17, 2020 for project specific details related to this purchase. Below please find a summary of the
purchase approval request:

2020 Landfill Water Quality Testing and Monitoring Change Order #1

To approve Change Order #1 to the contract with Chemserve Environmental
Analysts of Milford, NH for water quality testing and monitoring services at all of
the City of Nashua landfill sites for the Solid Waste Department in the amount not
to exceed $29,888. Funding will be through: Department: 168 Solid Waste; Fund:
Solid Waste; Account Classification: 55 Other Contracted Services.

Revised Schedule of Values and Change Order

The Solid Waste Department is requesting Change Order #1 to the current three
year contract with Chemserve Environmental Analysts for water quality testing and
monitoring services at all of the City of Nashua landfill sites.

After the execution of a 3-year contract with Chemserve Environmental, the scope
of work changed due to increased testing requirements established by New
Hampshire Environmental Services (NHDES). New testing for Per and
PolyFluoroAlkyl Substances (PFAS) is the biggest reason for the added expenses
along with an increase in the number of wells the Solid Waste Department has been
required to test.

As a result the Solid Waste Department requires an addition $29,888 to complete
the work required for the rest of FY21, which is the final year of the contract. This
amount includes $10,770 to pay for work that has already been performed and
$19,118 to complete the rest of the testing as shown in the attached revised schedule
of values.

| was under the impression that we were elected to make these decisions. That’s fine and well and you can
make all the remarks you want from the gallery but you vote people out of office, that’s what you do. You don’t
have to include me in that package, but that’s normally when you don’t agree with decisions and the votes that
people make then you vote against them. That’s the authority that you have as a citizen, and | respect that.

Alderman Clemons

True, and | would agree with Alderman Deane that obviously this is going to be a big election issue. The
people who voted tonight, as well as the people who voted yes, will have to face the citizens. But | think since
the majority of the Board of Aldermen, who is elected, voted for this tonight, it did get a 8-6 vote, the majority of
us said yes, we should put it on the ballot and let people speak. If you decide afterwards that you are still not
going to follow what the citizens say because | think it’s going to win, but if it doesn’t, it doesn’t. If you decide
you're still going to vote the way you are going to vote afterwards, it is a non-binding resolution. At least you
will know where the citizens stand.

Alderman Lopez

Alderman Deane made a reasonable point. We are elected to make decisions. But | think we are also trusted
to make those decisions based on the information in front of us and the evidence at hand. We did go through
this whole performing arts feasibility study which specifically identified what would work and where it would
work. | heard some speculation as to whether that process was steered without any real evidence saying that
it was. I’ve heard people say that they would prefer a venue or a performance that is larger than what is being
recommended by the feasibility study we just went through. So, personally, | am listening to my constituents
and | am using my own judgment. | asked as many questions as | could identify in order to troubleshoot the
decision-making and say, am | doing right by the people at home who aren't aware. | also listened to people
who show up. This is a public meeting, and it is a very engaging public meeting. There is a huge public
turnout. | think it would be a little bit silly for us to ignore the other side of our responsibility which is to listen to
what people are asking us to do.

Alderman O’Brien

During the deliberations | did hear there were some questions, and some people did question on the petitions,
and | talked to many more people. | agree with you. Put this on the ballot and let’s exactly know what the
people say. | think it’s a continuation of due process. To Alderman Deane, | most certainly agree with you 100
percent, but the horse has already left the barn. We have a sitting alderman and a former alderman suing the
city when we duly voted on something already. | wish people would listen. We do have the right to govern, but
unfortunately it seems like they have the right to challenge as well.

Phase IV Landfill Permit Application —- Response to NHDES Comments

To approve services from Sanborn Head & Associates, Inc. (SHA), of Concord,
NH in an amount of $30,000 to address New Hampshire Department of
Environmental Services (NHDES) comments to the Type 1A permit application
for the proposed Phase IV secure landfill expansion. Funding will be through
Department: 168 Solid Waste; Fund: Solid Waste; Activity: Expansion Phase 3
and 4.

The NHDES has completed their initial review of the Type 1A permit application
submitted by the City in July 2020 for Phase IV of the secure landfill expansion.
In correspondence to the City dated November 20, 2020, the NHDES requests
additional information in order to deem the application complete. The Solid
Waste Department is requesting $30,000 for SHA to address the request for
additional information. Once deemed complete, NHDES will begin a technical
review of the permit application. When that process begins additional funding for
SHA will be required at that time to address comments from the technical review
and to continue the permitting process.

Dear Jeff:

Sanborn, Head & Associates, Inc. (Sanborn Head) appreciates the opportunity to be of
continued service to the City of Nashua (City). As you are aware, Sanborn Head provided the
City with a Preliminary Opinion of Cost, dated September 2, 2016, to prepare an Alteration
of Terrain (AoT) permit and a Type I-A Permit Modification Application (PMA) associated
with the proposed development of Phase IV. The Type I-A PMA was submitted to the New
Hampshire Department of Environmental Services (NHDES) on July 23, 2020, and the AoT
permit will be submitted in December 2020, pending the completion of a wildlife study
report, which is required as part of a recent rule change that requires the City to meet certain
New Hampshire Fish & Game (NHF&G) standards.

As part of the 2016 Preliminary Opinion of Cost, Sanborn Head recommended that the City
budget $200,000 to fund the following items:

m Address NHDES comments to the AoT permit application and Type I-A PMA;

= Provide support at public hearings and meetings;

= Prepare the Type II PMA; and

= Assist with preparing construction bid documents.

As discussed, the City is requesting Sanborn Head to provide a revised cost opinion to
address the items listed above. Based on our latest conversations, the City is more interested
in obtaining financing related to the permitting of Phase IV, rather than the construction-

related items (i.e., Type II PMA and bid documents) since that work will not occur for several
years.

Permit Support Scope Items

As mentioned above, the Type I-A PMA was submitted to the NHDES and the AoT permit
application will be submitted in December 2020. Based on our experience preparing these
permits for similar projects within the State, and given the current permitting nature of these
