SUBJECT: NTC Time Extension Recommendation
Dear Camille:
GPI has reviewed the time extension request from D.L. King & Associates, Inc. submitted and dated October 24,
2021. After review, there are some comments and recommendations GPI has on the merits of the request as are
described below:
Recommendation for Substantial Completion date
The current substantial completion date for the contract is currently October 24, 2021 and includes work
features related to the contractor binder paving City Hall Way and Garden Street. GPI recommends that this
date be extended to December 15, 2021 with no general conditions cost to the City. This date matches the
NHDOT winter shut down date. At that time, the contractor is to have the site secured, the Transit Center
exterior fully operational as per pre-construction use and bus/pedestrian movements. A future time extension in
the spring of 2022 to complete roadway work will be necessary, and the contractor shall demonstrate through an
updated schedule a new completion date for all exterior work items.
Recommendation for Final Completion and Interior work date
The current final completion date for the contract is currently November 23, 2021 and includes completion of
interior work to include the occupancy permit. GPI recommends that this date also be conditionally extended to
December 15, 2021 with no general conditions cost to the City. The Nashua Transit System (NTS) is agreeable
to a temporary occupancy permit for employee-only portions of the building such as, ticketing (without bullet
resistant glass), breakroom and employee restroom. Between December 1 and December 15, the expectation
is that the contractor can provide a progress report for outstanding items to complete the rooms by December
15. Also, it is expected that long lead items, such as the bullet resistant glass have expected arrival and
installation dates. Accordingly, a new completion date for interior work may be negotiated with the contractor
with updated schedule provided.
Understanding the contractor has requested time until May 31, 2022, there currently is no supporting
documentation provided to warrant such an extension. GPI recommends the above short-term extensions to
provide time for actual schedule impacts to be understood and documented. Also understanding the urgency to
eliminate the current displacement of NTS staff, a short-term extension leaves the possibly of liquidated
damages in place if they become necessary. If you have any questions on these issues, please do not hesitate
