be the 23" of December. Actually all 3 of those bonds would take place that evening if what the Clerk
is saying is correct.

Alderman Klee

Actually the answer will probably have to wait for the Clerk. So if we have the Public Hearing on the
2™ then that would mean that we cannot vote on it on the 10" is that correct. We would actually have
to wait until the 23" to vote on it, that’s what the Clerk will determine for us correct? So regardless, we
cannot hear it until the 23" if the 15 days, whether we change the Public Hearing or not.

Alderwoman Melizzi-Golja

Yes but | believe that the question was if the informational meeting is going to be the 9", could we not
hold the Public Hearing at the next Budget Meeting which is the 16'"? Is that correct, your next Budget
Meeting for December would be the 16". and if that is the case it can’t happen because 16 plus 15 is
31 and our next — so you would be having a Special Meeting on New Years Eve. We can’t hear it on
the 23" if I’ve done the math correctly and I’ve followed all of the dates correctly that are being put out.
| think that’s, you know, it would be a Special Meeting on January 2™ that you would have to hold.

Attorney Clarke

Well what we have confirmed is that the Charter requires a duly advertised Public Hearing; the RSA
that | was thinking of is RSA 33:9, which requires a 2/3 vote to pass a Resolution. But | see what you
are saying Sue, that the Charter might not actually have any specific dates or timeframes. It just says a
“duly advertised public hearing’.

Alderman Clemons

Can | just ask the maker of the motion through you a question? Might it satisfy you to simply have
these bonds voted on on the 23" as opposed to the 10"?

Alderman Jette

My thought was that the Public ought to have an opportunity to know what the project is, what the plans
are before the hearing, before the Budget Review Committee. | guess if we can do this the way that
I’ve proposed legally, that would be my preference; if we can’t do it than | understand that we will do it
as initially proposed.

Attorney Clarke

We do have confirmation on the time frames. RSA 33:8-a mentions that yes, the notice of the time,
place and subject of the hearing, published in a newspaper at least 7 days before it is held. The
hearing shall be hold at least 15 days, but not more than 60 days prior to the meeting in which the bond
is to be voted on. So we do have the 7 prior and 15 day after.

Alderman Clemons

So just to clarify, that means that with the Public Hearing on the 2™, it would be voted on the 23" of
December and if we were to move that hearing, really to the date proposed in this motion, we’d have to
call a special meeting at some point in January in order to dispose or to make a decision on that?
