Calls for Service

Calls for service include 911 calls and any time a citizen, contractor, vendor, employee or business
owner contacts our Fire Alarm Division. These calls may be to report an emergency, request an
inspection, ask a question, schedule a school public service activity, advise us of a hazardous
condition, or any combination of the above.

The second quarter of 2022, Nashua Fire Rescue answered: 13,201 calls for service.

National Fire Incident Reporting System (NFIRS)

The National Fire Incident Reporting System (NFIRS) is a voluntary reporting standard that fire
departments use to uniformly report on the full range of their activities, from fire, to emergency
medical services to severe weather and natural disasters. NFIRS is the world’s largest, national,
annual database of fire incident information.

The second quarter of 2022, Nashua Fire Rescue responded to a total of 2,522 NFIRS Incidents

Emergency Medical Service Responses (EMS)

Emergency Medical Service responses include any emergency response created as a result of a 911
call for help that is coded as medical in nature. In some cases, the response includes a fire engine
with an AMR ambulance. In others it is a fire engine only. One example of a fire engine only response
would be for a lift assist where someone has fallen, believes they are uninjured, only requiring help to

get up.
The second quarter of 2022 Nashua Fire Rescue responded to 1,524 emergency medical calls.

City of Nashua Fire Marshal’s Office Activity

The Nashua Fire Marshal's Office is responsible to review all plans and inspect work to see that it
conforms to all relative building and Life Safety Codes.

The second quarter of 2022, the Fire Marshal’s Office completed 313 fire inspections.

assigned by DesignLAB to perform work under this contract. Approved key personnel shall
not be taken off of the project by DesignLAB without the prior written approval of the City
of Nashua, except in the event of termination of employment. DesignLAB shall, if
requested to do so by the City of Nashua, remove from the job any personnel whom the
City of Nashua determines to be incompetent, dishonest, or uncooperative.

. CITY OF NASHUA REPRESENTATIVE The City of Nashua may designate a City of Nashua
representative for this contract. If designated, all notices, project materials, requests by
DesignLAB, and any other communication about the contract shall be addressed or be
delivered to the City of Nashua Representative.

. CHANGES TO SCOPE OF WORK The City of Nashua may, at any time, by written order,
make changes to the general scope, character, or cost of this contract and in the services or
work to be performed, either increasing or decreasing the scope, character, or cost of
DesignLAB's performance under the contract. DesignLAB shall provide to the City of
Nashua within 10 calendar days, a written proposal for accomplishing the change. The
proposal for a change shall provide enough detail, including personnel hours for each sub-
task and cost breakdowns of tasks, for the City of Nashua to be able to adequately analyze
the proposal. The City of Nashua will then determine in writing if DesignLAB should
proceed with any or all of the proposed change. If the change causes an increase or a
decrease in DesignLAB's cost or time required for performance of the contract as a whole,
an equitable adjustment shall be made and the contract accordingly modified in writing.
Any claim of DesignLAB for adjustment under this clause shall be asserted in writing
within 30 days of the date the City of Nashua notified DesignLAB of the change.

When DesignLAB seeks changes, DesignLAB shall, before any work commences,
estimate their effect on the cost of the contract and on its schedule and notify the City of
Nashua in writing of the estimate. The proposal for a change shall provide enough detail,
including personnel hours for each sub-task and cost breakdowns of tasks, for the City of
Nashua to be able to adequately analyze the proposal. The City of Nashua will then
determine in writing if DesignLAB should proceed with any or all of the proposed change.

Except as provided in this paragraph, DesignLAB shall implement no change unless the
City of Nashua in writing approves the change. Unless otherwise agreed to in writing, the
provisions of this contract shall apply to all changes. The City of Nashua may provide
verbal approval of a change when the City of Nashua, in its sole discretion, determines that
time is critical or public health and safety are of concern. Any verbal approval shall be
confirmed in writing as soon as practicable. Any change undertaken without prior City of
Nashua approval shall not be compensated and is, at the City of Nashua’s election,
sufficient reason for contract termination.

. CITY OF NASHUA COOPERATION The City of Nashua agrees that its personnel will
cooperate with DesignLAB in the performance of its work under this contract and that such
personnel will be available to DesignLAB for consultation at reasonable times and after
being given sufficient advance notice that will prevent conflict with their other
responsibilities. The City of Nashua also agrees to provide Professional

Dear Board of Aldermen,

As Nashua’s Community Television Manager, from a technical and monetary viewpoint, it was
welcome news to hear that you are planning to eliminate a full blown Zoom element to your
meetings. As | have now heard that you will be debating this further at next week’s Board of
Aldermen, | would like to call to your attention a couple of factors that you may not be aware
of.

Approaching the end of a year using Zoom remotely, we could see the isolation phase of the
pandemic coming to an end early in 2021. Anticipating a slow transition to all in person
meetings, we endeavored to create a combo or hybrid set up in the Chamber. We quickly
found that mixing a service designed to be used over the web with one designed to be
broadcast over cable proved difficult. To be precise, the audio is always a miss-match. Through
the months we found that if our Videographer boots everything up in the Chamber on Monday
morning, and | start a “Mock” Zoom once we get everything balanced properly, and if we keep
the system on, it tends to stay that way for the four days that make up the rest of the week.
Unfortunately, we also found that if we keep the equipment continuously on past that, by the
next week it eventually degenerates to making those obnoxious electronic sounds when
people are talking. So, every Monday we perform this procedure at a cost of $3,744.00 per
year for the extra shift.

Because Zoom with a public element to it requires an active host, up until now this has fallen
to us as well. Basing it conservatively on three Committee meetings a week, this costs us
around $11,000.00 a year. This effectively doubles our cost to cover a meeting as our
Videographer (who cannot perform both duties at once) is there as well. This is unsustainable

for us.

As you can see, besides the subscription, the costs for Zoom have not come and gone, they are
continuous. As | believe we would be able to continue to absorb the Monday set up cost, | ask
that if you decide to keep Zoom, you make it available only to Aldermen and City staff on a per
need basis. That way it can be set to start up without the governing parameters that require a

watchful eye.

The Last Man Standing (in the Nashua Assessing Office} Greg Turgiss

Some of you may remember the story of the Private Investigator (PI) hired to track a Nashua
Assessor, Greg Turgiss, whereabouts while performing assessing work. The result of this
investigation showed that the assessor was sleeping at a railtrail head and in a parking lot behind a
hotel all while signing out on a Assessing Department white board that he was doing field work.

It was discovered during the investigation that more than ten years prior the assessor had two
incidents involving the use of city computers to view pornography, confessing to spending hours on
the City computers viewing images. Despite the repeat violation, he remained employed.

One would think that the PI report would have been the nail in the coffin, but not in Nashua. Scott
Painter UAW Union Rep., Director Kleiner, Mayor Donchess and the Nashua Police Department
all rallied behind Mr. Turgiss.

Mr. Painter represented Greg Turgiss but also the office worker who identified problems with Mr.
Turgiss’ work logs. This was a major conflict. He encouraged Ms. Walley to leave and back our
sleepy porn guy. Eventually, Ms. Walley was fired by Ms. Kleiner and ultimately settled with the

City for $100,000.

Ms. Kleiner thought Mr. Turgiss’ lying on the white board was just fine, but to keep his lies more
private, she had the white board removed from the office, The Mayor wanted to promote Mr.
Turgiss to a working Assessing Chief for the City of Nashua. The less you know, the higher you

go.

The Police Department conducted an investigation addressing potential criminal charges for
mileage fraud against Mr. Turgiss and witness tampering against Ms. Kleiner. The Police were not
capable of performing an unbiased investigation of “their own.” The Mayor controls their budget

and we all remember the Mayor’s power move to take control of the Police Commissioners,

The Police produced an Intradepartmental Communication on January 8, 2020 regarding the
investigation and gave Mr. Turgiss a pretty complimentary report. The report stated, “

In regards to the submission of fraudulent mileage reimbursement reports: All daily work and
activity logs that had been generated were compared to the mileage reimbursement forms that
Turgiss had submitted. In reviewing these logs and using Google maps mapping out the shortest
possible distances it would have taken Turgiss to visit the properties he had on specific days. In
doing so it was found Turgiss had not over reported any of his mileage and actually under
recorded the mileage on some days.

As a salaried employee Turgiss is entitled to his salary regardless of the actual hours he works as
long as he works at some point during a pay'period. In speaking with Turgiss's supervisors and the
Human Resources Department it appeared that Turgiss was completing the work that was required
and expected of him.

The DRA also conducted an investigation. They completed their report on January 24, 2020, weeks
after the NPD. They too had work logs and the Private Investigator’s Report. At that time, DRA
laws did not permit the sanctions and reports to be released. The Assessing Standards Board (Asb)
wrote legislation that passed in June 2022 to release these sanction reports. I just received these
reports through a Right to Know request. Here is what the DRA reported,

2. Dereliction of Duty — Breach of Ethics Rules. At various times during the month of April 2019,
you were observed by a taxpayer and a private investigator that she hired sleeping or relaxing in
‘your car parked at a trailhead and. in a:parking lot behind a local hotel for extended periods of
time during the work day while you were signed out of the office at City Hall as “in the field’. On
April 15, 16, and the week of April 26, it is clear that your field reports are contradicted by the
observations of the private investigator. Your field logs are incomplete and thus for any dates that
you were observed by the private investigator in the parking area and lacking a field report
showing you were actually doing something work-related, any uncertainties should be weighed
against you. This behavior constitutes misconduct under Asb 301.36 as dereliction of duty, or
malfeasance, misfeasance, or nonfeasance because during hours you were in your car napping or
relaxing you should have been performing the assessing duties outlined in Asb 304.04. Not doing
so and instead misrepresenting to your employers what you were actually doing constitutes
dereliction of duty, and malfeasance, misfeasance, or nonfeasance. It also constitutes misconduct
under Asb 301.36(b) as a violation of appraisal practice ethical standards, in particular, but
without limitation, Asb Code of Ethics Canon 1. The sanction for these violations under Asb 308.05
is decertification for up to 5 years.

What is most concerning is that the Police weighed heavily on what Mr. Turgiss told them despite
his lying on his logs and the City white board. His lying had no impact on his credibility in the eyes
of the police. The police investigation was improper.

What needs to change. The Police must enact a policy to prohibit investigations of City employees.
These investigations must go to a state agency. Nashua voters have to elect a new Mayor who

wants nothing to do with Ms. Kleiner. Both need to be shown the door. There is not much we can
do about the Union.

When all this was going down, the Assessing office had 9 workers, a chief, four assessors and four
clerical staff members. Everyone is gone now, except Greg Turgiss, the last man standing. The
coverup from all of these departments and individuals has left us with the sleepy porn guy for many
years and an Assessing Office with no credibility.

In June of 2019 Nashua resident Laurie Ortolano along with Nashua resident a Laura Colquhoun came
forward to the Nashua Police Department to report concerns regarding illegal activity within the Nashua
Assessing Department, specifically fraudulent mileage reports, theft of wages and possible bribery/improper
assessing practices involving employee Greg Turgiss and possible witness tampering/intimidation involving

Administrative Services Director Kim Kleiner.

Ortolano explained that she raised concems regarding operations in the Nashua Assessing Department in the
Fall of 2018. She advised that as a result of the information that she was able to gather, the City
commissioned. an audit of the Department which was conducted by John Griffin (Chief Financial Officer)
and Kim Kleiner (Chief of Staff). ‘Ortolano stated that she is not satisfied with the results of the audit, does
not detieve that it was “independent” and does not believe that her concems have been adequately
addressed. Ortilano explained that as a result of the audit, the Chief Assessor position was eliminated and
Kim Kisiner, was placed in charge of the Department as the Administrative Services Director. According to
Orolano,. Kisiner’ ‘has no experience as an assessor and'was simultaneously placed in charge of Purchasing,
IT, GIS. Risk: iianagement and Human Resources, ere inhibiting her ability to monitor the activities of

Onpiana reported specific concerns with regards to Greg Turgiss' s activities. Ortolano‘explained that
according to now former Assessing Department: employee: Cheryl Walley, Turgiss has a history of filing
fraudulent/incetrect ‘mileage reports, has been spoken to,about t those reports:in the past but continues to file
fravdulent/incorrect mileage reports. She had concerns with regards to Turgiss' work activities and whether
he has been and ss misrepresenting what he is doing’ while at:work. ‘She explained she hired a private
investigator to follow Turgiss and that the resultsiofithat investigation were extremely concerning. Ortolano
advised that she discovered a number of abatements that occurred in October:2018 that'she believes may
have been the result of "favoritism". Ortolano had complied, large sours of of documentation supporting her

concems through Right to Know Requests from: thie See, Department.

Ortolano explained that as a result of the.concerns. that ishe has: raised regarding Turgiss’ activities the City
as retained Attomey Mark Broth to conduct an independent investigation into Turgiss’ mileage reports and
work logs. Ortolano advised that she will-be. attempting | to meet-with Aftomey, Broth iniorder to discuss her
concems but believes that the scope of his’ mvestigaiion will be t90 narrowly;focised,
