The purpose of this is to amend it and schedule a public hearing and re-refer it to the Planning Board
which needs to be done before action can be taken on it.

Alderman Siegel

Will another action be to re-refer it to committee for debate at the Aldermanic level? | didn’t expect to
be debating this now. | didn’t Know it was coming out of committee; | just made the assumption that
we were just going to debate it at that point potentially.

President McCarthy

We can re-refer it the committee as well if you like.

Alderman Siegel

It’s the will of the Board.

President McCarthy

The committee is basically done with it and produced amendments at their last meeting but if you want
to re-refer it to the committee so that they get another look at it after the Planning Board has
commented. It actually is referred to the committee essentially because the public hearing will be
scheduled at the next committee meeting.

Alderman Siegel, just to clarify, it was necessary for the Board to amend it before the public hearing
could be scheduled.

We have heard some comment on this tonight. We had a chance to talk with some of the corporate tenants on
the field only to discover that there are some issues that they have with being located in New Hampshire and
some issues that might cause some of those hangars to be empty over there. A few years ago in 2015, the
NH DOT conducted a study on the economic impact of aviation in the State of New Hampshire and it rightly
said that we have great benefit from aviation in this state and not just for pilots and mechanics but for the
companies that own these things and employ people and pay property taxes. A further review of that report
indicates that although the benefit is great, the number of airplanes based and the operations conducted in the
State of New Hampshire is in decline and if the based aircraft and operations conducted in New Hampshire are
in decline then it stands to reason that great benefit is also in decline. In line with what we heard it looks like
the New Hampshire registration fee structure, which at one time may have been competitive, is today non-
competitive particularly with regard to competing with Hanscom Field in Bedford, MA. We heard that an

aircraft that was $40 million could have a $300,000 first year registration fee in New Hampshire and maybe a
$350.00 registration fee in Massachusetts. Massachusetts has a sales tax but anyone who lives near the
border as we do knows that periodically Massachusetts has sales tax holidays. A number of years ago
Massachusetts declared a permanent sales tax holiday on anything to do with airplanes. If someone were to
buy a $50 million jet they would have a $2.5 million tax bill and that would look a lot worse than a $300,000
registration fee but now that they have voided that sales tax and declared a permanent sales tax holiday in
Massachusetts to compete with us, we are now the high cost competitor with registration fees in the vicinity of
$300,000 for the first year. The registration fee calculation charges fees to all aircraft that are based here and
it's a scale. The scale is dictated largely by what we call millage. Millage is in the first ten years of an aircraft's
life there is a value portion that is charged, that’s why it winds up being $300,000 on an expensive airplane. At
the 11" year that same jet might only be $1,000 to register because it falls off of that first ten year schedule. It
would seem to me that registration fee might have been in lieu of a sales tax, ten years of registration fees to
be still competitive with the sales tax that Massachusetts used to have. Massachusetts has seen growth while
our numbers, as reported to the NH DOT study, are trending down. Again, the value that can come from a
company that bases itself here and happens to rely upon corporate travel to conduct their business could be
great. The property tax associated with it, the jobs associated with it and right now the registration fee is a red
flag, it's a stop sign that says don’t come to New Hampshire. Representative LeBrun put together some
legislation, HB-124, which is going to have a public hearing at the Transportation Committee next week and we
are bringing this now under suspension as an endorsement hopefully for the City of Nashua to support some
kind of registration fee reform and to improve the business climate in New Hampshire and especially in
Nashua. The nearest airport of course is Hanscom and they are getting a lot of our business. We are by the
way, Nashua is the busiest airport in the state and Nashua is trending down. In an effort to have a statement
from the city to present at that committee hearing next week, we brought this in and | would be happy to
answer any questions about it. | am sensitive to the desire for there to be some revenue neutrality to it. The
goal of this legislation is that it is not revenue neutral, the goal is that it is overwhelmingly revenue positive and
that’s what drawing new businesses here could do for the state. There are some fee issues and maybe we
can have the state committee take a look at some of the options for restoring some of that revenue lost in the
short-term.

Alderman Schoneman, do you remember off hand what the total number of aircrafts are registered in the state
is?

Alderman Schoneman
| don’t know but 1,100 sounds familiar to me.
President McCarthy

If | recall correctly, the total revenue from the registration fees statewide is about $850,000?

Alderman Schoneman
Yes, approximately.

President McCarthy

Which works out to about $8,000 per aircraft which means there aren’t very many that are paying $300,000
registering the state, is that correct?

Alderman Schoneman

That is correct. Where Massachusetts may 50 large jets we might have 3 or 4 of the same type. | spoke with
a chief pilot who is based down in Hanscom. He was the chief pilot for EMC which was bought by Dell and

now is a chief pilot for Dell. He says that there are about 275 corporate aircraft based in Hanscom, the ramp is
full and the hangars are full. As soon as someone says they want to build a new hangar he says there are
people lining up dropping money on their desks to say | want to be in your new hangar. Green Mountain
coffee was looking to come to New Hampshire but while they were looking in Portsmouth their accountants
alerted them to the fact that the registration fee would be astronomical and to get that airplane out of New
Hampshire just as quickly as they can. Green Mountain Coffee is now down on Route 3 in Burlington and
wouldn't that have looked nice in Nashua or Portsmouth. It’s about the whole State of New Hampshire.

Alderman Dowd

As the former chair of the Nashua Airport Authority | agree with everything that Alderman Stoneman just said
and the registration fees have been an impediment to bringing aircraft in here for years and | think that
anything we can do to lower the fee will be offset by having more aircraft come into New Hampshire. We are
losing out on a lot of business because of that astronomical registration fee.

Alderman Siegel

| would hope that our representatives that are also Aldermen here would have a bipartisan agreement in the
legislative body for Nashua and this is hopefully not a partisan issue and there is a favorable response from
both sides of the aisle. | will also point out that we don’t have to figure out ways to make up the revenue, the
revenue has already flown away so it isn’t like we have to be revenue neutral. It’s an airplane unlike a fixed
building and it’s typically with those expensive airplanes the come with pilots so you can just sum them from
wherever it is and they are cheaper to have. | strongly urge everyone to support this all through the legislature.

Alderman O’Brien

Fortunately this bill will be appearing before my committee which is the Transportation Committee and as | do
with many things, | make sure | vote for Nashua and this is definitely a bill that would benefit Nashua and | will
urge my colleagues up there to see it as that type of issue, that we are being drained and we have a wonderful
airport that | support and | want to keep it going.

I’m here about the environment again. Massachusetts is worse than New Hampshire. | went to my mother’s
house last week and there was glass everywhere and I’m on fire. I’ve had two tests in November and these
doctors don’t believe in God they believe in science. It’s microscopic like dust. Heidi, the Environmental
Health lady, doesn’t believe me and she thinks | am hallucinating. My mother thinks | am lying. | should be
quarantined like the Ebola people. If everyone dies then it’s on Heidi. | shouldn’t have to get other people sick
to prove | am sick.

REMARKS BY THE MEMBERS OF THE BOARD OF ALDERMEN

| want to thank the fire department and Harbor Homes, the Mayor’s office and anyone involved in the Safe
Stations Program. It’s so well run and | think it’s really working and whatever we can do to support the
program is really incumbent on us, these are our citizens and our neighbors.

Alderman Deane

| would like to send my condolences to the friends and family of Don Mayo who passed away the other day. |
had known him for many years and he was an interesting guy.

Alderman Siegel

I’d like to mention that this Thursday at 7:00 p.m. in the New Searles Elementary School Café | will be hosting
a Ward 9 Informational meeting and all are welcome to attend. | realize that overlaps the Ward 3 meeting that
Mayor Donchess is having. For our legislatures, you probably noticed that there was a 1% report return on our
pension, this is very bad and undoubtedly means that bill to increase the effective expected rate of return to
7.75%, most likely dead on arrival. | would urge our legislatures to please revisit the funding percentage to
introduce legislation, if possible, to make it less than 100% per the discussion that we have had several times.
| just don’t see any real alternatives. We are in a lot of trouble.

The Mayor is having a Ward 3 meeting on Thursday and would like to invite anyone who would like to come.
It’s at the Amherst Street Elementary School at 7:00 p.m.

CLARIFYING AND UPDATING THE ELDERLY HOUSING SUPPLEMENTAL USE

REGULATIONS AND RELATED PROVISIONS

CITY OF NASHUA

In the Year Two Thousand and SeventeenSixtee#

The City of Nashua ordains that Part II "General Legislation Chapter 190 "Land Use", Part 2
"Zoning Districts and Supplemental Use Regulations", Article VI "Supplemental Use
Regulations", Section 190-42 "Elderly housing" of the Nashua Revised Ordinances as amended
be hereby further amended by adding the new underlined language and deleting the struck-
through language-as follows:

"§ 190-42. Eldery-housine, Housing for Older Persons.

Purpose: To recognize that housing for older persons provides for the diverse and special needs
of this group, including the needs for meeting/function rooms and recreational facilities, and
attempt to foster development of housing alternatives for older persons with the basic supportive
facilities and services.

The development of housing for older persons may allow residents the
opportunity to enjoy the rights and privileges of ownership and maintenance of
private property within the City of Nashua.

It is a community goal to promote development of housing for older persons that
provides facilities and service offerings typically demanded by this group, and it
is also a goal to promote proximity of such development to support services
(shopping, medical services, transportation, etc.) necessary to meet the needs of
these residents.

Housing developed in this section must be established and maintained in
compliance with all applicable state and federal laws with respect to such
housing and/ medical care, including the Fair Housing Act, as amended, 42
USC$§ 3601 et seg., NHRSA 354-A: 15-exd-the AA Cede of Adinistrative Rites,
Hh sOlletsege

Pursuant to RSA 354-A:15, I and Ill, it is recognized that prohibitions against
housing discrimination do not apply to housing for older persons, which conforms
to all applicable rules and regulations.

ORDINANCE O-16-xxx

The intent is to foster development of housing for older persons while detailing
local planning standards and promoting consistency with land use policies in the
Master Plan and the land us laws and regulations.

The intent is to regulate the intensity and mix of the different types of dwelling
units required to meet the needs of these citizens so as to provide ample outdoor
and livable space and to retain a sense of personal identity intimacy, and human
scale within the development.

The intent is to review the bulk, height, and spacing of buildings, and the traffic
circulation and parking pattern within the development to ensure that the
adequate light, air, privacy landscaping, and open space for passive and active
recreation are provided with the development.

The City of Nashua finds, determines and declares that:

There is a recognized need within the City for suitable and appropriate housing
for older persons.

Older persons are exclusively people age 35 and older.

According to Demographic Element of the Mas Plan the number and proportion
of persons 55 years or older will increase significantly during the next several
decades, thereby creating an increased demand for elderly housing.

Housing for older persons can be developed to provide housing opportunities for
this group and at the same time not detract from the low-density settlement
patterns defined by significant open space and a rural community character
described in the Master Plan.

It is recognized that exclusive zoning for persons 35 or older promotes the
general health and welfare.

This section implements the following Master Plan recommendation:

Due to the like increase in demand for elderly housing, both for independent
living and managed care facilities, it is recommended that the Zoning Ordinance
be examined and revised, if necessary, to ensure that adequate opportunities to
develop elderly housing are available. This is especially important given the
projected increase in the senior population over the next 10 to 20 years.
