ORDINANCE O-16-021

(4) One Commissioner shall be a representative of the Mayor's office, who
shall be appointed by the Mayor and confirmed by the Board of Aldermen.
The term of the Mayor's representative Commissioner shall be at the
pleasure of the Mayor.

(5) The terms of the Commission-members volunteers who are appointed by
the Commissioners shall be at the pleasure of the Commissioners but shall
last for no longer than the end of the fiscal year in which they are
appointed.

B. Purpose. The Review-and-Comment Commissien-Citizens Advisory Commission
for Community Grants shall consist of an appropriate number of subcommittees
as determined by the Review-and-Comment Commission Citizens Advisory
Commission for Community Grants Chair, but no fewer than three
subcommittees, which shall review the funding requests of local human services
agencies and comment on those requests to the Mayor and Board of Aldermen.
The purpose of each subcommittee is to review an agency's request proposal,
meet with representatives of the agency, vote on a recommended funding level,
suggest conditions to be met by the agency receiving the funds, and report its
findings to the Commission as a whole. The Review-and-Comment Commission
Citizens Advisory Commission for Community Grants will later forward its final
recommendations to the Mayor and Board of Aldermen.

Cc. Procedures.
(1) Prior to December 1 of each budget year, the Chairman of the
Commission shall provide a schedule to the Board of Aldermen. The

schedule shall include at least:

(a) An initial meeting of the Commissioners at which meeting the
Chairman of the Commission shall be elected;

(b) An orientation session for the Commissioners with the Mayor,
Human Affairs Committee, Urban Programs Department, and
volunteers invited to review the City’s consolidated plan;

(c) Posting date of application;

(d) Submission deadline for application; and

(e) Final session of commissioners.

The Commission shall use a City of Nashua Review-and- Comment
Community Grants application and Review-and-Comment Community
Grants commissioner worksheet appreved-bythe Humans ffairs
Committee. If updates to the documents are deemed necessary by the
Commissioners, the Chairman of the Commission shall provide updated
documents to the Aldermanic Committee on Human Affairs prior to use.

Prior to May 15 of each budget year, the Chairman of the Commission
shall provide to the Board of Aldermen:

(a) A schedule, which shall include all meetings held by the
Commission and its subcommittees;

(b) Completed City of Nashua Review-and-Comment Citizens
Advisory Committee for Community Grants applications;

(c) Completed Review-and-Comment Citizens Advisory for
Community Grants commissioner worksheets; the completed
worksheets will include recommendations based on consistent
criteria and factual best practices;

(d) Meeting minutes; the meeting minutes shall include an audio
recording, list of attendees, motions made, and voting results; and

(e) Chairman’s recommended clerical support funding budget for the
subsequent year.

The term of the Chairman of the Commission shall be for one year. The
Chairmas shall not be the Aldermanic Commissioner. A Chairman shall
serve no more than three consecutive terms.

The Aldermanic Commissioner shall be a member of the Aldermanic
Committee on Human Affairs.

The Chairman of the Commission shall assign volunteers to
subcommittees and shall assign applications to subcommittees. The
assignment will be via random selection. The Chairman shall provide
copies of all applications to each volunteer.

At least once per Aldermanic term, the Chairman of the Aldermanic
Committee on Human Affairs shall invite the Review-and Comment
Citizens Advisory Commission for Community Grants Commissioners to
a joint meeting. The meeting will serve as a review of the procedures of
the Commission.

In the Year Two Thousand and Sixteen

The City of Nashua ordains that Part II “General Legislation”, Chapter 320 “Vehicles
and Traffic”, Article XI “Parking Meters”, Section 320-47 “Parking meter and reserved space
fees; permits; meter bags”, subsection A of the Nashua Revised Ordinances, as amended, be
hereby further amended by deleting the struck-through language and adding the new underlined
language as follows:

“§ 320-47. Parking meter and reserved space fees; permits; meter bags.

A. The parking fee forall ...

EXTENDING THE OVERNIGHT ON-STREET PARKING PROGRAM
INDEFINITELY AND ALLOWING RESIDENTS OF ATWOOD COURT, ORANGE
STREET AND WHITNEY STREET TO PURCHASE OVERNIGHT ON-STREET
PARKING PERMITS

In the Year Two Thousand and Sixteen

The City of Nashua ordains that Part II “General Legislation”, Chapter 320 “Vehicles
and Traffic”, Article XIII “Night Parking”, Section 320-78.1 “Overnight on-street parking pilot
program in designated downtown area” of the Nashua Revised Ordinances, as amended, be and

hereby is further amended by deleting the struck-through language and adding the new
underlined language as follows:

“320-78.1. Overnight on-street parking pilet-program in designated downtown
area.

There shall be a pilet-program for on-street overnight parking as described below.

overnight parking for any time period between the hours of 12:00 a.m. and 6:00

a.m. on designated streets without a permit is a violation of § 320-78 and is not
allowed.

Subject: Hills Ferry Road Railroad Crossing

Mayor and Members of the Board:

The Community Development Division has a pending grant application submitted to the Land
and Water conservation fund to improve the Greeley Park boat ramp and parking area) A
portion of Greeley Park which includes the boat ramp and only public access to the Merrimack
River in Nashua is accessed by Hills Ferry Road which crosses the Pan Am Railways track. The
pending grant is conditioned on the City being able to demonstrate that public access is available
to the ramp by way of this railroad crossing. Previous funding made available by NH Fish and
Game to improve the boat ramp was withdrawn because the City could not demonstrate that the
railroad crossing was public. In order to allow for such demonstration the City has brought a
petition before the New Hampshire Department of Transportation seeking a declaration that this
is a public crossing or alternatively to alter its status to a public crossing. One of the issues will
be the extent to which the City will be required to upgrade the existing safety measures (now
consisting of a sign reading “Railroad Crossing”) and maintain them going forward.

Attached please find a proposed settlement of that administrative proceeding which attempts to
limit the City’s current and future responsibility for such upgraded safety measures albeit still
potentially requiring future upgrades under certain circumstances.

I respectfully request your authorization of the proposed settlement.

City of Nashua v. Pan Am Railways, Inc.
Docket # 2016-07

ORDER

By agreement of the parties the Commissioner orders as follows:

1. The grade crossing located at Hills Ferry Road is Nashua, New Hampshire is determined
to be a public crossing.

2. No safety or other upgrades to the crossing are necessary at this time.

3. It is anticipated by the parties that if passenger rail is ever instituted over this rail line,
any needed upgrade to the Hills Ferry Road crossing will be handled and expenses borne
in the same manner as upgrades to the rail line and to other crossings. Otherwise, if
upgrades became necessary in the future due to increased rail, automotive, or pedestrian
traffic or due to changes in the nature of such traffic, and the expense of such upgrades
are not to be borne by whatever third parties contributed to such need, then Nashua shall
be responsible for the provision of such upgrades and Pan Am shall be responsible for the
costs of maintenance of such upgrades thereafter.
