Proposed Purchasing Ordinance Updates

Proposed Change:
Change to add virtual bid openings*

Proposing to allow for virtual bid openings in addition to in person. This will allow for participation from
more vendors, stakeholders and interested parties with less effort than travelling to City Hall for an in
person.

F. The Manager shall not solicit a bid from a contractor who is in default on the payment of taxes,
licenses or other monies due the City.

Proposed Change:
Add the restriction from including vendors who have been debarred from participation in any
State or Federal program

Proposing to add debarment as an exclusion for participating in the City’s bid opportunities to ensure we
are selecting “responsible and responsive” vendors to work with.

Debarment means an action taken by a Federal agency or official to exclude a person or business entity
from participating in transactions involving certain federal funds

A debarment may be based on convictions, civil judgments or the agency’s independent evidence proving
by a preponderance of the evidence that a company or individual were involved in fraudulent conduct on
public contracts, such as, contract and financial assistance fraud, embezzlement, theft, forgery, bribery,
poor performance, non-performance or false statements as weil as other causes.

§ 5-84Speclal purchase procedures.

A. The competitive bidding process shall not apply to the following special purchases:

(4) Sole-source procurements, where the proposed purchase is manufactured by only one company or
where a sole company’s product offers proprietary features or technology necessary for the City’s
requirements.

Proposed Change:
Add the following janguage: “or where a sole company’s product offers proprietary features or

technology necessary for the City’s requirements.”

Proposed change is proposed to include technology based items where there are multiple produced
options but where technology needed preciudes ail but one company/option.

(7) Purchases under extensions of contracts when no price increase exceeds 10% per year.

Proposed Change:
Add: “and where a market change has not reduced pricing in the product category”

Proposed change is proposed te more clearly define to a best business practice

Proposed Purchasing Ordinance Updates

§ 5-91Amendment to contracts.

For any contract previously approved by the Finance Committee, the Mayor shall inform the Finance
Committee within 10 business days of any amendment to the contract terms, scope of work, or sums
payable to the contractor, or if the contract was terminated. No contract may be amended as to its
scope of work or so as to increase sums payable to the contractor, without Finance Committee approval
for amendment amounts exceeding $25,000;

Proposed Change:
Replace paragraph with: For any contract previously approved by the Finance Committee, the
Mayor shall inform the Finance Committee of any substantial amendment to the contract terms
or, change in intent of originally approved scope of work, or if the contract was terminated or
has been delayed by more than one year. No contract may be amended as to its scope of work
or so as to increase sums payable to the contractor, without Finance Committee approval for
amendment amounts exceeding $25,000

Proposed change to eliminate requirement where there is no significant change in scope of work or
terms (termination or delay}. Change orders are within a normal scope of the nature of many of the
projects we contract and to effectively adhere to this requirement would create excessive
communications. We are proposing to continue to request approval from the Finance Committee for
changes that exceed the standard $25K threshold and communicate only significant project changes that
substantially change the project scope or timeline.

§ 5-138Contracts.

A. All contracts and amendments to contracts, regardless of value, in which the City becomes involved
or engaged shall be reviewed by the City Corporation Counsel, all contracts and amendments in excess
of $25,000 shall be reviewed and approved by the Finance Committee prior to award, and

all contracts and amendments in excess of $1,000,000 shall be reviewed and approved by the Finance
Committee and approved by the Board of Aldermen prior to award, except for emergency situations as
defined in §§ 5-90 and 5-91.

B. Ali contracts may be signed on behalf of the City by the Mayor. Contracts under $1,000 may be signed
on behalf of the City by employees in the following positions: [Added 9-24-2019 by Ord. No. O-19-053]
(1) Public Works Division Director. , {2} Community Development Division Director,
(3) Administrative Services Division Director, (4) Financial Services Division Director, (5) Public
Health and Community Services Division Director, (6) Chief of Police, (7) Fire Chief, (8) Library
Director, (9} Economic Development Director, (10) Corporation Counsel, {11} City Clerk,
(12) Emergency Management Director

Proposed Change:
Change threshold from $1,000 to $10,000

Proposing to increase the threshold for contract signing from Sik to $10K. There is no good way to
quontify impact for this change os there is currently no automated contract process and no central log
for contracts.

Dear Aldermen of the City of Nashua, I’m writing to request
your support on resolutions R-21-202 and R-21-203 to
purchase the 15 Bartlett Ave parcel (plot 57-3) which is
encompassed on three sides by Greeley Park. Allowing this
13-acre forest to be cut down so that a 43-unit housing
development can be built would have a permanent and
enduring negative impact on the city for generations to
come.

| do not support the plan to build 40+ houses on the Baker property at 15 Bartlett.

The street and neighborhood would be negatively changed by that development.
Bartlett St is full during weekdays while waiting for school children to leave or return to cars and SUVs.

Please forward this email to the Board of Aldermen. This was initially sent to my alderman, Alderman Klee,
and the Aldermen-At-Large. Thank you.

My name is Steve Barry. My wife Kim and I are raising our two teenage daughters on Wellman Avenue, where
we’ve lived since 2005. My wife and I both grew up in Nashua. After several years in the more urban Boston
area, we decided to move back to the north end. We made this decision, in part, to live near the woods of
Greeley Park.

When my girls were young, we took them to the park often. My girls called Greeley Park “Woo-hoo Park,” due
to the sounds that the mourning doves made when I took them there. The girls love the park. When they were
younger, of course, they’d play on the swings, play soccer, and ride their bikes.

Lately, though, the Park plays a different role in our lives. The peacefulness and solitude of the forest has taken
on much more importance. We often go for walks after school. It is quiet and peaceful. The girls talk about
their days. Sometimes, we’ll see deer, pileated woodpecker, or other wildlife there. We walk on the path
through the woods that abuts the fence bordering the Barker property.

That area is the only safe, wooded area near our house. How precious is that? In a time when we’re looking to
get away from our screens — or even our houses when we’re quarantined — that forest has been an absolute God
send. I run on that path and walk our dog through there several times each week. Sometimes, we’re there every
day.

If the woods of the Barker property are cut down, Greeley Park will cease to be a Park as we know it. Instead,
it will become a road between two neighborhoods.

It will still have swing-sets. But it will not have solitude. It will lose its soul.

I cannot overstate how important the park — and particular, the forest ~ has been in shaping my daughters’ love
of nature. They founded the “Green Teens,” an environmental club at Pennichuck Middle School. And now
my oldest, Taylor, represents Nashua North High School on Nashua’s Energy and Environment

Committee. When asked to draw something important to her while at Pennichuck, Taylor actually drew a
picture of Greeley Park. This picture now hangs downtown by the Adult Learning Center.

If we lose this forest, it would be an unspeakable loss. We’ll lose an oasis of solace in our increasingly
turbulent times, in a city that grows louder by the day. Tomorrow’s generations will lose the chance to connect
with nature. Please act to save this true gem of our city. Greeley park — and how many people truly feel about
this city — won’t be the same if you do not.

1am unable to attend the infrastructure meeting this week to voice my support of the downtown barriers. This program
has been successful for the last two years. As chair of the downtown improvement committee we have discussed the
pros and cons of this program, we have walked the downtown area and looked at areas that could possibly be adjusted
for additional parking on Main Street and side streets. We have discussed how we can improve the barrier program,
looking at time frames for barriers in place, color of barriers, and areas that can do with less outdoor space. These
discussions will continue so that we have a program that works for everyone.

| realize there are a couple of downtown business owners who strongly oppose the barriers, | think it is important to
listen to all, and | personally believe a majority of business owners are in favor of the barriers. Barriers not only provide
additional seating for restaurants they make a major impact on the speed of traffic on Main Street which is a

positive. Yes we need to discuss the program and make it work for all and | hope by voting to continue the program we
can continue to engage this positive program for downtown.
