Good Evening:

| am writing to put forth my opinion regarding the placement of Jersey Barriers on Main Street to
support expanded outdoor dining.

In the spirit of fuil disclosure:

« [donot take advantage of sidewalk dining, but it is something that i support (see below) under
the proper circumstances
e | do go downtown to support other Main Street merchants

Prior to the pandemic, downtown dining appeared to be working just fine, where owners were allowed
to set up tables and chairs on the sidewalk in front of their establishment. If anything, | remember the
City being more restrictive. If | remember correctly, | recall a warm Spring, where downtown
restaurants wanted to put out table and chairs early for St. Patrick's Day. The answer from the City
was NO. Dining was only allowed between certain dates. Let There Be Outdoor Dining! | Nashua,
NH Patch

Now, we seem to be going to the opposite end of the spectrum to accommodate a level of outdoor
dining that | think is not required.

The expanded dining made sense to me when in-door dining was significantly restricted to social
distancing requirements. Businesses would have closed without this accommodation. It was the
neighborly thing to do. But now, those restrictions are no longer there, and it should revert back to
what it was. | also say this because other merchants, who don't serve food and/or drink are being
negatively impacted due to loss of parking on Main Street. How is this fair to them? Other thoughts:

e [am concerned for public safety when both the Fire and Police departments come out so
strongly against this

e |am also not overly impressed with the use of barriers ... even after they were fully decorated
last year. Some looked great, while others looked unsightly ... again: no consistency in how
this was rolled out.

| also don't appreciate the "sneaky way" this all appears to be happening. Even if everything is above
board, it just doesn't seem to be that way, and people are rightfully questioning what is really going
on. What ideas have been presented? Who presented them? etc. etc. etc.

Hello,

We live on Franklin Street, around the comer from Main Street and we support the expanded outdoor dining.
Although, I would love to see something other than Jersey barricades, like flower boxes or wooden barriers, but
if that’s our only option, then bring them back please.

We dine out 2-3 times a week, sometimes just walking down for a cocktail and to sit out on a nice night. More
people dining downtown means more people in shops also and more people engaged in the City.

From what I see, this is an “all or nothing” proposal, but if compromise could be made with movable barriers so
that they aren’t blocking the streets when the restaurant isn’t opened, that might appease some people.

And one more suggestion: when people complain, stating opposition to the expanded dining, ask them how
often they even go downtown. We live here, love living downtown and partake of the expanded dining many
times each week,

Hello,

Iam writing to voice my opinion, as a taxpayer, regarding the barriers on Main Street.
This was great when it was needed. If we no longer need a mask mandate, especially in
our schools, there is no need for expanded outdoor dining. Restaurants need to go back

to regular outdoor dining without being expanded out into the street.

The fact that the police/emt said the barriers added to response time should be enough
for you to remove them now out of concern for the safety of your constituents.

How can you even suggest another three years? Please end this insanity.

Subject: Use of the NH Holocaust Memorial by the Founders
After the City’s Assumption of Ownership

Fred S. and Janice R. Teeboom, founders of the NH Holocaust Memorial, will be allowed use of
the memorial site, after the city’s assumption of ownership pursuant to Resolution R-10-43, for
the following events and objectives:
> Conduct of Yom Ha'shoah and other memorial events associated with the Holocaust.
Conduct tours associated with the purpose of the memorial.

>
> Plant landscaping such as a tree or bush or flowers in commemoration of family members.
>

Access to the site’s electrical service for powering a public address (PA) system during
an event associated with the Holocaust.

» Access to the site’s video surveillance system over the Internet for purpose of remote
monitoring.

ESCALATION

Pricing under this Agreement shall be escalated in accordance with this Section 11.
Contract will be increased annually by 2% to be applied to the operational hour
rate of the Agreement ona cumulative annual basis January 15 of each contractual
year. For current service rate sheet, see Contract Pricing attached as Exhibit D.

FORCE MAJEURE

A Force Majeure Event is an extreme event that is neither reasonably
foreseeable, nor within the control of the parties. For the purposes of this
agreement a force majeure includes, but is not limited to, war, strike, riot,
crime, act of God (hurricane, flood, blizzard, earthquake, volcanic eruption,
etc.}, act of terrorism, and the like, but shal! not include any circumstance
attributable to an act or omission by either party, nor failure to reasonably
plan and prepare for events once they become known, or to reasonably
respond to circumstances after they occur.

Neither party shall be held to have committed an Event of Default in respect
of any obligation under this Agreement if prevented from performing that
obligation, in whole or in part, because of a Force Majeure Event.

If a Force Majeure Event prevents either party from performing any of its
obligations under this Agreement, that party shall:

promptly notify the other party of the Force Majeure Event and its
assessment in good faith of the effect that the event will have on its ability

to perform any of its obligations. {f the immediate notice is not in writing, it
shall be confirmed in writing as soon as reasonably practical;

not be entitled to suspend performance of any of its obligations under this
Agreement to any greater extent or for any longer time than the Force
Majeure Event requires it to do;

use commercially reasonable efforts to mitigate the effects of the Force
Majeure Event, remedy its inability to perform, and resume full performance
of its obligations;

keep the other party continually informed of its efforts;

provide written notice to the other party when it resumes performance of
any obligations affected by the Force Majeure Event.

If a Force Majeure Event causes the damage to the Plant such that
reconstruction of the Plant would take more than one (1) year, in the opinion
of a professional hired by Customer, Customer may terminate this Agreement
upon written notice to MCAT within one hundred and twenty (120) days of
such Force Majeure Event.

To all Aldermen, my name is Chris Thibodeau from ward 6 this is regarding dining on main street.

I like the vibe of the dining on main street and may have been helpful to a point get restaurants some help last
year but it's honestly not practical. It takes up parking that is already hard enough to find. The restaurants have
been allowed sidewalk dining and that already already takes up the side walks, that is more than enough. A
friend informed me that it is having the opposite impact to the non restaurant shop owners. It impacts the flow
of traffic especially during high use times. For my representative the vote should be no.

If the vote is agreed upon there is no reason why it needs to be approved for three consecutive years, it should
be an annual thing that gets looked into.
