Re: Proposed clarification to Land Use Code related to Driveways

The Community Development Division in partnership with Public Works and the Fire Marshall are
in support of amending the Land Use Code as it pertains to the regulation of driveways within the
City to clarify how dimension standards are measured and to align the land use code with Public
Works driveway permit standards.

Since the land use code was updated in 2004 the City evolved its driveway requirements to align
with best practices and comply with ADA. The proposed updates are to codify these best practices
and ensure compliance with ADA laws.

Re: Proposed clarification to Land Use Code 190-40 Conservation Subdivision

Within the City’s Land Use Code, under NRO 190, Article VI Supplemental Use Regulations, the
City adopted 190-40 Conservation Subdivisions as an “option [which] provides flexibility in site
design in order to allow developers to preserve common open space and natural resources.” The
code then goes on to detail the specific purposes of the section and how it implements the 2002
Master Plan, focused on protection of natural resources, reduction of infrastructure and flexibility of
design.

The design standards allow for flexibility of lot size, frontage and width to cluster development in a
smaller area in exchange for preserving the most open space and reducing infrastructure. However,
this section relies on the underlying zoning district to define the allowed uses and density (See 190-
AQ (C) 2) defined in Table 16-3. For example, a traditional subdivision of a 10 acre parcel in the R-
9 zoning district would allow a maximum of 40 new lots and require each new lot be at least 9,000
SF, spreading development out over the whole original 10 acre parcel. The same land under a
Conservation Subdivision would also be allowed a maximum of 40 units but would require much
smaller lot sizes to preserve more of the land in open space. The image below is an example from

In further reviewing the purpose statement of § 190-40, the ordinance is intended to provide
flexibility in dwelling unit form, ownership, and design, whilst providing development density
incentives that balance themselves with the protection of natural resources that underpin the

ordinance’s intent. This principle of flexibility directly conflicts with §190-17 (B) that states “Only
one principal structure shall be permitted on a lot, except where otherwise provided by this
chapter.” With this requirement, two identical applications for development under the Conservation
Subdivision, with one creating separate lots and one proposed asa condominium would not be
treated equally. The condominium development would not be allowed or would need to go to the
Zoning Board of Adjustment for a variance, and if granted, then to the Planning Board for
subdivision approval. In contrast, the same development with individual lots could proceed directly
to Planning Board for approval.

The proposed clarification to this section of the land use code is therefore to explictly allow for the
design and fundamental principles of a conservation subdivision to be applied equally if the
proposed development will produce individual lots for each housing unit OR if the project will be
developed as acondominium form of ownership with units being owned individually upon
commonly owned land, as we believe it was intended.

The proposed change will create equal processes while still appropriately protecting the intent of the

Conservation Subdivision ordinance to regulate the design of a development in order to preserve
open space and minimize infrastructure.

In the Year Two Thousand and Twenty

The City of Nashua ordains that Part II “General Legislation”, Chapter 320 “Vehicles
and Traffic”, Article III “Stop and Yield Intersections”, Section 320-4 “Stop intersections”,
subsection D of the Nashua Revised Ordinances, as amended, be hereby further amended by
adding the following new underlined language in the appropriate alphabetical order:

“§ 320-4. Stop intersections.

1D: The following intersections are hereby designated as stop or through streets, and
authority is hereby granted for the erection of a stop sign at the corner so
designated in accordance with the tenor of this chapter:

RESOLVED by the Board of Aldermen of the City of Nashua that the City of Nashua and
the Division of Public Health and Community Services are authorized to accept and appropriate
$100,000 from the State of New Hampshire Department of Health and Human Services into
Public Health and Community Services grant activity “FEMA Vaccination Response Grant” for
the purpose of supporting COVID-19 vaccination clinic activities. This funding shall be in effect

Budget Review Committee

The cost analysis is as follows: if the employee makes less than
their Police Department pay through the military, these sidebars
authorize the Police Department to make up the difference. For an
example using a Senior Patrolman, the Police Department would
pay 44% and the savings in the budget would be 56%. If there
were to be any backfill, the City wouldn’t have much cost because
of the 56% payroll savings. Additionally, being at full
complement for the coming year will enable the Police Department
to better operate without having to backfill every shift for this
military individual.

ANALYSIS

This resolution approves the cost items of sidebar agreements between the Nashua Police
Comrnission and the Nashua Police Patrolman’s Association and the Nashua Police Commission
and the Nashua Police Supervisor’s Association concerning military leaves of absence, effective
February 1, 2021. The board of aldermen must vote whether or not to approve the cost items of
these sidebars within thirty days of receipt. RSA 273-A:3 II (c).
