FISCAL NOTE: This ordinance will not result in any increases in costs to the

general fund. As units come on board, any monitoring costs
paid to a 3rd party contractor will be paid for out of the
housing trust fund.

ANALYSIS

This legislation amends the Inclusionary Zoning Supplemental Use Regulations.

State statute (RSA 675:2) and NRO Section 190-132 require a public hearing and referral to the
city planning board. The public hearing is conducted by the aldermanic planning and economic
development committee with notice published in a newspaper of general circulation and posted
in two public places at least ten calendar days prior to the date of the hearing. (Notice period
does not include the day notice is posted or the day of the public hearing. RSA 675:7,1.) A
favorable vote of two-thirds of all the members of the board of aldermen present and voting
would be required if a protest petition is filed pursuant to RSA 675:5. Under RSA 676:12 and
NRO Section 105-3, no building permit may be issued after the legal notice has been posted if
the proposed changes would, if adopted, justify refusal of the permit. This limitation applies for a
period of 120 days.

ORDINANCE

PROHIBITING TRUCKS ON EATON STREET

CITY OF NASHUA

in the Year Two Thousand and Twenty One

The City of Nashua ordains that Part II “General Legislation”, Chapter 320 “Vehicles
and Traffic”, Article VIII “Certain Classes of Traffic on Certain Streets”, Section 320-29 “Truck
traffic prohibited”, subsection A of the Nashua Revised Ordinances, as amended, be hereby
further amended by adding the following new underlined language in the appropriate
alphabetical order:

“§ 320-29. Truck traffic prohibited.

A. Trucks shall be prohibited from certain streets as follows:
Name of Street Location
Eaton Street No trucks shall enter or be operated on Eaton Street

between West Hollis Street and Ledve Street”

All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

This ordinance shall become effective at the time of removal and/or installation of the necessary
sign(s) and/or pavement markings.

ANALYSIS

This legislation prohibits trucks from entering or operating on the entire length of Eaton Street.

Authority for this ordinance is found in NH RSA 47:17 VII (a), which states that city councils
may make ordinances regarding the use of vehicles on particular highways and to exclude
vehicles altogether from certain ways. The erection, removal, and maintenance of traffic devices
and signals shall conform to applicable state statutes and the latest edition of the Manual on
Uniform Traffic Control Devices. NH RSA 47:17 VIII (a). The Board should consult with the
Engineering Department to determine if this ordinance is in compliance.

AUTHORIZING A YIELD SIGN ON MANCHESTER STREET AT ITS
INTERSECTION WITH CONCORD STREET

CITY OF NASHUA

In the Year Two Thousand and Twenty One

The City of Nashua ordains that Part II “General Legislation”, Chapter 320 “Vehicles
and Traffic”, Article [II “Stop and Yield Intersections”, Section 320-5 “Yield intersections”,
subsection C, of the Nashua Revised Ordinances, as amended, be hereby further amended by
adding the following new underlined language in the appropriate alphabetical order:

C. The following shall be yield intersections:

This legislation authorizes a yield sign on Manchester Street at its intersection with Concord
Street.

The erection, removal and maintenance of all traffic control devices must conform to applicable
state statutes and the latest edition of the manual on Uniform Traffic Control Devices. RSA

47:17 VIII (a). The Board should consult with the city’s Traffic Engineer to determine if this
ordinance is in compliance.

ORDINANCE

RELATIVE TO SEASONAL ROAD CLOSURES AND ELIMINATION OF CERTAIN
ON-STREET PARKING FOR USE BY RESTAURANTS FOR OUTDOOR DINING

CITY OF NASHUA

In the Year Two Thousand and Twenty-One

WHEREAS, due to the Novel Coronavirus (COVID-19) pandemic, the Board of
Aldermen approved legislation (O-20-015 and O-21-050) seeking to assist restaurants through
the negative impacts of COVID-19 by accommodating expanded outdoor dining in areas
abutting and directly in line with a restaurant’s property;

WHEREAS, the expanded outdoor dining has proven to be a successful economic
stimulant for the City;

WHEREAS, in addition to the positive economic impact the expanded outdoor dining
has had in the City, COVID-19 continues to negatively affect the health and economy of Nashua
through continued transmissions, illness and new variants such as the Delta variant, and this
negative influence is reasonably expected to last a period of years; and

WHEREAS, this legislation authorizes the temporary seasonal closure, for a period of
months in each of the next three years, of portions of certain roads to vehicular traffic,
elimination of some on-street parking, and relocation and creation of some handicap parking
while recognizing that the situation is dynamic.

NOW, THEREFORE, BE IT. RESOLVED by the Board of Aldermen of the City of
Nashua that the roads and on-street parking as depicted on the attached maps which are
incorporated herein, shall be modified and portions closed, parking spaces eliminated, and
handicap parking spaces relocated and created as shown on the map each year for the following
three years, 2022, 2023 and 2024, from March 15" through November 15".

BE IT FURTHER RESOLVED that upon recommendation of the Director of Public
Works and the Parking Manager, the Mayor may approve additional road closures, elimination
of on-street parking and creation of handicap spaces to accommodate outdoor dining locations.

ORDINANCE O-21-076

This legislation shall take effect upon passage and shall remain in effect until midnight
November 15, 2024. All ordinances or parts of ordinances inconsistent herewith are hereby
suspended while this ordinance is in effect.

The City Clerk is directed not to codify this ordinance in the Nashua Revised Ordinances but to
designate it as Covid-19 Emergency Measure No. (City Clerk to assign appropriate
number upon passage) and publish it and any subsequent emergency measures on the city
website.
