Leave Periods: Employees with one (1) or more years of continuous service may be granted a
leave up to one year. An employee with less than one year may be granted a leave up to thirty
(30) days.

Health, Dental & Life Insurances: The City will continue to pay its share of health and dental
insurances for an employee who is on an approved leave of absence. The City will continue to pay
its share of health and dental insurances up to six (6) months for an employee who is on an
approved unpaid leave of absence.

FAMILY MEDICAL LEAVE ACT (FMLA):

An employee, who is employed for at least twelve (12) months or has worked at least 1,250 hours during
the prior twelve (12) month period, is eligible to take up to twelve (12) weeks leave of absence over a twelve
(12) month period of time. FMLA leave is granted for the serious illness of the employee, spouse, the care
of a minor child, the placement of a foster/adoptive child, the birth of a child, personal illness or the care of
a parent, child or disabled child, who has a serious health condition. (Cite the General Order in the
Department's Rules & Regulations Manual for additional language.)

Length of Unpaid Leave: Unless otherwise designated by law, if the Department's operations are
affected due to the length of an unpaid leave of absence for personal illness and a medical authority
cannot determine when the employee is able to work, it shall be the Chiefs of Police discretion to
hire a temporary or regular replacement.

Recovery: If an employee is able to recover from the disability during the limitation period of the
long-term disability benefit and the Commission is satisfied with the recovery, he/she will have
preference over applicants outside the City to apply for any position within the City that he/she is
qualified for.

Termination: If the employee cannot recover during the limitation period as described above, the
employee shall be terminated.

ARTICLE 20: PERSONAL DAYS

GENERAL POLICIES:

A.

For the purpose of this Article the words "personal day" means a normal workday, when an
employee is excused from active duty for personal reasons.

The receipt and use of personal days will be on a calendar year basis.

Employees on payroll effective January 1* or hired before July 1°! are entitled to three (3) personal

days per year (not deducted from accrued sick leave). In addition, employees are entitled to two

(2) additional personal days; however, said days shall be deducted from the employee’s accrued

sick leave. If there is no accrued sick time available, the employee may elect to take an accrued
vacation day. If there is no accrued vacation time available, the employee is not eligible for a
personal day.

D. In the first year of employment, employees hired after July 1° are entitled to two (2) personal days
(not deducted from sick) and one (1) personal day (deducted from sick) and those hired on between
October 1° and December 31*' are entitled to one (1) personal day (not deducted from sick).

E. Personal days cannot be carried over from one calendar year to another.

APPROVAL OF PERSONAL LEAVE:

Personal Leave must be approved by your supervisor not more than fifteen (15) days, nor less than five (5)
days prior, to the date of such personal day, except in an emergency. A supervisor may waive the notice
period for requesting personal leave. lf approved, the appropriate form will be completed by the supervisor
or employee. The form will be forwarded to the Department's Financial Services Division. Except in cases
of emergency, the form will be approved/disapproved (pending the availability of personal days), and the
employee will be notified by the Bureau Commander or designee of its approval or disapproval.

PROVISIONS:

A. A personal day's approval is subject to potential workloads, manpower requirements, and any
possibility of an emergency situation as determined by the Chief of Police or designee.

B. Once a personal day is approved and the date is to be changed or canceled by the employee, the
employee must reapply.

C. The approved personal day is subject to recall by the Chief or designee due to potential workloads,
manpower requirements, and any emergencies that may arise.

D. Personal days shall not be taken more than two at a time unless approved by the Chief of Police

or designee.
DISPUTES:

Disputes concerning personal days shall follow the Grievance Procedure through STEP 3, at which point,
the decision shall be final and binding upon the parties.

ARTICLE 21; EMERGENCY LEAVE & PERSONAL TIME

C. Deduction from Sick Leave: Said time is deducted from the employee's accumulated sick leave.

D. When Sick Leave is Not Available: If no sick teave is available, the employee is not eligible to
receive an emergency leave day, unless the employee opts to take an available accrued vacation
day.

E. Part-Time Employees: Only upon the discretion of the Chief of Police (or a Deputy Chief in the
Chief's absence) will a part-time employee be allowed to take a day off for emergency !eave without
pay.

APPROVAL OF LEAVE:

With prior approval and at the discretion of the Chief of Police or his designee, Emergency Leave may be
granted to employees. The appropriate form will be completed by the supervisor or employee. The form
will be forwarded to the Financial Services Division for deduction purposes.

EXTENSIONS OF EMERGENCY LEAVE:

An employee may be granted an extension beyond 8-hours of emergency leave up to two (2) weeks at the
sole discretion of the Chief of Police. Any requests for extensions shall be in writing on the appropriate
form and shall set forth in detail the reasons therefor.

DISPUTES:

Disputes concerning emergency leave shall not be subject to the Grievance Procedure.

PERSONAL TIME

DEFINITION:

‘Personal time’ is defined as a special situation that arises that is not considered as any ather type of leave
contained within this bargaining agreement such as a Personal Day, Family Medical Leave, etc.

FULL-TIME NON-EXEMPT EMPLOYEES:

At any one time the minimum time allowed will be (30) minutes, and the maximum time allowed is two (2)
hours. Such time shall not exceed (16) hours in any calendar year, and shall be deducted from the
employee's accumulated sick leave. If no sick leave is available, the employee is not eligible to receive
Personal Time.

REGULAR PART-TIME EMPLOYEES:

At any one time the minimum time allowed will be thirty (30) minutes, and the maximum time allowed is two
(2) hours. Such time shall not exceed four (4) hours in a calendar year and shall be deducted from the
employee’s accumulated sick leave. !f no sick leave is available, the employee is not eligible to receive
Personal Time.

REQUESTING PERSONAL TIME:

In writing on the appropriate Department form, employees will be allowed to formally request Personal Time
off during their workday. On the form, the employee is required to specify the reason(s) for the Personal
Time.

I’d like to speak to that. Thank you. This has been a long time coming for this bargaining unit and for
these hard working men and women of our City. In 2015 the School Board decided that it would be a
good idea to investigate privatization of the custodians and that proved to be an ineffective strategy that
the City was very much against. It would have been actually more costly to us in the long run. Then
after that decision was made to keep the custodians, they have been fighting to get a contract since
then. So this has been going on since 2015. It is what | consider to be a sad chapter in the City’s history
but one that hopefully tonight, with your support, we can move beyond and not go down this road again.

We have hard working people in our schools and the custodians are exactly that. They are custodians
of our school; they are the ones that get there early in the morning, leave late at night. They are the
ones that know where every leak is when it first develops and they are the ones that tell us what we
need to fix, when it needs to be fixed. They take care of our schools. So | am proud to support this; |
think that from a cost perspective, it is one of the more modest contracts that have come before us. |
think it is fair and | would urge everyone to support it. Thank you.

This Legislation allows the Police Department to make viable use of the bikes that they collect as stated
in the Ordinance or the Resolution. There’s a little complication, there was a change in State Law that
allowed us to do this so that portion can be explained by Corporation Counsel. But it is something that
we are allowed to do and it will benefit the people that end up having the bike donated to them. | think it
is the proper action to pass it.

MOTION BY ALDERMAN DOWD FOR FINAL PASSAGE OF R-19-184 BY ROLL CALL
ON THE QUESTION
Alderman Jette

| understand what the Mayor has presented to us, | understand the reasons for it. | am in favor of doing
this. But when | look at the Resolution, | just want to make sure, perhaps through you we could ask
Corporate Counsel, to reassure me that we are doing what we think we are doing here. The Resolution
says that whereas the State has provided some extra money and whereas in 174, which we adopted a
couple of months, that we directed that $4.5 million of the unassigned General Fund Balance be applied
to reduce the tax rate. Whereas now it would be prudent to lower the taxes and will result in lower taxes
for $6.2 million to be applied to reduce the tax rate. This $6.2 consisting of the $4.7 extra money that we
are getting from the State and now $1.5 million of unassigned fund balance. Then it says now therefore
and this is what we are doing, therefore it is resolved that 174 is rescinded and $1.5 million of the
unassigned fund balance be applied to reduce the calendar year tax rate. It doesn’t say we are going to
apply the $6.2 million; it says we are going to apply $1.5. So am | missing something Counsel?

Steven Bolton, Corporation Counsel

The DRA will recognize that as other revenue. The tax rate is always set by the DRA with a fairly simple
formula. They look at our budget, our share of the county’s budget and then they subtract from that
revenue we get from other sources. So what we have predicted for the auto registration revenue and
building permit fees and all the other various licensing fees and so forth. And money that we receive
from the State, subtract that, they get the number that has to be raised by taxes, they divide that by the
total amount of taxable property we have in the City and come out with a rate per thousand which we
know is the tax rate. The idea being that if we get that much collected in taxes, that along with all the
other revenue will equal the amount that we have budgeted plus our share of the county budget. So we
don’t have to tell them to deduct the $4.7 million, they will automatically do that.

Essentially what we are doing here is saying, Ok, the amount of other surplus money, when we were
going to make it $4.5, we don’t have to, because we have $4.7 coming in. We are going to make it $1.5
together with the $4.7 bring it up to around $6.2, but that also essentially saves us that other $2.9 or $3
million and as the Mayor was saying, you can then make a rational determination in ample time as to
how to allocate those funds. So this will accomplish that objective.

Yeah so | support this, | know there are a lot of people in our City who will be looking forward to a lower
tax rate. My question is if this aid is only a one time deal and it is not going to come next year, are we
going to be artificially reducing the rate. And if anyone here who is a State Rep can speak to whether or
not we think we will get this next year?

This is actually a 2-year program so we will see the money next year. | mean we were without the aid
going to apply $4.5 million dollars to the tax rate; now it is $6.2. So to that extent $1.7 we are using this
additional aid to help reduce the tax rate. So we could do that again next year; if the aid is not available
the following year, then there would be that $1.7 million dollar issue that we would have to potentially
cover.

REMARKS BY THE MEMBERS OF THE BOARD OF ALDERMEN
Alderwoman Melizzi-Golja

Yes thank you. | would just like to congratulate everyone who participated as artists and those who did the
planning and attended the Art Walk this weekend. We certainly lucked out with the weather and the storm
rolling through in the middle of the week. And as | walked around on Sunday | had many positive
comments from the artists as well as from those who were participating. So thank you to everyone who
made that happen because you make it happen, not only for the people who attend, but for the artists. And
many of them express how much they enjoyed being here, especially some of them who were first-time
participants and look forward to coming back. So thank you for everyone’s efforts.

Alderman Clemons
So after | said | didn’t want to speak | looked at my calendar and | realized this is the last Full Board

Meeting before the election. So | just wanted to remind people to go out and vote in the City Election which
will be on November 5". The polls will be open from 6:00 AM to 8:00 PM.

And | had made a note before, | would like to confirm this with the City Clerk. Is this Friday the last
opportunity people have to switch their party prior to the primary?

The City Clerk’s Office will be open from 7:00 to 7:30 for party affiliation changes prior to the Presidential
Primary.

Alderwoman Melizzi-Golja

Right. So you can do whatever you want to do but it has to be done by this Friday and you are open in the
evening for that?

Correct, from 7:00 to 7:30.

Alderman Lopez

| do intend to be founding the Pizza Party. | would like to wish Alderman Kelly a Happy Birthday. | would
also like to echo Mary Ann Melizzi-Golja’s comments about Art Walk. | would like to wish congratulations to
Manny Ramirez and Cecilia Ulibarri, anybody who happened to be out at Art Walk and maybe saw a giant
crowd gathering on the bridge; that was because the two founders of Positive Street art have reached a
new level of development | guess. Manny did propose and it sounds like Cecilia is going to through with it,
so congratulations to both of them.

And then finally | wanted to just let the public know, particularly Ward 4, that oversized trash pick-up expires
this Friday. So you have to call DPW, for example, if you are putting your couch on the sidewalk, you have
to call to have them remove that, otherwise it will be there all winter. So keep that in mind, please.

Alderman Klee

| would like to echo what Alderman Clemons said about the election on November 5". In addition to
electing City Officials there will be 2 questions on the back of the ballot. So even if you feel that there’s no
contention, meaning that there aren’t people running, which there are, and you feel your vote doesn’t count,
you do have two questions to answers and they are very important. | think people should come out and
voice their opinion on both the Sports Betting and the Election of Officials in the mid-section. So | think that
it’s important that we all get out there and vote. Thank you.
