To: Mayor James Donchess; Nashua Board of Aldermen
From: Steven A. Bolton, Corporation Counsel

Date: December 7, 2016

Subject: Hills Ferry Road Railroad Crossing

Mayor and Members of the Board:

The Community Development Division has a pending grant application submitted to the Land
and Water conservation fund to improve the Greeley Park boat ramp and parking area) A
portion of Greeley Park which includes the boat ramp and only public access to the Merrimack
River in Nashua is accessed by Hills Ferry Road which crosses the Pan Am Railways track. The
pending grant is conditioned on the City being able to demonstrate that public access is available
to the ramp by way of this railroad crossing. Previous funding made available by NH Fish and
Game to improve the boat ramp was withdrawn because the City could not demonstrate that the
railroad crossing was public. In order to allow for such demonstration the City has brought a
petition before the New Hampshire Department of Transportation seeking a declaration that this
is a public crossing or alternatively to alter its status to a public crossing. One of the issues will
be the extent to which the City will be required to upgrade the existing safety measures (now
consisting of a sign reading “Railroad Crossing”) and maintain them going forward.

Attached please find a proposed settlement of that administrative proceeding which attempts to
limit the City’s current and future responsibility for such upgraded safety measures albeit still
potentially requiring future upgrades under certain circumstances.

I respectfully request your authorization of the proposed settlement.

20210407 Nashua Phase III Stage 2 Proposal-Rev1.docx

SCOPE OF SERVICES
Task 1 Design Documents

Sanborn Head will prepare Design Documents that will be included with an application fora
Type II Modification to Solid Waste Management Facility Permit (see Task 3). We anticipate
that the Design Documents will include the following components:

=» Technical Specifications;
=» Construction Drawings (Drawings);
=» Supporting Calculation; and

=» Construction Quality Assurance Plan.

The Drawings will be based on the “Phase II] Construction Drawings,” approved by the
NHDES on December 5, 2020. Plan sheets and details related to the construction of Phase III
Stage 1 will be eliminated, and the existing conditions will be updated to include the Stage 1
as-built information. As required by Permit Condition 10, Sanborn Head will prepare the
following under this task:

« Additional details related to the construction and connection of the zigzag liner system;
and

» A calculation package specific to the anchor trench pullout and zigzag liner system
settlement calculations based on ultimate settlement.

Sanborn Head will prepare technical specifications related to the Phase II] Stage 2
construction materials. Because the majority of the Phase II] operating components were
installed as part of Stage 1 (i.e, power, pumps, riser building, etc.) the Phase II] Stage 2
technical specifications will be limited to Site Work (Division 2), Concrete (Division 3), and
Mechanical (Division 15).

Sanborn Head included budget to prepare for and attend an online teleconference (i.e.,
Microsoft Team meeting) with the NHDES soon after we receive authorization to proceed
from the City to discuss our understanding of the Phase II] Stage 2 permit conditions. This
meeting will serve as a kick-off to the project and to inform the NHDES of the City’s timeline.

Following the NHDES meeting, Sanborn Head will prepare an Opinion of Probable
Construction Cost for Phase II] Stage 2 based on the costs associated with the construction
of Phase II] Stage 1. Please note that Sanborn Head is not a professional cost estimator,
therefore, our opinion should not be considered equivalent to the nature and extent of the
service a professional cost estimator would provide.

Task 2 Operating, Closure, and Financial Assurance Plans

In accordance with Permit Conditions 10 and 19, the current Operating, Closure, and
Financial Assurance Plans need to be updated specific to the addition of Phase III Stage 2.
This task will focus on developing an Inspection, Monitoring, And Maintenance Protocol
(Protocol) that will be included in the updated Operating and Closure Plans. As detailed in
Permit Condition 10, this Protocol will identify:

To Nashua Board of Aldermen/Women Ref: Ordinance 20-018 Facial Masks

From: Sue Newman - 25 Charlotte Ave., Ward 2 -- State Rep. Ward 2

lam totally in support of requiring the wearing of facial masks in Nashua, when inside a
building such as a grocery store, etc. Although grocery stores have marks on the floor,
directional arrows, etc. signage, etc. for social distancing, and post the CDC recommendation for
wearing face masks, there seems to be a small minority of people that simply refuse to wear
masks.

I'll explain my personal experience last evening (May 20th), at Market Basket at Sommerset Plaza. |
got to the store after 5 p.m., | had my mask, there was no line waiting, and | did look at the sign
posted on the entrance docr: "All customers entering these premises SHOULD WEAR A
FACIAL COVERING over their mouth and NOSE in Accordance with CDC GUIDANCE. Thank
you for your Compliance. PLEASE PRACTICE SOCIAL DISTANCING SIX FEET APART "

The majority of shoppers Inside the store were wearing masks, but | saw at least 4 people

shopping, who weren't. While | was walking across the back of the store ( from the Deli/Meat Dept.
along the back aisle toward the Produce section) -- | saw one of the unmasked couples - coming
in the opposite direction on the parallel aisle (they were coming from Produce area towards
Meat/Deli) -- and we were approximately 20 feet apart -- when the woman sneezed.

| did not observe the sneeze, as | was glancing at things on my left -- but | stopped, and looked over
at them. NO mask, aloud sneeze and | have NO idea whether she used her ‘arm to sneeze into - or
not" - but she did say "Sorry".as they proceeded along the aisle.

In this time of Covid19 pandemic awareness and knowledge of how easily the virus can be
spread, hearing a loud SNEEZE ina store, by an unmasked person, is.... memorable. With
A/C weather approaching, | have concerns that air flow systems also might 'expedite' the virus'
spread in enclosed areas.

| told the store manager what happened (he wears a mask) as! was leaving the store. He said that
in Massachusetts, the shoppers have to wear masks. Most people here do wear masks, but a
few just seem to refuse to -- and that seems so wrong, for the rest of us.

Grocery stores have gone to great efforts to sanitize shopping carts, mark off distancing, put
directional arrows on the floors, protect the cashiers with plastic, etc. - and yet we have NO
enforceable requirement for patrons to wear a mask while inside the store -- seems crazy!

Subject: Proposal for mandatory face masks

Mr. Jette,
I’m a resident in Ward 5, my address is 42 Whitford Road in Nashua.

I read an article from the Union Leader discussing the idea of mandatory face mask in Nashua
that may go to the Alderman board for a vote.

https://www.unionlead er,com/news/health/coronavirus/face-mask-mandate-for-stores-
restaurants-floated-by-nashua-health-officials/article 3293e88 1-fa35-5383-8350-
b9b01 bbffP?b2. html

I have a few concerns against such an ordinance, one philosophical and the other two practical
based on my observations.

1) Mandating a face mask covering, which is a suggestion from the CDC, seems to
underestimate our ability as adults to make decisions in our own best interest. Though it’s a
common sense recommendation, the experts are divided on whether a mask actually prevents
transmission. I think for this reason it should remain a recommendation and not become and
ordinance which in my opinion should be evidence-based beyond reasonable doubt if we’re
forcing citizens to do something.

2) The CDC face covering recommendations come with a major caveat: maintaining 6-ft social
distancing. I can tell you from my observations, the general public’s adherence to this dropped
significantly after a large portion of people began to wear masks. It promotes a false sense of

security for most. I experience this at the grocery store frequently—people with masks are the
worst offenders of bumping into me, reaching over me and others, etc.

3) Masks must be washed daily to be effective. This is also part of the CDC recommendations. I
see the same masks on grocery store workers, and while I have no proof they don’t wash them
daily my hunch is the probability is low that every person follows this guideline. Given this, are
we going to mandate washing as well? How will it be enforced? If this isn’t done, an unintended
consequence is that, in theory, a virus carrier is loading up their mask with viral residue daily and
thus exposing people they encounter to *more* viral load than they otherwise would have when
they wear their mask.

In light of these, | would ask that you vote against this if it comes to ballot. Not because I don’t
believe we should be safe in our community, but because I don’t think this has enough evidence
to support a local ordinance-level mandate, and I think the other ramifications may have
umnmtended consequences that go against what this is trying to accomplish.

Please contact me if you would like to discuss.
Best Regards,

David Winchester

The Honorable James Donchess, Mayor

The Honorable Members of the Board of Aldermen
City of Nashua

229 Main Street

Nashua, NH 03060

Dear Mayor Donchess and Members of the Board of Aldermen,

Tam writing to you to ask that you approve the Board of Education’s request for a 2.25%
increase in the FY2021 budget. Our city, along with the rest of the country, is facing
many challenges during the COVID-19 pandemic. There is no question that the
pandemic will have financial repercussions on all of us.

Some have suggested that the hiring freeze instituted by the Mayor apply to the school
district. I respectfully disagree. Prior to the COVID-19 pandemic, the needs of our
students continued to grow. The dynamics of families and the needs of students have
changed exponentially over the last decade. The number of special education students
is growing, the number of ELL students is growing, and the number of students facing
traumatic experiences is growing. One could argue that every current student has faced
a traumatic experience this year with the abrupt closing of city schools. There was a
need for additional staff to support our students before the pandemic; the need has
grown significantly since March.

We are uncertain when we will return to school in our traditional setting, but we wiil
return at some point. When we do, we are going to need all hands-on-deck to not only
support our students, Dut families and the staff ofthe district. Many would say that it
is not the school district’s responsibility to provide some of these supports or services.
if not the district, then who will provide the services? The role of public schools has
been evolving. Our budget needs to evolve with those changes to meet the needs of all
of cur students.

I am grateful for the support the Mayor and the Board of Aldermen have shown the
school district In the past. | am fully aware that the district is the largest, and most
expensive department in the city budget. However, every penny invested in education
is a penny invested in our city’s future. Please continue that investment by approving
the 2.25% request by the Board of Education.

Respectfully,

President, Nashua Teachers’ Union

Hi Good Afternoon,

"LIVE FREE OR DIE" does that ring a bell with the 10 who are forcing this mandate on the public? All your
doing is promoting fear as the media does you no better than them and the Govenor.

Ali your doing is pushing business out of Nashua. I can go to Salem and Hudson were I need to get what I need
now.
Good thing I work close to Salem NH there getting my business now.

What's the point of this mandate the Government is not in charge of my health, I AM.
J am not putting my health at risk when I am perfectly healthy by putting a mask on that will do nothing but
weaken my immune system.

Those who contract the virus have a 99% survival rate same survival rate as the seasonal Flu. Please get you
facts straight and do your research.

VOTERS will have there say.
I look forward to Election time.
Stop acting like little dictators.
