AUTHORIZING THE MAYOR AND CITY TREASURER TO ISSUE BONDS NOT TO
EXCEED THE AMOUNT OF FIFTEEN MILLION FIVE HUNDRED THOUSAND
DOLLARS ($15,500,000) FOR THE PERFORMING ARTS CENTER

CITY OF NASHUA

In the Year Two Thousand and Seventeen

RESOLVED by the Board of Aldermen of the City of Nashua that the Mayor of the City
of Nashua and the City Treasurer of the City of Nashua are hereby authorized to issue and sell
general obligation bonds of the City in an aggregate principal not to exceed fifteen million five
hundred thousand dollars ($15,500,000). The proceeds of said bonds shall be used for the
Performing Arts Center. The useful life of the project is 30 years.

PURPOSE WORK DESCRIPTION AGGREGATE USEFUL

NOT TO EXCEED

Purchase, renovate, Purchase of an existing Fifteen million five Thirty (30)

and constructa new | building and the construction | hundred thousand years

performing arts of both floors to include all dollars ($15,500,000)

center hard, soft and incidental

costs.

Pursuant to Nashua City Charter §54-a, this resolution requires a “duly advertised public
hearing.” Also see N.H. RSA 33:9, which requires a 2/3 vote for passage of this resolution.

The bonds shall be general obligations of the City of Nashua, payable as to principal and
interest from ad valorem taxes, which will be levied without limitation as to rate or amount on all
taxable property within the territorial limits of the City of Nashua.

The bonds shall bear the manual or facsimile signature of the City Treasurer and the
Mayor. In accordance with Chapter 91 of the New Hampshire Acts of 2005, bonds issued
pursuant to this resolution shall not require an authenticating certificate of a bank or trust
company doing business in the State of New Hampshire or The Commonwealth of
Massachusetts, or the Commissioner of Revenue Administration.

The bonds are to be issued in fully-registered form by means of a book-entry system or
otherwise and shall have such terms and conditions and be in such form, subject to the provisions
of this resolution and applicable law, as shall be determined by the Mayor and the City
Treasurer.

No borrowing for the renovation or construction of a new performing arts center, except
for costs related to acquiring and securing (for safety and security purposes) the property
anticipated to be used as a new performing arts center, shall occur until such time as the Mayor
has determined that private funds totaling at least four million dollars ($4,000,000), to be used
towards a portion of the operating costs of such new performing arts center, have been raised.

RESOLVED FURTHER, that the Mayor is authorized to enter into the required
contracts therefor as well as any amendments to be made thereto or any other documentation
necessary for the receipt of said funds.

RESOLUTION

ESTABLISHING A PERFORMING ARTS CENTER STEERING COMMITTEE

CITY OF NASHUA

In the Year Two Thousand and Seventeen
RESOLVED by the Board of Aldermen of the City of Nashua that

WHEREAS, the City recently concluded a feasibility study for a Performing Arts Center;

WHEREAS, the study recommended the preferred site be located at 201 Main Street (known as
the former location of “Alec Shoes");

WHEREAS, the City strongly supports increased economic development to provide additional
jobs for residents of Nashua and the region, to expand business within the City’s downtown, and
to develop a healthy robust downtown economy, which will create a stronger tax base;

WHEREAS, the creation of a Performing Arts Center is a proven strategy leading to a stronger
and healthier downtown economy; and

WHEREAS, one of the critical next steps is to formulate a steering committee to help guide the
next phases of a Performing Arts Center;

NOW THEREFORE, BE IT RESOLVED by the Board of Alderman of the City of Nashua
that a Performing Arts Center Steering Committee be established as follows:

(a) The committee shall be responsible for making recommendations to the mayor
and the board of aldermen for the physical design planning and construction of a
Performing Arts Center located at 201 Main Street. Furthermore the committee shall
develop an operational and strategic plan for the Performing Arts Center.

(b) The committee shall consist of eleven (11) members. One (1) member shall be the
mayor or his or her designee. One (1) member shall be a representative from the Greater
Nashua Chamber of Commerce who shall be appointed by the Chamber’s
President/CEO. Three (3) members shall be representatives of the Nashua Arts
Commission who shall be appointed by vote of a majority of the Arts Commission.

RESOLUTION R-17-122

Three (3) members shall be representatives of the Downtown Improvement Committee
who shall be appointed by a vote of a majority of the Committee. Three (3) members
shall be from the Board of Aldermen, whose term shall be concurrent with the alderman's
term of office, and who shall be appointed by the president of the board of aldermen.

(c) The appointed members shall serve at the pleasure of the appointing authority and
until the committee has executed its charge as articulated in the aforementioned recitals
and in paragraph (“a”). Upon completion of its duties, the committee shall disband. The
committee shall elect a chairperson by majority vote and adopt by-laws as necessary to
regulate its affairs.

RE: Warrant to be Committed to Chief of Police for Unlicensed Dogs

Pursuant to RSA 466:14, | am requesting the Board of Aldermen commit the warrant to the
Chief of Police so that either he or his designee will issue the Notice of Civil Forfeiture to those
dog owners who have failed to renew or license their dog(s) as required under RSA 466°1.
Those owners identified on the warrant are required to license their dog(s) and pay a $25 civil
forfeiture fee per dog and a $7 cost of service fee within 15 calendar days of the notice.

In March of this year we forwarded 11,105 notices (4,807 by email and 6,298 by mail) to dog
owners to license their dog. On May.15™ we mailed reminder postcards to 3,508 owners of
which 4,405 dogs remained unlicensed. Starting on June 15" we started placing reminder
phone calls to 1,947 owners of which 2,442 dogs still remained unlicensed, in order to provide
every opportunity possible to avoid appearing on the warrant and incurring additional
forfeiture fees and fines. According to our records, there are currently 1,599 owners of which

1,994 dogs that remain unlicensed.

In accordance with NRO 5-136, Lam providing you with our estimate of overlay needed for
FY18 ($2.0 million) and am.also providing you with the amount we have left in the overlay for
FY17 ($1.7 million) and the overlay reserve Gls 5 million). See the attached “Surplus Use and
Overlay Notification.”

Also in accordance with NRO. 5- 135(8), Tam poviding: the Board with an estimate of
unassigned fund balance as well as how much of that balance I propose to use to reduce the
anticipated tax rate. The unassigned 1 fund balance i is projected to be $37,121,501. Iam
recommending that we use $7, 100, 000 of the pana fund balance against the tax rate.

NRO 5-135(A) outlines a Solicy that a minimum. 10% of. a fiscal year’ S appropriations be
maintained in undesignated general fund balance. As you can see in ‘the “Surplus Use and
Overlay Notification’ ’ worksheet, ‘the estimated maior | fand balance i is projected to be 11.6%
of the FY2018 fiscal year appropriations.

I will be submitting the resolution for your first meeting i in ‘Soptember to coincide with this letter.

RE: Household Hazardous Waste Collection Program Support

Dear Alderman,

| am writing on you this letter of support of the Household Hazardous Waste Collection Program
(HHWCP). The regional program provides a valuable service to the City of Nashua and greatly
reduces the amount of household hazardous waste that could otherwise be improperly disposed
of. Improper disposal of household hazardous materials can result in a multitude of negative
events including; hazardous materials incidents, hazardous materials contamination of people,
property, or the environment. Just last year the HHWCP collected just under 100,000 pounds of
waste from just over 1700 households (HHWCP 2016 stats).

As the coordinator of the City of Nashua Hazardous Materials Team | am in regular contact with
the HHWCP managers prior their collection events held at the Department of public works.
While most hazardous waste collected at these events has been routine, we have had instances of
more serious chemicals have been brought by residents for disposal. Especially in these
instances, | am most thankful for this program where these materials are being placed in the
custody of a HHWCP contractor who is a properly trained professional to handle these (and all
other waste) items.

If it were not for the HHWCP program, I am certain these materials would be improperly
disposed of, or remain in improper environments where negative occurrences are more likely to
happen. Residents need a methodology to properly dispose of household hazardous waste. The
HHWCP is the only program of this type that meets this community need.

Nashua Fire Rescue supports the HHWCP and we hope the Board of Alderman will consider
doing so as well.
