g. Resubmittal Procedures
1) Contractor shall make corrections required by Engineer and
shall return the required number of corrected copies of Shop
Drawings and submit, as required, new Samples for review
and approval. Contractor shall direct specific attention in
writing to revisions other than the corrections called for by
Engineer on previous submittals.
2) Contractor shall furnish required submittals with sufficient
information and accuracy in order to obtain required
approval of an item with no more than 3 submittals. Engineer
will record Engineer’s time for reviewing subsequent
submittals of Shop Drawings, samples, or other items
requiring approval and Contractor shall reimburse Owner for
Engineer’s charges for such time.
3) In the event that Contractor requests a change of a previously
approved item, Contractor shall reimburse Owner for
Engineer’s charges for its review time unless the need for
such change is beyond the control of Contractor.
Variations: Clearly identify requests for “Or-Equal” and substitute items
and submit per subparagraph 1.02.C.1.b above. Substitute items will not be
considered when indicated or implied on Shop Drawing or material and
equipment data submittals without separate written request, or when
acceptance will require revision to the Contract Documents. Identify
variations from Contract Documents and material and equipment or system
limitations which may be detrimental to successful performance of the
completed Work and identify reasons therefor at no additional cost to
Owner.. Engineer will be allowed a reasonable time within which to
evaluate each proposal or submittal made and may require Contractor to
furnish additional data about the proposed substitute item. Engineer will be
the sole judge of acceptability. No “or equal” or substitute will be ordered,
installed or utilized until Engineer’s review is complete, which will be
evidenced by a Change Order in the case of a substitute and an approved
Shop Drawing for an “or equal.”
a. “Or Equal” Items: If in Engineer’s sole discretion an item of material
or equipment proposed by Contractor is functionally equal to that
named and sufficiently similar so that no change in related Work
will be required, it may be considered by Engineer as an “or equal”
item, in which case review and approval of the proposed item may,
in Engineer’s sole discretion, be accomplished without compliance
with some or all of the requirements for approval of proposed
substitute items. A proposed item of material or equipment will be
considered functionally equal to an item so named:
