estimated to be from $30,000
and $45,000. The reduction in parking enforcement revenue is
estimated to be from $5,000 to $8,606. Cost to move the
barriers is estimated to be $60,000 a vear. Painting cost is
estimated to be $20,000.

ANALYSIS

RSA 41:11 enables the Board of Aldermen to regulate the use of all public highways and

sidewalks,

ORDINANCE

RAISING THE LANDFILL DISPOSAL FEE FOR CONSTRUCTION AND
DEMOLITION DEBRIS FROM $90 PER TON TO $300 PER TON

CITY OF NASHUA

In the Year Two Thousand and Twenty-Two

The City of Nashua ordains that Part I] “General Legislation”, Chapter 270 “Solid
Waste”, Article III “Sanitary Landfill”, Section 270-9 “Fees for deposit of waste” of the Nashua
Revised Ordinances, as amended, be and hereby is further amended by deleting the struck-
through language and adding the new underlined language as follows:

“§ 270-9. Fees for deposit of waste.

All permittees holding permits under § 270-8 shall pay the following fees in connection
with waste matertal deposited by them at any iand fill:

Cc Construction and demolition debris shall be charged on a per-ton basis at $300 per
ton. Feral Other acceptable municipal solid waste otherthat-that not defined in
other subsections of this section, a-sem shall be charzed on a per-ton basis not less
than $60 per ton and not more than $90 per ton to be established from time to
time by the aldermanic Finance Committee in consultation with the Director of
Public Works and Board of Public Works. There will be a minimum charge not to
exceed 1/2 of a ton as established by the Board of Public Works for commercial
disposal of municipal solid waste, construction and demolition debris and
sweepings. Waste from mobile home parks and multifamily residences, including
apartment, condominium, rowhouse and townhouse complexes, shall be exempt
from such fee in accordance with written procedures established by the Division
of Public Works.”

This ordinance shail become effective upon passage.
