ORDINANCE

INCREASING SEWER USE FEES RATES AND CHARGES

CITY OF NASHUA

In the Year Two Thousand and Twenty
The City of Nashua ordains that Part II “General Legislation”, Chapter 255 “Sewerage
Disposal”, Article [IX “Sewer Use Fees”, Section 255-63 “Rates and charges”, of the Nashua

Revised Ordinances, as amended, is hereby further amended by deleting the struck-through
language and adding the new underlined language as follows:

“§ 255-63. Rates and charges.

B. Demand charges. Each user shall pay a quarterly or monthly demand charge
based on the size of the water meter serving the property.

Until December 31, 2020, Qquarterly and monthly charges will be as follows:

C. Flow charge. In addition to the monthly or quarterly demand charge, each user

shall pay a flow charge for each 100 cubic feet of use measured by water meter

readings or wastewater flow meter readings. Fheflow-charge-pert00-cubicfeet
will be $2.05 through December 34 2016—Effective January 1, 2017, the flow
charge per 100 cubic feet will be $2.36._Effective January 1, 2021, the flow

charge per 100 cubic feet will be $2.83. Effective January 1, 2022, the flow

charge per 100 cubic feet will be $3.26.”

LEGISLATIVE YEAR 2020

ORDINANCE: O-20-040

PURPOSE: Increasing sewer use fees rates and charges

ENDORSERS: Mayor Jim Donchess

COMMITTEE

ASSIGNMENT:

FISCAL NOTE: This increase in rates and charges is intended to bring annual

revenues to a level that will support the ongoing cost of
operations, fund future debt payments on the CSO (“combined
sewer overflow’) projects, fund non-CSO infrastructure
improvements and provide reserves for capital equipment
replacement. Future recommended increases will depend on
the results of updates to the rate/revenue analysis.

ANALYSIS

This ordinance increases the sewer quarterly/monthly demand charges and sewer user flow
charges in January 2021 and January 2022 as stated in the legislation. The amounts are
increased by 20% effective January 1, 2021 and by 15% effective January 1, 2022.

This legislation should be referred to the Board of Public Works.

ORDINANCE

AMENDING THE ADMINISTRATIVE OFFICER ORDINANCE

CITY OF NASHUA

In the Year Two Thousand and Twenty

The City of Nashua ordains that Part II “General Legislation”, Chapter 190 “Land Use”,
Part 7 “Administrative Officer”, Article XXV “Staff’, Section 190-235 “Administrative Officer”
of the Nashua Revised Ordinances, as amended, is hereby further amended by deleting the
struck-through language and adding the new underlined language as follows:

“§ 190-235. Administrative Officer.

AnThe Administrative Officer is the Planning Director. In the event of a vacancy in office or
the unavailability of the Planning Director, the Community Development Division Director is

authorized to act as the Administrative Officer. shal be-appeimted-bythe Mayor and confirmed
bythe Beard-of Aldermen and upentakine office The Administrative Officer shall be

authorized to administer and enforce the provisions of this chapter except for sections or articles
within this Part 7 that are constructed as innovative land use controls (RSA 674:21) that provide
for the appeal, administration, or enforcement by another person or Board as designated within
that section or article. Nothing herein prohibits the Administrative Officer from holding other
appointed office.”

All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

This ordinance shall become effective at the time of passage.

A special meeting of the Board of Aldermen was held Tuesday, November 24, 2020, at 6:05 p.m. via
teleconference.

President Lori Wilshire presided; City Clerk Susan K. Lovering recorded.

Prayer was offered by City Clerk Susan K. Lovering; Alderman David C. Tencza led in the Pledge to the
Flag.

As President of the Board of Aldermen, | find that due to the State of Emergency declared by the
Governor as a result of the COVID-19 pandemic and in accordance with the Governor's Emergency
Order #12 pursuant to Executive Order 2020-04, this public body is authorized to meet electronically.

Please note that there is no physical location to observe and listen contemporaneously to this meeting,
which was authorized pursuant to the Governors Emergency Order. However, in accordance with the
Emergency Order, | am confirming that we are:
