§ 9.4 CERTIFICATES FOR PAYMENT
§ 9.4.1 The Architect will, within seven days after receipt of the Contractor’s Application for Payment, either issue to
the Owner a Certificate for Payment, with a copy ta the Contractor, for such amount as the Architect determines 15
properly due, or notify the Contractor and Owner in writing of the Architect's reasons for withholding certification in
whole or in part as provided in Section 9.5.1.

§ 8.3 DELAYS AND EXTENSIONS OF TIME
1 Costs of labor, including social security, old age and unemployment insurance, fringe benefits required
by agreement or custom, and workers’ compensation insurance,
2 Costs of materials. supplies and equipment, includ.ng cost of transportation, whether incorporated or
consumed,
3 «Rental costs of machinery and equipment, exclusive of hand tools, whether rented from the Contractor
or others;
4 ~~ Costs of premiums for all bonds and insurance, permit fees, and sales, use or similar taxes related to the
Work, and

§ 7.1.2 A Change Order shall be based upon agreement among the Owner, Contractor and Architect, a Construction
Change Directive requires agreement by the Owner and Architect and may or may not be agreed to by the Contractor;
an order for a minor change in the Work may be issued by the Architect alone.
ARTICLE 6 CONSTRUCTION BY OWNER OR BY SEPARATE CONTRACTORS
§ 6.1 OWNER’S RIGHT TO PERFORM CONSTRUCTION AND TO AWARD SEPARATE CONTRACTS

Architect requires additional time for review. Failure of the Owner or Architect to reply within the 14-day period shall
constitute notice of no reasonable objection.
§ 5.2.2 The Contractor shall not contract with a proposed person or entity to whom the Owner or Architect has made
reasonable and timely objection. The Contractor shall not be required to contract witb anyone to whom the Contractor
has made reasonable objection

completeness of other details such as dimensions and quantities, or for substantiating instructions for installation or
performance of equipment or systems, all of which remain the responsibility of the Contractor as required by the
Contract Documents. The Architect's review of the Contractor’s submittals shall not relieve the Contractor of the

ARTICLE 4 ARCHITECT
§ 4.1 GENERAL
§ 4.1.1 The Owner shall retain an architect lawfully hcensed to practice architecture or an entity lawfully practicing
architecture in the jurisdiction where the Project is located. That person or entity is identified as the Architect in the
Agreement and is referred to throughout the Contract Documents as if singular in number

§ 3.13 USE OF SITE
The Contractor shall conftne operations at the site to areas permitted by applicable laws, statutes, ordinances, codes,
rules and regulations, and lawful orders of public authorities and the Contract Documents and shall not unreasonably
encumber the site with materials or equipment.
§ 3.14 CUTTING AND PATCHING
§ 3.12.3 Samples are physical examples that illustrate materials, equipment or workmanshyp and establish standards by
which the Work will be judged.
