RE: Main Street Jersey Barriers

Dear Members of the Board of Alderman:

My name is Robert M. Shepard and ] am the Manager of Factory Street Associates, LLC,
which owns the office building at 47 Factory Street in Nashua. This office building houses our
law firm, Smith-Weiss Shepard Kanakis & Spony, P.C. This letter is to express my personal
opinion pertaining to the removal of the jersey barriers on our downtown streets. In my opinion,
I believe that downtown Nashua would benefit from the permanent removal of the jersey barriers
on Main Street and adjoining streets. I believe installing the jersey barriers served a purpose for
a limited period of time and this purposes no longer exists. The problem that we experienced in
our office with the jersey barriers was the difficulty that our clients had in arriving at our office
and the difficulty that we had in attempting to navigate Main Street. The jersey barriers created a
complete bottleneck in traffic on Main Street and what would normally be a five (5) minute trip
tured into a fifteen (15) or twenty (20) minute negative experience. I am also concerned about
the impact of the jersey barriers on businesses located on Main Street that are not restaurant
businesses. I have been at my present location since 1983 and J have seen many businesses
come and go on Main Street. I think we need to make an effort to encourage businesses to stay
on Main Street and to make it easy for customers to patronize the various Main Street businesses.

To whom it may concern - Below is the letter | previously submitted in December 2021
regarding parking restrictions on Main Street. In addition to the items | outlined below, |
would like to express my concern over the removal of parking kiosks and the
requirement to use a parking app in order to park on this part of Main Street. My
customers who do not want to add the parking app, or have no idea how to add an app, or
don't have a smart phone, have to cross the street and walk half a block to to get to a
kiosk. | have had people turn around and leave (1 know because they come in and ask
what to do and when | explain their options they turn around and leave), or run in quickly
instead of shopping because they don't want to get a ticket. It is particularly a problem for
older people and for the disabled. This is keeping people away from downtown. No one
parks in front of my gallery anymore. This is very concerning for my business.

Dear Board Members,

It has come to my attention that the city is discussing continuing to close roads and eliminate on-
street parking during certain months for a 3 year period ending Nov 2024.

| am the owner of the League of NH Craftsmen Nashua Fine Craft Gallery located at 98 Main
Street. We have been in this location for over 11 years. We sell fine craft created by 250 local artists
and draw shoppers and diners to downtown Nashua from across southern NH and northern MA.

When in-door dining was restricted in the summer of 2019 | was happy to see the accommodations
made by the city to expand the existing out door dining. | look out my front door to the outdoor dining
area for Casa Vieja and there were many people out there much of the time. The atmosphere was
festive and people were just happy to be out.

With indoor dining restrictions eliminated this year, that was NOT the case. !t was RARE that there
were more people dining out doors than could have been accommodated with the tables set up on
the sidewalk. Most of the tables were EMPTY. Rather then being festive, it was kind of gloomy. | do
not believe believe the downtown restaurants need this accommodation any longer. Outdoor dining
can still be available, but should be limited to the sidewalk area as it was prior to summer 2019.

Many shoppers have been avoiding downtown. | know this because they tell us that is the case when
they finally do come in. How many purchases did they make at the mall or online while they were
avoiding downtown? Some people will call us and have us ship to them, and they live in

Nashua! Were they to come in and browse they might buy more than the one thing they had us ship
to them, and they might visit more downtown businesses while they were here. It is not just the
parking. Traffic gets snarled more easily and the barriers with all the discordant colors and designs
are distracting to drivers. | think it would be important to take into consideration the affects on all
downtown businesses, not just the restaurants.

i am in favor of keeping Mainstreet with 2 lanes going north and two lanes going south with store front
parking restored permanently. Outdoor dining can be accommodated on the sidewalk in front of the

restaurants.

Dear Board of Aldermen

I am writing to reinforce my comments about the barriers last summer. I agree with all of the comments that I
have seen that at the start of the pandemic they were an important and effective way to help our restaurant
businesses survive.

Last summer was a different story. The loss of parking spaces and the traffic congestion was terrible, not to
mention the possibility of critical vehicles like an ambulance or a fire truck getting stuck in the congestion.

I think most restaurants, The Flight Center included, have not seen the need for that expanded dining now that
inside dining is mostly back to normal. They don't have the business and don't have the staff to service that
many tables. Seth at The Flight Center has told me that the extra parking on our block is much more important
to his business than a few extra tables that he does not have the staff to service.

As for our business, Alphagraphics, our customers complain daily about the lack of parking. At Alphagraphics
we also take deliveries from UPS, our paper merchants and other suppliers multiple times each day. And as a
fairly good sized printing company we load up large shipments in front of our business for delivery to our
customers in the area. The barriers have made all of that activity very difficult if not impossible.

I have attached two pages of signatures from our staff and our customers on the petition for permanent removal
of the barriers.

I am hoping the board and city leaders will consider all voices in this matter.

» Developing engineering drawings that compare the existing landfill topography (as
provided to us in a recent topographic survey) to the currently permitted final landfill
grades;

s» Estimating the remaining disposal capacity (airspace) in terms of cubic yards; and

» Calculating the remaining life of the permitted landfill based on the remaining capacity
and the City’s projected waste acceptance rate.

To accomplish the above, Sanborn Head assumes that the City will provide AutoCAD
formatted drawings of the site topography, as well as recent waste receipts. Sanborn Head
will transmit the results of our evaluation in a letter addressed to the City.

Task4 Annual Financial Assurance Update

The NHDES Rules require landfill owners to submit financial assurance updates to NHDES
every third calendar year in order to demonstrate that financial assurance for closure and
long-term monitoring and maintenance (LTMM) is provided for the Four Hills Landfill
(Env-Sw 1400). During the years in which a submittal to NHDES is not required, an
updated closure cost estimate is required to be prepared and kept for the facility’s records.
Since the City last submitted an update to NHDES in March 2021, the next submittal to
NHDES will be required in March 2024. Updates prepared during FY 2023 and 2025
should be kept for the facility’s records.

This financial assurance demonstration includes preparation of opinions of closure and
post-closure cost for the currently permitted areas (Phases I, IJ, and II) and calculations to
demonstrate that the City is setting aside funds sufficient for future closure and post-
closure needs.

Sanborn Head will prepare the opinions of cost using the required NHDES forms based on
the permitted closure plan, currently available average unit costs for similar projects,
current costs for monitoring services, published construction cost estimating guides, and
our engineering judgment. We will estimate the remaining life of Phases I, II, and III based
on the latest survey update and prepare sinking fund calculations using account balances
provided to us, actual waste tonnage received at the Four Hills Landfill, and the projected
waste tonnage for the remaining estimated life of Phase I, Il, and III. The calculations will
demonstrate that the balances for the closure and LTMM accounts are consistent with what
was projected or provide amounts per ton that should be set aside going forward to
provide sufficient funds at the expected date of closure.

Sanborn Head will prepare a letter, addressed to the City, that documents our evaluation,
which will include NHDES Cost Estimate Forms for landfill closure and post-closure care,
and sinking fund calculations.

Task5 General Engineering Services

Sanborn Head’s services under this task will be performed at the City’s request and involve
routine matters of limited scope, such as attending meetings with regulators and providing
design, operation, or air consultation relative the Four Hills Landfill.

Removal of the Barriers

When COVID hit our community and strict mandates existed, our restaurants were struggling
and there was a need for intervention downtown. The barriers were incorporated to create a
safe dining environment and open the area back up for patrons and employees. As we have
progressed through COVID and people are back to work and restaurants are at full capacity,
the barriers are now a nuisance. The traffic, lack of parking, and inconvenience has shop-
pers avoiding the area, resulting in a significant loss of business. It is time to move forward
and permanently remove the barriers and support the hundreds of businesses that are now

negatively affected.

Dear Members of the Board of Aldermen:

I would like to express my opposition to Ordinance O-21-076 with regard to the
installation of barriers on Main Street. While I understand the original genesis of the barriers
and the need to help local restaurants survive during a most unusual time, I believe it is essential
that the City and the downtown merchants step back and re-evaluate the impact, both good and
bad, on all businesses resulting from reinstalling the barriers in our Main Street. Additionally, I
think it is important to understand the extremely adverse consequences of the barriers on both the
passage of normal traffic through our downtown and access for the emergency vehicles
particularly during prime traffic hours.

My law office is located in the downtown of Nashua and in the past year I have had
numerous clients who have intentionally avoided coming to my office due to the presence of the
barriers and resulting traffic and general congestion in the downtown area. Additionally,
personally, as a resident of Nashua for over 60 years, I find it unacceptable that due to the
barriers there are almost no parking spaces available on our Main Street for a citizen desiring to
patronize those businesses located on Main Street.

I believe the time has come to no longer place these barriers in Main Street, but rather to
find other ways to continue to encourage both restaurant and non-restaurant growth and
development in our downtown.

To the Nashua Board of Alderman:

The purpose of this letter is to address our concerns of the Jersey barriers that
have been in place during the last 2 years to accommodate Main Street’s outdoor
dining. We are aware that there are considerations that the barriers are once
again going to be installed this year.

We were in agreement at the start of the Covid-19 pandemic that the barriers
were a good idea to allow restaurants to have more seating and space due to the
restrictions that were in place. However, after 2 years of the barriers, we no
longer feel it is justified to install them once again.

In prior years sidewalk dining was utilized by the restaurants and was adequate.
We are in continued favor of sidewalk dining for the restaurants downtown. This
allows for patrons to park and walk freely to any of the downtown establishments
that they wish to do business with.

We dre opposed to the barriers. They are a cause of traffic congestion, parking
restrictions, and safety concerns for pedestrians trying to navigate Main Street,
along with having an adverse effect on other non-restaurant businesses.
