FY2022 unanticipated Food Services related revenue into Fund

FISCAL NOTE: This resolution appropriates an additional $300,000 to the
Food Services Fund.
ANALYSIS

This resolution appropriates $300,000 of FY2022 unanticipated revenue into the Food Services
Special Revenue Fund. The unanticipated revenue received represent reimbursement from the
Federal Government for the “Free and Reduced Lunch Program”.

Charter Sec. 53 permits specific non-budget, supplementary appropriations. There should be
notice and a public hearing. A two-thirds vote is required under Charter Sec. 56-b for an item or
amount not in the mayor’s budget. A roll call is required under Charter Sec. 49.

RESOLUTION

RELATIVE TO THE TRANSFER OF CORONAVIRUS STATE AND LOCAL FISCAL
RECOVERY FUNDS ESTABLISHED BY THE AMERICAN RESCUE PLAN ACT
“ARPA” AND FY2022 SUPPLEMENTAL APPROPRIATIONS IN THE AMOUNT OF
$14,500,000

In the Year Two Thousand and Twenty-Two

WHEREAS Resolution R-21-167 accepted $16,138,777 from the Coronavirus State and
Local Fiscal Recovery Funds established by the American Rescue Plan Act “ARPA” to fund
eligible expenses and/or revenue replacement.

THEREFORE, BE IT. RESOLVED by the Board of Aldermen of the City of Nashua to
authorize a transfer of estimated revenues and appropriations from the ARPA Grant Fund into
the City FY2022 General Fund as revenue replacement to fund the “provision of government
services” allowable expenses. Recognizing that the City of Nashua experienced lost revenue in
excess of $14,500,000 due to the Coronavirus pandemic, $14,500,000 in salaries and wages paid
out of the Nashua Police Department FY2022 operating budget was selected as the costs
associated with the provision of government services that will be reported to the U.S. Treasury in
compliance with the ARPA rules.

FURTHER RESOLVED by the Board of Aldermen of the City of Nashua to appropriate
in FY2022 the sum of $14,500,000 from the Nashua Police Department into the following funds

ANALYSIS

This resolution authorizes a transfer of estimated revenues and appropriations from the ARPA

AMENDING THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
CONSOLIDATED PLAN FOR FISCAL YEARS 2021-2025 TO ACCEPT ROUND 4
CDBG-CV FUNDING UNDER THE 2020 CARES ACT

CITY OF NASHUA

In the Year Two Thousand Twenty-Two

RESOLVED by the Board of Aldermen of the City of Nashua that

WHEREAS the Coronavirus Aid, Relief, and Economic Security Act (CARES Act)
included funding to be distributed pursuant to section 106 of the Housing and Community
Development Act of 1974 (42 U.S.C. 5306) to grantees that received allocations pursuant to that
same formula in federal fiscal year 2020;

WHEREAS the U.S. Department of Housing and Urban Development (HUD) awarded
Community Development Block Grant-Coronavirus (CDBG-CV) funds to the City of Nashua to
prevent, prepare for, and respond to coronavirus;

WHEREAS R-20-029, passed by the Board of Aldermen on April 28, 2020, authorized
the City to accept Round One CDBG-CV funding in the amount of $390,913 and created the
COVID-19 Impact Fund Program;

WHEREAS R-21-112, passed by the Board of Aldermen on February 23, 2021,
authorized the City to amend the FY2020 HUD Annual Action Plan to accept Round Three
CDBG-CV funding in the amount of $482,813 under the 2020 CARES Act;

WHEREAS HUD has awarded the City an additional $168,968 under Round Four
CDBG-CV funding, requiring the City to further substantially amend its FY2021-2025 HUD
Consolidated Plan and associated Annual Action Plan, pursuant to HUD guidance; and

WHEREAS this substantial amendment will follow the CARES Act waiver provisions
related to virtual public hearings and reduced comment periods, to allow grantees to utilize
expedited procedures to prepare, propose, modify, or amend its statement of activities for grants
from amounts made available under CARES Act as well as funding under the City’s FY2020
grant as authorized under R-20-029.

In the Year Two Thousand and Twenty-Two

RESOLVED by the Board of Aldermen of the City of Nashua that the City is authorized
to enter into a Memorandum of Understanding with the City of Manchester, New Hampshire,
regarding a welfare software application in substantially the same form as the attached after the
Memorandum of Understanding has been approved and signed by the City of Manchester.

FURTHER RESOLVED by the Board of Aldermen of the City of Nashua that the Mayor,
with the assistance of the Office of Corporation Counsel, is authorized to prepare and execute the
Memorandum of Understanding and all necessary documents and take all necessary actions
contemplated by the Memorandum of Understanding or required to effectuate the same.

allocated according to the recommendations of the Human Affairs Committee as voted upon at

RELATIVE TO PUBLIC COMMENT

CITY OF NASHUA

In the Year Two Thousand and Twenty-Two

The City of Nashua ordains that Part I “Administrative Legislation”, Chapter 5
“Administration of Government”, Part 2 “Board of Aldermen”, Article III “Rules and Order of
Business”, Section 5-14, “Order of Business”, of the Nashua Revised Ordinances, as amended, be
hereby further amended by adding the new underlined language and renumbering, as follows:

al On Public comment allowed in A and B above shall be conducted as follows:

(9) Excessive repetition and irrelevant remarks are discouraged;

(10) Crude. vulgar. profane and/or obscene remarks are prohibited: and

(11) __ The presiding officer has authority to terminate the remarks of any speaker when
such remarks do not adhere to this ordinance or other applicable law.”

All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

This legislation shall take effect following its passage.
