of the Notice of Award will be deemed acceptable to OWNER and ENGINEER subject to
revocation of such acceptance after the Effective Date of the Agreement as provided in Article
6.06 of the General Conditions.
10.03 CONTRACTOR shall not be required to employ any Subcontractor, Supplier, individual, or
entity against whom CONTRACTOR has reasonable objection.
ARTICLE 11 PREPARATION OF BID
11.01 The Bid Form is included with the Bidding Documents.
6.02 Addenda may also be issued to clarify, correct, or change the Bidding Documents as deemed
advisable by OWNER or ENGINEER. Bidders are requested to sign each Addenda issued to
indicate receipt of this additional information and must include the signed cover page with
Bidders bid submittal. It is the Bidder’s responsibility to determine from the City website if
Addendas have been issued.
ARTICLE 7 BID SECURITY

ARTICLE 1 DEFINED TERMS
1.01 Terms used in these Instructions to Bidders will have the meanings indicated in the General
Conditions and Supplementary Conditions. Additional terms used in these Instructions to
Bidders have the meanings indicated below which are applicable to both the singular and plural
thereof:
A. Bidder — The individual or entity who submits a Bid directly to OWNER.

*Coverage must include all owned, non-owned and hired vehicles.
> Workers’ Compensation Coverage according to Statute of the State of New Hampshire:
$100,000 / $500,000 / $100,000
The City of Nashua must be named as an additional insured on all liability certificates.
All bidders and subcontractors at every tier under the bidder will fully comply with NH RSA Chapter 281-A,
“Workers’ Compensation”.
Delivery of the Bids shall be at the Vendor’s expense. The time of receipt shall be considered when a Bid has
been officially documented by the Department, in accordance with its established policies, as having been
received at the location designated above. The City of Nashua accepts no responsibility for mislabeled mail.
Any and all damage that may occur due to shipping shall be the Vendor’s responsibility.
