Apply rubber membrane under all roofing units and new RPI walkway pads with
sleepers above to mount the roafing units.

Apply RPI walkway pads from the door entrance and all the way around the
large units and both AC units. Note, the walkway pads will have 1” spacing
in between each to allow water to flow to the drain.

The roof units will be raised and reattached by J. Lawrence Hall.

8. Waste disposal:

® The work areas shall be kept neat and clean on a daily basis.

e An on site container will be used for disposal of tear off materials.

® The container will be set on planks to prevent damage.

e The location of the container to be determined at a later time.

*® The container shall remain on the job site until the work has been
completed.

9. General notes:

e Contractor to provide sanitary facilities for the duration of the project
for the work crew.

® All exterior work areas shall be thoroughly cleaned upon completian of the
job.

® Follow ali existing OSHA regulations as mandated by 29 CFR 1926 for the
construction industry.

e® All work to be done in a workmanlike manner in accordance with the standard
practices,

@ Also followed are special considerations set forth by the manufacturer for
the application of the specific product line.

® We maintain a current General Liability and Workman's Compensation
Insurance policy. A copy of this policy will be sent to you to verify our
coverage if requested.

Right of Rescission

I have the right to terminate this contract within three {3} business days of signing this
agreement. If I ¢hoase to terminate this contract, I will contact Chick Beaulieu, Inc. office on
or before - In the avent I terminate this agreement there will be no penalties,

and any deposits of mine will be promptly returned.

If the customer is a corporation or Timited partnership, the undersigned, jointly, severally or

Responses to Submitted Questions

What is the minimum R-value you are looking for?
o As per the IFB: “replacement of the existing insulation with similar material with
the same R value or better” is required in the bid.

Alternatively, do you want tapered insulation over the minimum R-value?

o As per the IFB: “The project consists of the design-build efforts necessary for
replacement of the roofing” which includes “determination of a suitable
replacement membrane for the roof”. As long as the same R value or better is
met we are open to new roofing suggestions.

Would you like vapor barrier as part of the new assembly?

Would you like the ballast stone removed?
o As per the IFB: “removal of the existing stone on the roof” is part of the project.

Will the brick repair be by others at no cost to the roof contractor?
oO As per the IFB: “replacement of roof flashing, drains, and drip edges
where needed” is required. Any associated brick / masonry work needed to
accomplish this should be included in the bid.

Do you want to match the existing edge metal? (It is believed to be lead coated, which
would be more expensive than grey aluminum or grey steel.) Do you want the roof
drains replaced? (interior access will be required.)

o As per the IFB: “replacement of roof flashing, drains and drip edges where
needed” is required. The flashing/metal work should match the existing building
for continuity on the property.

What is the warranty term you are looking for?
o Warranty should not be less than 20 years from the date of final inspection and
approval.

Is a building permit required?
o Yes.

e What is the time frame (start/finish dates) to allow for the temporary disconnect of
HVAC unit?

o The dates below are flexible as they weather dependent. Because the project is
dependent on HVAC system service interruption the project should commence
no earlier than October 1, 2016 (unless the average daily temperature exceeds
85 degrees) if so then the project should be postponed until November 1, 2016
at the latest, regardless of the average daily temperature). Because of this
flexibility the allowed time frame for substantial completion will be 90 days after
the Notice to Proceed and final completion will be 180 days.

e Will the test cut results be posted?

oO Bidders will be responsible for including cost associated with Asbestos
sampling. Do not include cost of removal at this time as we are unsure of
asbestos presence. We require the use of a State Licensed Consultant and/or
Contractor to perform the tests. Attached to this Addendum item is the State’s
Licensed Asbestos Abatement Contractors and Consultants list.

Assuming no asbestos is found, the bidder agrees to perform all of the reroofing and
related work for the building listed in the project scope/specifications at the Nashua
Police Department for the sum of:

Test Cuts and Evaluation for Asbestos

The bidder will perform test cuts at roofs. This item shall be bid at a unit price and will
include all labor, patching materials and lab testing costs. According to EPA
requirements, “a homogenous area (our roof for example, if all the materials look the
same, no repaired areas ) with an area of between 1000 and 5000 square feet would
require 5 bulk samples to be collected.” Do not include cost of removal at this time as
we are unsure of asbestos presence. We require the use of a State Licensed
Consultant and/or Contractor to perform the tests. Attached to this Addendum item is
the State’s Licensed Asbestos Abatement Contractors and Consultants list.

Please see attached communications from Jennifer McCormack, Director of Nashua Public Library, dated
June 14, 2021 for project specific details related to this purchase. Below please find a summary of the
purchase approval request:

STANDARD FORM OF AGREEMENT
BETWEEN OWNER AND CONTRACTOR

This agreement is made:

And the CONTRACTOR: Chick Beaulieu, Inc and its successors, transferees and assignees (together
“CONTRACTOR”)

For the following Project: Fleet/Range Roof Replacement at NPD

ARTICLE 1-— THE CONTRACT DOCUMENTS

The CONTRACTOR shall complete: the work described in the Contract Documents for this project. The
documents consist of: ig

1. This Agreement signed by the OWNER and CONTRACTOR, including the General Terms and
Conditions;

Scope of Work;

Drawings and Specifications provided in the bid documents;

Change Order Form; ~

Insuranice Certificate;

Written change orders for minor changes in the Work issued after execution of this Agreement; and
Fully Executed OWNER Purchase Order

The Contract represents the entire and integrated agreement between the parties and supersedes prior
negotiations, proposals, representations or agreements, either written or oral. Any other documents which
are not listed in this Article are not part of the Contract.

In the event of a conflict between the terms of the Proposals and the terms of this Agreement, a written
change order and/or fully executed OWNER Purchase Order, the terms of this Agreement, the written
change order or the fully executed OWNER Purchase Order shall control over the terms of the Proposals
ARTICLE 2 — DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION DATE

ARTICLE 3 — CONTRACT SUM

Subject to additions and deductions by Change Order, the OWNER shall pay CONTRACTOR, in
accordance with the Contract Documents, the Contract Sum of:

($78,900)
The Contract Sum shall include all items and services necessary for the proper execution and completion of
the Work.

ARTICLE 4 — INSURANCE AND INDEMNIFICATION

CONTRACTOR shall carry and maintain in effect during the performance of services under this contract:

>» General liability insurance in the amount of $1,000,000 per occurrence; $2,000,000 aggregate;
> Motor Vehicle Liability: $1,000,000 Combined Single Limit;
*Coverage must include all owned, non-owned and hired vehicles.

> Workers’ Compensation Coverage in compliance with the State of NH Statutes,
$100,000/$500,000/$ 100,000.

CONTRACTOR and SUBCONTRACTORs at every tier will fully comply with NH RSA Chapter
281-A, “Workers’ Compensation”.

The parties agree that CONTRACTOR shall have the status of and shall perform all work under this
contract as an independent CONTRACTOR, maintaining control over all its consultants, sub consultants,
CONTRACTORs, or SUBCONTRACTORs. The only contractual relationship created by this contract is
between the OWNER and CONTRACTOR, and nothing in this contract shall create any contractual
relationship between the OWNER and: CONTRACTOR’s consultants, sub consultants, CONTRACTORs,
or SUBCONTRACTORs. The parties also agree that CONTRACTOR is not an OWNER employee and that
there shall be no:

Withholding of'income taxes by the OWNER:

Industrial insurance coverage provided by the OWNER;

Participation in group insurance plans which may be available to employees of the OWNER;
Participation or contributions by either the independent CONTRACTOR or the OWNER to the
public employee’s retirement system;

Accumulation of vacation leave or sick leave provided by the OWNER;

6. Unemployment compensation coverage provided by the OWNER.

CONTRACTOR will provide the OWNER with certificates of insurance for coverage as listed below and
endorsements affecting coverage required by the contract within ten calendar days after the OWNER issues
the notice of award. The OWNER requires thirty days written notice of cancellation or material change in
coverage. The certificates and endorsements for each insurance policy must be signed by a person
authorized by the insurer and who is licensed by the State of New Hampshire. General Liability and Auto
Liability policies must name the OWNER as an additional insured and reflect on the certificate of
insurance. CONTRACTOR is responsible for filing updated certificates of insurance with the OWNER's
Risk Management Department during the life of the contract.

> All deductibles and self-insured retentions shall be fully disclosed in the certificate(s) of insurance.

> If aggregate limits of less than $2,000,000 are imposed on bodily injury and property damage,
CONTRACTOR must maintain umbrella liability insurance of at least $1,000,000. All aggregates
must be fully disclosed on the required certificate of insurance.
