BPW meeting. We could postpone the Public Hearing to December 16" the night of the Budget Review
Committee Meeting and then the Board of Aldermen is meeting the following week, the 23% and you
know so we could | think there is time for the Board to act on this even if we postpone the public
hearing until the 16".
Since | have heard that it is in order, | would like to make a motion to postpone the public hearing on
the Board of Public Works Building to December 16h

When we were first talking about the Public Hearings and the dates and having them and everything,
Treasurer Fredette came to me and said that he would like to have all three of those Public Hearings
the same night. So this is all going in lockstep because it saves him a tremendous amount of work with
Bond Counsel. So the request to have these in a separate meeting and in this timeframe was a
request of the City Treasurer.

| understand that the motion is in order, my question is are we meeting the legal obligations required by
the State of New Hampshire or our own Ordinances regarding Public Hearings if we were just to
reschedule this to the 16". | know that we have to do Public Notices and things like that and that is the
nature of my questions.

| think from a legal standpoint the statute for bonding | think it might even actually be 7 days’ notice
although | don’t have the analysis. | am getting a nod from the City Clerk. Legally we meet the notice
requirement for scheduling that Public Hearing. | don’t know if there would also be any issues with
getting that notice published or anything.

Attorney Clarke is correct it is 7 days; it takes 3 days to get it into the paper, but | think more importantly
is after the Public Hearing you must wait, | believe, 15 days, before you take that second reading, that
vote. So there has to be a period of time according to the RSA’s, | believe, after the Public Hearing and
before the second reading. If my memory serves me correctly that is 15 days. The sheet is in the back
if you'd like me to get that, in reference to the RSA.

Yes that would be helpful, | think. My only other comment was that if indeed we have to wait the 15
days after the Public Hearing, then the bond wouldn’t come up until the 23" anyway, because it couldn’t
come on our calendar for the 10". So therefore that would create a situation where we had the Public
Hearing on the 2™, we had the other informational meeting and then there would be a significant
number of days in-between that and the next Board of Aldermen where that would appear which would
