Holidays as stated in the UAW Clerical, Technical and Professional Contracts

Article 14
Holidays

Employees covered under this agreement shall receive straight time wages and not be required
to work on the following holidays, except as otherwise provided in this article:

New Years

Martin Luther King, Jr. Day
Memorial Day
Independence Day

Labor Day
Veteran's Day

Thanksgiving Day

Christmas

Presidential Election Day [every four years]
Presidents’ Day

In addition to the above days, two (2) holidays shall be determined by the Mayor in January of each
year,

Employees working in the Public Works Division, except for employees in the Engineering and
Administration Departments, shall have the same holidays as those specified in Article ISA of the
collective bargaining agreement between the Board of Public Works of the City of Nashua and
Local 365 of the American Federation of State, County and Municipal Employees, AFL-CIO,
provided that the total number of holidays shall be no less than holidays listed above.

Employees required to work @ holiday shall receive one and one half (1.5) their usual straight
time rate of pay for hours worked. In addition they shall receive holiday pay unless, prior to
submission of the weekly payroll, the employce requests in writing to take the holiday time off on
a scheduled work day satisfactory to management, within three (3) months from the date of the
holiday.

When a holiday occurs during scheduled time off, the holiday shall be paid at straight time and
the employee will not be charged with earned time for that day.

If'a holiday falls on a Saturday and is observed on a Friday, said Friday shall be a paid holiday. If
a holiday falls on a Sunday, and is observed on a Monday, said Monday shall be a paid holiday.

IT'S A BAD LOOK TO ARREST CITIZENS IN CITY HALL

At the June 30, 2021 Board of Assessor’s meeting, Deputy Attorney Leonard made a statement on record regarding
my February 17, 2021 arrest in City Hall.

Ms. Ortolano’s ... It is because she forced her way into the locked legal office, sat in front of my office, and would
not leave until the police came. It had nothing to do with time or date stamping, assessment or abatement
applications. As Ms. Ortolano is well aware, the legal office does not do that.

It was a shameful, unwarranted arrest for Deputy Attorney Leonard, Attorney Bolton, Mayor Donchess and Chief
Carignan to order. The arrest was made 26 days after the police escorted me from the building, determining, at that
time, that the “incident” required no action.

Here is what Deputy Attorney Leonard knew:
- The city website did not say the Legal office was closed or appointments were necessary.
- She was not in the office when I walked into the legal office, fabricating the “forced” entry without being present.

- The Assessing Office policy for processing abatement applications requires the office to provide an immediate
date/time stamp to the property owner as proof of receipt.

: there were no provisions set up by the City to accommodate property owners to comply with city policy and
provide an in-person receipt.

- We were in the midst of a pandemic and the assessing office was closed with construction delays.

- The legal office was responding to questions citizens had about the processing of the abatement applications.
* She made a choice that day to not assist a citizen with a reasonable business request.

- She made the choice to view my trip to the legal office as a matter of trespassing.

- She fabricated my actions as hostile and threatening.

I was welcomed into City Hall, as no appointment was necessary for my requested business, on January 22, 2021 by
the entry person. I had no intention of going to the legal office that day, but when other city offices were closed, I
knew the legal office would have the ability to provide a receipt.

That day in City Hall, I was representing two senior citizens having prepared their property abatement applications.
The City was heavily overtaxing some property owners in a mobile home park. I stayed in the legal office, sat in the
legal hallway in a quiet protest waiting for someone to help me. Rather than just stamping the applications and
sending me on my way, the legal office called the police.

The City Attorney’s, Mayor Donchess and Chief Carignan concocted a story and described my entry into City Hall
equivalent to the insurrectionist that stormed the DC Capitol, slamming me with a felony misdemeanor A and
requesting a year in jail. It was a bogus arrest that should have never happened. It is a bad look when citizens are
arrested in City Hall for attempting to perform routine business. It is time for some leadership changes in this City.

By the way, the two property owners won their abatements and are saving $4,000 over the next two years - a cause
worthy of a peaceful protest.

Rebuttal to Attorney Bolton’s explanation on Court Order

A Telegraph article ran July 28, 2021, regarding the Court order for the City to pay my legal
expenses for disregarding a discovery request to obtain emails from Director Kleiner.

The request made in July 2020 was for specific time and content for emails from a single person.
Kim Kleiner’s emails, relative to assessing, sent from August 9 through September 30, 2019. This
was not an extensive search.

Attorney Bolton offered explanations to the Telegraph that were not part of the City’s objection
to my Attorney’s motion for sanctions. Apparently, given enough time, he’s able to fabricate more
absurd excuses to explain the City’s bad faith.

According to Attorney Bolton, the reasons for disregarding the discovery:
COVID
City Hall Renovations
Employees working remotely
No employees available to conduct searches

COVID is a pandemic political excuse with little relevance to searching for emails. Ms. Kleiner
assured the public that employees were working at 100%. The search required Ms. Kleiner’s time
and an IT Department employee.

Kleiner’s office and the IT Department were not under renovations. Ms. Kleiner’s office was open
to the public throughout the pandemic without an appointment.

This request was a computer driven search, so Ms. Kleiner should have been able to remotely
compile her emails and the IT department had a worker in City Hall.

We paid the IT empioyees full time salaries; someone was available to conduct the search.

He concluded by telling the Telegraph
Ultimately it was discovered that the backup storage system failed and the emails were
lost.
We had over 100 requests we had to deal with.

According to Attorney Bolton’s May 13, 2021 Objection filed with the Court against our request
for sanctions,
“Following the plaintiff's RFPD, the City engaged in a timely search for the requested
emails. Early on in this process it was discovered that emails fram the month of September
2019 were unobtainable due to file corruption.” (emphasis added — RFPD, Request for
Production of Documents)

So, searches were conducted and the City knew early on. From July through December, Attorney
Leonard chose to string us along telling us the emails were being compiled and reviewed.

Attorney Bolton’s statement that they had over 100 requests to deal with is simply unverifiable
because claims submitted Right-to-Know requests are attorney-client privilege material, which
means that they can make up any number they wish.

Attorney Bolton has been very harsh to describe me and some in the Aldermanic Chamber as
“liars”. It would appear Attorney Bolton is fabricating facts and misrepresenting the issues. It is
disturbing that a municipal attorney representing right-to-know challenges in a civil matter can
operate in such an uncivil and hostile manner. Bully tactics. This is an embarrassment to City Hall
and Nashua residents.

Attorney Bolton serves at the pleasure of the Mayor and is paid the highest salary funded by
taxpayers. It’s time for a new Corporation Council.

the purchase approval request:

Item: Installation of 4 flow meters on interceptors within the Wastewater collection
system

Value: Year 1 (12 months) total of $35,200, Year 2 (10 months) total of $26,000 for a
