Ineligible Uses -Local Fiscal Recovery Funds

Pension Fund Deposits
Extraordinary contributions to a pension fund for the purpose of reducing an accrued,
unfunded liability are ineligible. Funds can be used for routing payroll contributions for

employee pensions.

Rainy Day Funds or Financial Reserves
Replenishing rainy day or other reserve funds is not considered a government service

and is therefore ineligible.

General Infrastructure
General infrastructure spending above the amount allocated under the revenue loss
provision is not covered as an eligible use except for water, sewer, and broadband

infrastructure.

Debt Service & Legal Settlements

Paying interest or principal on outstanding debt and expenses related to legal
settlements or judgements do not qualify.

Two Virtual Forums

On September 21°t & 23 7-8PM the Office of Economic Development will host a Virtual
Forum to present the proposed ARPA framework, answer questions, and solicit additional

to present the proposed ARPA framework, answer questions, and solicit additional feedback.

Virtual Business Forums

On September 22"¢ 10 AM the Office of Economic Development will host a Virtual Forum to
present the proposed ARPA framework, answer questions, and solicit additional feedback.
Specifically outreaching and hearing from businesses and their employees. If interested in

Timeline

The goal is to present an updated ARPA framework to the Board of Aldermen at the October
12th meeting and to provide a report to the appropriate subcommittee the ulimtate goal is to
finalize the report and spending by mid-fall.

CERTIFICATE OF SUFFICIENCY
August 26, 2021

To the Mayor and Members of the Board of Aldermen:

On August 24, 2021, the Office of the City Clerk accepted a petition seeking to amend
the City Charter relative to the nomination and the confirmation of appointments to the
Nashua Board of Police Commissioners.

RSA 49-B:5, II provides that a written petition for an amendment to the city charter may
be filed by the number of voters equal to at least 15 percent of the number of ballots cast
in a municipality at the last regular municipal election. Whereas the number of votes cast
at the November 2019 municipal election totaled 10,260 votes, the minimum number of
voters required to petition for a charter amendment is 1,539. Upon review, 1,830 of 2,058
signatures were certified. Since that number exceeds the minimum required for a
petitioned charter amendment question, I find, therefore, that the filing is sufficient to
have the question placed before the voters in an upcoming election.

RSA 49-B:5 requires that “within 10 days of receipt of a report that a petition is
sufficient, the municipal officers shall by order provide for and issue notice of a public
hearing on the proposed amendment. The notice of the hearing shall be published in a
newspaper having general circulation in the municipality at least 7 days prior to the
hearing, and shall contain the text of the proposed amendment and a brief explanation.
The hearing shall be conducted by the municipal officers and no substantive changes may
be made to the amendment.

Within 7 days after the public hearing, the municipal officers shall file with the municipal
clerk a report containing the proposed petitioned amendment and shall order the proposed
amendment to be placed on the ballot at the next regular municipal election. In the case
of municipalities with biennial elections, the municipal officers shall order the
amendments to be placed on the ballot at either the next regular municipal election or at a
special municipal election that occurs not less than 60 days after the date of the order.”

This Certificate of Sufficiency is being provided to the Legislative Offices for the Board
of Aldermen for filing as required under RSA 49-B:5,IV. Time being of the essence, it is
also being provided to the membership via email. The affidavit regarding the creation of
the petitioners’ committee and the petitions submitted to the City Clerk are on file in the
City Clerk’s Office.

RE: Vision for usage of ARPA Funds & Guiding Principles

Iam writing to request a meeting to discuss a draft framework acting asa preliminary plan and to
communicate a vision for how the use of American Recovery Plan Act (“ARPA”) funds will be

developed.

Municipalities across the nation are the beneficiaries of significant influx of federal funds via
the American Rescue Plan Act (“ARPA”). ARPA is intended to address the negative health and
economic impacts caused by the COVID-19 pandemic. Nashua anticipates approximately
$16,000,000 in funds. We received our first of two installment payments of $8,000,000 in May
of this year. We expect the second installment to be distributed next May 2022.

At the September 14, 2021 Board of Aldermen Meeting, the Board will have a 1*' reading
accepting these finds. Over the coming weeks the Office of Economic Development with the
assistance of Financial Services and the Office of the Mayor will undertake a community
outreach effort to discuss an appropriate framework. We'd like to offer residents an opportunity
to provide feedback on the draft framework for spending ARPA funding, which has specific

eligibility requirements.

The goals we want consensus on prior to undertaking this outreach exercise is first, that this
money will have a meaningful and lasting impact on Nashua. Second, it is an imperative that we
be strategic with this infusion of funds and making sure we not only accomplish our statutory
obligation, but also enhance our economic wellbeing. These guiding principles should lead our
decision-making as we move forward.

There will be a presentation providing an overview of how ARPA funding may be spent and a
draft framework for discussion purposes at the Special Board of Aldermen Meeting on

September 8",
