As | said these tax credit programs are the perfect example of that kind of public and private
collaboration. One other thing | would like to add that is not directly related to what the Mayor has said,
but | was reading studies at Southern NH University have shown that the Palace Theater brings $8
million to $10 million dollars in economic activity to Manchester. I’d like to quote and end with one
quote from Peter Ramsey, many of you may have heard this because it was said | think at a subset of
the Board when we were working on this program. He said, “What a wonderful project and concept you
have embarked on. You should be proud of ourselves, you have given the City citizens hope in
themselves, pride in their City, faith in their desire to live in Nashua. It takes a community to run a City.
This process they you have embarked upon will bring out both the positive people and the pessimists.
The hopeful and the naysayers. Remember your courage and foresight could change the City forever.
Together you can change your City, create a legacy for Nashua that you will all be remembered for.

As one of those involved citizen volunteers, | am urging you all to vote yes on this amendment. Thank
you.

Andrew Curioso Hi! am Andrew Curioso, 24 White Oak Drive. | am a property tax payer and my
daughter is starting school in Nashua in a couple years. My company that | helped co-found employees
several people in Nashua. Like the Mayor, | appreciate the need for a Preforming Arts Center to help
create a vibrant downtown as well as for economic and cultural growth. | can speak from my personal
experience that something like a Performing Arts Center is definitely something people like me with
young families look for when they are deciding on a place to move to and a place to live and stay. |
have no doubt that it will attract employees and families and tax payers.

As a tax payer, | feel very strongly about how my taxes are spent. It is my belief that approving
spending for proper planning and preparation and architecture for the project early will help with raising
the funds and making the project a success. | believe that is an excellent use of my taxes. | want my
daughter to grow up in a town or city with a vibrant downtown and with the arts. | strongly urge you to
pass the resolution. Thank you.

Bernadette Halleron Good evening, Madam President, esteemed members of the Board of Aldermen,
Mr. Mayor, Madam City Clerk and Madam Legislative Manager. Bernadette Halleron from 2 Clock
Tower Place in Nashua. | just want to say this is the first time | have ever spoken before the Board. |
am out of a sick bed to come here because | believe this is an important issue for the City and | really
believe, although | am not a native of Nashua, | am a native New Englander imbued with that native
New Englander fiscal conservatism. However also with Yankee ingenuity and | believe that this project
would be an important economic development project. | am in favor of anything — everything | have
read shows that this project would Segway into bringing more businesses into Nashua. And | am very
in favor of anything that broadens the commercial tax base of the City as well as just bringing more
culture opportunities to the City.

| hope that you will all have the courage to focus on the future here and approve the amendment that
you are considering to allow the Steering Committee to do the appropriate fund raising for their part in
the development of this economic opportunity. Thank you. | just want to wish everybody Happy
Holidays and | am going back home to my bed. Everybody stay healthy and goodnight and God bless
Nashua.

Alotman Anjaputi Good evening Madam President and esteemed Board of Aldermen and the team. |
am here in favor of Resolution 18-092 and many things have been spoken and Mayor Donchess spoke
very eloquently. | have lived in this City for almost 30 years and you are right, acquiring Pennichuck,
rail and performing arts center have been the three main items that have been discussed in many
forms, many shapes. Time is of the essence, so when you think about building a home or building a
building, the first investment is design and planning and phased out how we do that. And when we are
doing a public project that is very critical, so without a plan, without a concrete game plan on how this is
going to be implemented and structural and creative art work to show how it would look is critical. | think
without having anything to show and say “write a big check” to any donors would be a moot point. And
we sit between the two cities, Manchester you see they have Palace Theater, Verizon Center, you

name it, even small towns like Westford and Chelmsford there is a Performing Arts Center on Main
Street. So that is a vital thing that we are missing in a wonderful City like Nashua. So | strongly urge all
of you to support this and this will only increase the cultural diversity and art diversity in our City. And |
can speak from a small minority community that has made home in Nashua, how many performances
from the Indian Community are looking and they hear about this Performing Arts Center, “When is it
coming, when can we sign up to have a performance there”. So there is excitement, there is buzz, so it
is on the radar screen for people outside of the community so we can attract more people.

The Holiday Stroll was a big testament a lot of people came from Boston and they said we didn’t realize
how huge this is, what a huge beautiful City. So there it is, we have the potential. So | am requesting,
and | am pleading please make a unanimous consent and unanimous vote to move forward and be this
shining star or shining icon in our downtown. Thank you.

Adam Marcoux Adam Marcoux, 4 Joloriln Lane, | am president of the Nashua Teacher's Union and |
am not here to talk about the Arts Center, sorry. | am here for other things and it is nice not to be the
most controversial item on an agenda for once in my life. We bring forward tonight the contract
between the Nashua Teacher’s Union Secretary’s Contract and the Board of Education. We spent
almost a year negotiating this contract and in any negotiation, no one is equally happy but | think we
found a compromise that we all could live with that is fair for my 73 secretaries. As the budget has
changed in the City and things have left the district, that rolls downhill to them.

One of the biggest things they deal with right now is answering the door bell and most people think
answering the door bell at a school is “Hey Welcome to our school’. In the days that we live in today, it
is a lot different and at times there is weight on these people’s shoulders when they answer that door
and they don’t know what person is. And this goes to recognize their hard work and dedication to our
City. | would like to thank Alderman Dowd and the Budget Review Committee for sending it through and
| look forward to hopeful final passage this evening and a new four-year contract for our secretaries.

Jim Tollner Good evening Aldermen and Mayor. | am here to discuss R-18-066. This is the same
legislation that was presented to you about a moth and a half ago so it hasn’t changed. This is the fair
and the correct thing to do for our city employees. Those employees whose sick time arrangement or
time policy was changed after they had been hired. In the legislation is a choice, it is a choice whether
they can cash out the amount of hours that they originally had when they were hired or utilize the sick
time. So we left that in there to give them a choice and that came out of the work that the Personnel
Administrative Affairs Committee worked on.

The total cost of the legislation is somewhere around $170,000.00 but please keep in mind that this
deals with11 city employees and those 11 city employees will probably retire sometime anywhere from
a year to 12 years from now. The issue of retirees, people who have already retired, shouldn’t be a
concern with regard to this legislation. You pass this legislation and it will alleviate the future risk for
litigation that the City might incur. Again, this is about the fair and correct thing to do for our city
employees. | want to thank the Mayor for his conversation and patient dialogue throughout this process.
| would like to thank the Personnel Administrative Committee for voting for this unanimously | think
twice, as recently as last week.

| also want to thank the Administrative Affairs Committee which is made up of citizens who also voted
unanimously in favor of this. Thanks very much.

Mike Buckley Good evening, Mike Buckley, Toddy Brook Road, Hollis, NH. | wanted to speak about
the Performing Arts Center the resolution to amend and | wanted to speak in favor of it but | guess there
wasn't a lot of discussion about why people would be opposed or for it. As | understand it there is a
little bit of a catch 22 as far as wanting to raise the $4 million dollars before we spend any money, but in
order to do that | think it was explained that we obviously needed a plan so we could present it to
people and have a viable concept that people can really say wow that is a great plan, | want to get

behind that. | think several people touched on that. | had a long discussion with Rich this afternoon, so
| fully understand, and | think | have my head wrapped around it pretty good.

As the Mayor discussed earlier when he was Mayor in the ‘80’s I’ve also been downtown for quite a
long time and | was on the 2000 Master Plan Committee that was 18 years ago. | think that a lot of
people in the City and a lot of people in this room that support it, we are all a community. | think there is
a lot of support for the Performing Arts Center at this point, we are just wrestling with how we get there.
What | am afraid of though is we could get mired down in how we go about this and we could still be
looking at this in a couple years, even if we said yes right now, let’s approve this money, let’s get it
going, let’s get the architect, let’s get the plans, let’s get everything rolling.

This project is going to take quite a long time, it is a long time-frame. So the longer we put off starting
it, the longer it is going to take obviously to get it finished. | always tell my people in my organization,
the best way to get something done is to start, because once you start it is easy. If you talk about it to
death, you are never going to get anything done. So sometimes you make small mistakes, but you can
always fix them as you go. The most important thing is to get a project started. I’ve been downtown
obviously since 1995 and there are challenges to being downtown, but when | came to downtown as a
young chef, at 30 years old, this town really embraced me and the business people in this town really
embraced me and gave me a lot of support. So | am here to stay. | have two businesses’ | have no
problem staying here with my two businesses and | would even grow business down here.

But | think it important that we sent a message to other people that this is a great place to do business
and | have seen over the years since we opened I’ve seen a rise of the downtown Main Street, I’ve
seen it really prosper, I’ve seen it back off, I’ve seen it go up and | think we are in jeopardy right now of
sputtering a little bit. And | hate to see that, | hate to lose more businesses or have people being
worried about coming down to do business because other places have closed. | think it sends a
powerful message if the people of the community and the Aldermen can see, take a little bit of
entrepreneurial approach and embrace this thing. We need the money to get the money, so it is kind of
a Catch 22. Sometimes you have to take a leap of faith to get things done.

| think we are in agreement, or a lot of us are in agreement that at the end of the day this will be a very
positive thing for the City, for the tax payers, for the people that love art to utilize to see shows and hear
music. It will be great for the people that do business downtown, it will also attract new business
downtown and it will also satisfy some of the big picture items of being a great place for families and
bringing young people and keeping people in the community. So | just urge you to be in favor of it and |
certainly am. Thank you.

Paul Patti_Good evening, Paul Patti, 3 Monica Drive. | also submitted this as an e-mail and I'll just call
the high points here. | am a proponent of the Performing Arts Center Investment and that is investment
in the community in what will be the future of Nashua, supporting the economic development of
downtown and the City. | support updating the bond item to release funds for the architectural design
because perspective donors as many people mentioned and especially Mayor Donchess with your
comments, because the perspective donors need to see what they will be investing in.

Having architectural renderings will help Nashua apply for the New Market Tax Credits and help the
City reach the $4 million dollar goal sooner. The bond item will also increase the likelihood of corporate
sponsorships and overall help the fundraising effort. There had been some comment before about the
professionals that were hired and such and | would like for the record to state that just as we recite the
Pledge of Allegiance, | was raised to and still do, trust in our elected officials to make informed and
intelligent decisions based on information received from multiple professionals in the industry as it very
much you all have it sounds like. As the economic wave of prosperity pushes ever outward from
downtown Boston, a successful Performing Arts Center for Nashua can be economic catalyst for the
future success of our City, our children and our grandchildren. Let’s not get left behind.

Sheetal Kelkar Good evening, my name is Sheetal Kelkar, 2 Forsythia Drive, Nashua. I’ve been a
resident of Nashua for the last 14 years and | have seen, well in the US 16 years, in Nashua 14 years
and I’ve seen it grow, I’ve seen the City advance, get better in terms of infrastructure, in terms of
diversity, and there is so much that Nashua offers and | really enjoy living here. | am in favor of Center
for Performing Arts, because | think in the priority list, we always put Arts at the bottom, it is almost
optional. But | feel that Arts, | even have a profession in Arts, I’m an actress, I’m a former pageant
winner and I’m an actress now although | was trained in Human Resources. That is my educational
qualification, so | understand these monetary things and tax related things. But | am a supporter of the
Arts and | highly recommend, and | would urge you all to vote for the Center tonight because | think that
in times that we see so much depression going around, and so much drug addiction problem. Arts
heal, arts just heal the soul.

Ben Clemmons Thank you. Ben Clemmons, 188 Ash Street, Nashua. | am coming before to speak in
favor of the amendment for the Performing Arts Center. | don’t think that there is a person in this room
that has never hatched a plan that had to change it or haven’t had to change it. That is where you are
all at right now. You can move forward with the best intentions sometimes but on occasion you have to
relook at things and say maybe we didn’t do this exactly the way we should have. | think that is where
the City is at right now, realizing that there has to be some investment up front in order to get big
investors to come on board for this project. It might have not been something that we had thought of
previously or when we put this to the ballot, but | think it is important that we recognize that plans
change sometimes or things come up that are unforeseen and we've gotten this far into the project to
abandon it | think would be to go against the wishes of the voters who voted and took their time to vote
yes on that ballot question. So | would encourage all of you to support these changes.

Mike Watt Michael Watt, 5 Briar Cliff Drive, Nashua, New Hampshire. Does anyone know where |
could find a good Christmas Carol around here? | guess |’d have to go to the Palace. For the most
part, | think the City does a pretty good job, we’ve got really nice parks, we got really nice roads, we
even built another high school, our policing of the streets, the fires are all out, they do a good job
educating our kids. | don’t see why this won’t be a success, | really don’t. My grandfather always said,
it takes money to make money and sometimes you have to show a little faith. In this case we are
talking about putting money up front so they know that they can invest in us. Having a municipality do
it, gives it a little bit more faith in my opinion, so they know that they are going to be there tomorrow.

| just think about generations in the past, when we look around, think about if they didn’t put that library
in there, they didn’t build that school, didn’t decide to put this building here. If they decided to do
something else, do a different project, how different our City would be. Who would be here, who
wouldn’t be here. We were talking about kids, people wanting their kids to grow up here and what kind
of investment you would have in your community. We need to invest in our community and | think that
is what the voters said when they voted for this. They took a leap of faith, they looked at the price tag
and said you know what, look at what we have done every, what day was the Holiday Stroll, but you
see how many people come here, how many people come from different communities? We bring
people together. There are what, 20,000 or 30,000 people that showed up last time? 45? That’s a lot
of people. | think about what is going to happen on those nights when we have a show. | talk about
having an actual show and people coming out and walking on Main Street. | think about the businesses
that benefit that night. I've seen what happens when we have even the flea markets and all the
different activities on Sunday and all the businesses that do well. | would like to see businesses open
on Sundays again for the most part. | see some of them, but I’d like to see all of them.

But at the end of the day | know | have to be brief, but | think you guys do a pretty good job and we
need to invest and do this. We are already here, you guys looked at it for over a year at this point, you
guys have looked at all the different options, the voters have said yes, let’s do it guys. Thank you.

(2) If any penalty set forth in Table 4-1 is not paid within ten days of the date the
citation was issued, the penalty shall be the amount set forth in Table 4-1 of this
subsection plus $50 up to a maximum of $1,000.

B. The penalties for any other offense for which a citation has been issued shall be as

Lisa Bissonnette Hi, Lisa Bissonnette from Amherst, New Hampshire, | work downtown in Nashua at a
large real estate development company. | am also the President of the Board of Directors of City Arts
Nashua which is a non-profit Arts Service organization here in Nashua. | want to echo Judy Carlson’s
remarks in particular about the creative community award that Nashua received last year. Nashua is
actually the only City in New Hampshire to ever win that award twice.

We have a significant and vibrant arts community, lots of supporters and it is very collaborative
environment, there is no question that community and the wider community of Nashua support the
Performing Arts Center and want to see it happen sooner than later. From a business perspective no
growth comes without investment, | think that’s well understood by everyone here tonight. We are
hearing a real willingness to make that investment in Nashua which we all believe in so much.

| will also say that as an investor in real estate, it is completely true that no one makes a significant
commitment of funds without a concrete design and plan. You want to know what you are spending
your money on and you want to have the sense that what you invest in will be completed successfully. |
think the Steering Committee for the Performing Arts Center has shepherded these early stages so well
and obviously asked a lot of questions, hired the best consultants in their fields to make the best
possible recommendation for Nashua and so | agree with Mr. Buckley it is time to proceed, let’s get it
done. Thank you.

Fred Teeboom | must be the last, I’m not the last. Fred Teeboom 24 Cheyenne Drive, Nashua, NH.
Let me say some things about the amendment that haven’t been talked about. The amendment says
that the $4 million dollars of charitable donations tax credits do not have to be solely spent on
operations, you can spend it on construction. The sole operator to bid, Spectacle Management
requires no subsidy. There will be no subsidy if the data has 700 seats, what they call a sweet spot for
Nashua. So you don’t need the $4 million to subsidize operations, if they give you a $1.00 to rent the
facility, they will operate the rest of the year and ask for no additional money. That is their proposal.

Now the recommended bidder by the Steering Committee is Icon Architecture. Now ICON architecture
was selected by the Committee. They did an absolutely outstanding job making the presentation,
almost like a preliminary design review, such detail, just blew everybody else away which is why they
got selected. They recommend a 700 seat theater, just like the operator. That requires building it from
the ground floor up, which I’ve always maintained makes sense, don’t put it on the second floor, think of
the egress problems, think about people that have died, have crashed through the floor, you have 1,000
people standing on the second floor, waving their hands, stomping that is a serious structure problem.

They don’t design it that way, they design it from the ground up. However, a 700 theater, even from the
ground up is going to be more expensive that a 550 seat theater. | have no doubt about that. The cost
estimated, the sole contracted cost estimator for this job Fennessy Consultant. They were hired by
Boonacot who partnered with Duncan Webb to do that original study. Fennessy Consultant estimated
the 550 seat theater to cost $16.4 million dollars. There is only one other legitimate estimate sort of,
McCarthy went to Harvey Construction, well established, do some school work and asked them to take
a look at the $16.4 bid and look at the comparison between the NH market and the Boston market.
Harvey reduced that $16.4 to $15 million construction cost.

Tim Cummings kept saying $11.5 million, | have asked him over and over again to produce the details.
He waves his hands, he talks about all these people that come around that he dealt with but he has
never produced details behind his $11.5 million. The cost is $15 or $16.5 million which is $5 million
dollars above what you have got funded in the current bond resolution. So you are going to need every
penny, every penny of this $4 million to $6.5 million that Mayor Donchess expects to receive from
charitable contributions for tax credits, you are going to need every penny for construction. That's what
is good about this amendment. It says you can use this charitable money, tax credit money for any
purpose to realize the Performing Arts Center. And that is a very good thing.

| think with this approach, now well thought through, having advance designs spending money on the
design so you can convince people that they should donate. | know I’ve built a memorial, the first thing

we did when we built the memorial is build a mock up to show people what they would contribute to
before we build it. It only makes sense for all those reasons and because | now have become a
supporter instead of a critic which | think ICON architecture has shown us what | have been maintaining
since last year and others have maintained. | fully support R-18-092 | would ask that one of the
Aldermen ask Attorney Bolton the following, there is a change to what people voted on. In the voting
resolution the word “shall” was used shall the Aldermen pass the resolution and it showed everything in
18-01. So one of you need to ask the attorney whether that resolution was permissive as opposed to
aclaratory; if Attorney Bolton wants to address it now.

It was very clear that it was non-binding advisory referendum. So it did not itself have a force of law, so
the Board of Aldermen is still free to adopt anything it is otherwise permitted to adopt.

Jim Lespasio Good evening ladies and gentlemen, my name is Jim Lespasio, | am the owner of Stella
Blu Restaurant on East Pearl Street in downtown Nashua. | am going to step away from the germ-
infested microphone at this point. | think we have all heard the positive reasons why the Performing
Arts Center is going to be an economic boom for all of the City of Nashua, not just downtown. So |
thought | would spend just a couple of minutes talking about, as an entrepreneur the due diligence that
we performed in 2008 before deciding to locate our restaurant in Nashua.

So through our priority list of course you want to open up a restaurant right next to where there are a lot
of people whether it is an airport or BAE or Fidelity — and we really didn’t have a lot of those
opportunities in downtown Nashua. So our next level of thinking was let us look at the retail businesses
that are downtown and let us see who is very well. Are there a number of people that have been here
for a long time, are there people here that are in our area of business and so we started looking at
places like Scontsas that has been there since over 100 years and with the Persian Rug. Michael
opened up in 1995 which was 13 years before we showed up, but all of those businesses, the fact that
they were there, created a fabric for a community and an economic environment that we found very,
very appealing.

In the restaurant business, we like the 30/70 rule where 30% of your business is coming from regular
customers but you are always looking for that other 70% and trying to woo them in. So we saw that
same kind of mix right here in downtown Nashua. | mean when Michael opened in 1995 I’m sure he
wasn't breathlessly waiting for Stella Blu to come to East Pearl Street but if he wasn’t there in 1995, we
would not have been there in 2008. His decision to open up and taking a risk and invest in downtown
Nashua, made us feel very comfortable and we said this area will support more similar restaurants and
he couldn’t have been more gracious when we opened in helping us out with questions and answers
and suggestions. So it really is a tight knit fabric of community downtown.

Now we are just a little guy, we have 15 employees most of them part-time and most of them are from
Nashua but | can imagine a much larger corporation or an entity that is looking to do their due diligence
priority and if they see a Performing Arts Center with 700 people there, that’s going to be the end of
their list, it is like ok we are done. We have already got all the economic vibrancy in a downtown area in
a concentrated area that we need. So! am sure we all understand that this will definitely bring in a lot
more business for everybody downtown.

Hopefully, in closing, we are all intelligent people here, there was maybe some miscommunication or
some verbiage or some sentence interpretation in the original amendment and | am sure we can all
come to an agreement together to make sure everything works and that way we don’t turn a 30 year
project into a 32 or 35 or even worse. Thank you very much for your time and | hope vote yes

made available. Can the Mayor just explain what this is for?

This is to repair and of course this was through the Board of Public Works, this is to repair a major piece
of equipment at the sewage treatment plant. The sewage treatment plant several years, 3, 4, 5 years
ago was in a major state of disrepair. The problems had not yet been revealed by the then
superintendent and Mayor Lozo with Alderman Deane and Segale, particularly the latter two, with Lisa
Fateaux, outlined a whole plan of improvements. As we have moved forward over the last 5 years the
facility has been upgraded very significantly and this is one of the last things that needs to be done.
