YEAR ESCROWS, TRUST AND GENERAL; ACTIVITY: LABINE PARK

Please see the attached communication from Nicholas Caggiano, Superintendent Parks and Recreation
for the information related to this purchase.

Pursuant to § 5-78 Major purchases (greater than $10,000) A. All supplies and contractual services,
except as otherwise provided herein, when the estimated cost thereof shall exceed $10,000 shall be
purchased by formal, written contract from the lowest responsible bidder, after due notice inviting bids.

The Superintendent of the Parks and Recreation Department and the Purchasing Department
recommend awarding this contract in an amount of $233,803 to D.L. King and Associates of Nashua,
NH. This award is contingent upon BPW approval at their next meeting scheduled for 5/5/16.

Contract Award of the Legacy Playground at Labine Park.

To award the Legacy Playground at Labine Park contract to the low bidder who
met the qualifications to D.L. King Associates of Nashua, NH in the amount of
$233,803.40. Funding will be through Department 177 Park & Recreation; Funds:
Contribution, Prior Year Escrows, Trust and General; Activity: Labine Park.

Bid Analysis

The project for the playground at Labine Park has been in the making for some
time. This project will provide a location for the Legacy Playground. The bid will
be for the site work and the installation of certain bid items. There will also be a
community assembly of the playground components. The project is scheduled to
kick off in mid-June and will be completed by early September.

The project was put out to bid and the city received three bids. The bids were
evaluated and a bid analysis was put together. One bid item (playground wood
carpet) amounting to $12,420 was pulled out of the bid. This item will be
provided and installed by the City. After a review of the bids, the feedback from
other departments who have worked with the vendor on other city projects it is the
recommendation of the Park & Recreation Department, and the City Purchasing
Manager to award this contract to the low bidder D.L. King and Associates of
Nashua, NH. in the amount of $233,803.40.

A.

ADDITIONAL COVENANTS

The ENGINEER agrees to provide in active charge of this PROJECT for the life of the contract a Project Engineer who
is apermanent employee of the ENGINEER and who is a “qualified sanitary engineer” as defined under the
DIVISON'S“ Rules and Regulations for the Prequalification of Consulting Engineers.” The Project Engineer shall be’

Any proposed change in identity of the Project Engineer on the PROJECT shall first be approved by the DIVISON
before transfer of responsibility is made. Failure of the ENGINEERto abide by the above covenant may be
considered basis for debarment of the ENGINEER from the DIVISON'S Roster of Prequalified Consulting Engineers as
provided for under New Hampshire Code of Administrative Rules Env-Wq 603.08.

The ENGINEER agrees to be solely responsible for all bills or claims for payment for services rendered by others and
for all services and materials employed in his work, and to indemnify and save harmless the OWNER, and all of the
OWNER Sofficers, agents and employees against all suits, claims or liability of every name and nature arising out of
or in consequence of the negligent acts or failures to act of the ENGINEER or others employed by him in the
performance of the work covered by this AGREEMENT.

The ENGINEER further agrees to procure and maintain at his expense such workmen's compensation insurance asis
required by the statutes and public liability insurance in amounts adequate to provide reasonable protection from
claims for bodily injury, death or property damage which may result from his performance and the performance of
his employees under this AGREEMENT.

All documents, including original drawings, design calculations, work sheets, field notes, estimates, and other data
shall remain the property of the OWNER, and shall be transmitted to the OWNERin clean and orderly condition on
demand; however, these may be left in the possession of the ENGINEER at the OWNER Sdiscretion.

The ENGINEER shall not sublet, assign or transfer any part of the ENGINEERS services or obligations (except surveys
and borings and other special services) under this AGREEMENT without the prior approval and written consent of
the OWNER

It is further agreed that the ENGINEER will assist the OWNERor his authorized agent in providing the DIVISON with
clear documentation certifying that the necessary easements, options or outright purchases of land have been
secured to provide for location of treatment works and other associated structures and equipment as shown on the
contract plans or described in the specifications. Smilar documentation will be submitted on approvals from the
State Department of Transportation and/or other state agencies regarding location of treatment works within
rights-of-way and other lands under their jurisdiction.

ADDENDUM NO. 2 - March 24, 2016

Please also note the following items that were discussed at the pre-bid meeting conducted on
March 16, 2016. These items shall be taken into consideration in the preparation of the bid, and
shall be considered to be included in the Contract:

Nick Caggiano discussed the following:

The history of this 4 year project.

Explanation of the role of the Chamber Leadership group.

The history of the location selection.

Neighborhood make up.

Importance of schedule due to the location of the schools.

Description of the Flood Shack and the water service available the contractor is responsible to
bring the irrigation to the building.

City will make connection to the water service in the building and the installation of the
backflow and clock.

The aspect of the community build regarding the playground equipment required by the grant
this will be scheduled by City.

The City will purchase the playground equipment.

Todd Welch discussed the following:

Questions about subbase material requirements for the poured in-place surface: The
manufacturer’s requirements for subbase material were unclear. Clarification is provided below
under Construction Specifications.
Critical dates for bidding. Key dates were read aloud. Dates are:

o Addendum Date: Thursday, March 24, 2016.

o Bid Due Date: Thursday, March 31, 2016

o Notice to Proceed Date: Wednesday, June 1, 2016

© Substantial Completion Date: August 26, 2016

© Final Completion Date: September 12, 2016
Substantial completion was defined as all work being completed except minor punch list items.
