§ 5-91Amendment to contracts.
For any contract previously approved by the Finance Committee, the Mayor shall inform the Finance
Committee within 10 business days of any amendment to the contract terms, scope of work, or sums
payable to the contractor, or if the contract was terminated. No contract may be amended as to its
scope of work or so as to increase sums payable to the contractor, without Finance Committee approval
for amendment amounts exceeding $25,000;
Proposed Change:
Replace paragraph with: For any contract previously approved by the Finance Committee, the
Mayor shall inform the Finance Committee of any substantial amendment to the contract terms
or, change in intent of originally approved scope of work, or if the contract was terminated or
has been delayed by more than one year. No contract may be amended as to its scope of work
or so as to increase sums payable to the contractor, without Finance Committee approval for
amendment amounts exceeding $25,000
Proposed change to eliminate requirement where there is no significant change in scope of work or
terms (termination or delay}. Change orders are within a normal scope of the nature of many of the
projects we contract and to effectively adhere to this requirement would create excessive
communications. We are proposing to continue to request approval from the Finance Committee for
changes that exceed the standard $25K threshold and communicate only significant project changes that
substantially change the project scope or timeline.
§ 5-138Contracts.
A. All contracts and amendments to contracts, regardless of value, in which the City becomes involved
or engaged shall be reviewed by the City Corporation Counsel, all contracts and amendments in excess
of $25,000 shall be reviewed and approved by the Finance Committee prior to award, and
all contracts and amendments in excess of $1,000,000 shall be reviewed and approved by the Finance
Committee and approved by the Board of Aldermen prior to award, except for emergency situations as
defined in §§ 5-90 and 5-91.
B. Ali contracts may be signed on behalf of the City by the Mayor. Contracts under $1,000 may be signed
on behalf of the City by employees in the following positions: [Added 9-24-2019 by Ord. No. O-19-053]
(1) Public Works Division Director. , {2} Community Development Division Director,
(3) Administrative Services Division Director, (4) Financial Services Division Director, (5) Public
Health and Community Services Division Director, (6) Chief of Police, (7) Fire Chief, (8) Library
Director, (9} Economic Development Director, (10) Corporation Counsel, {11} City Clerk,
(12) Emergency Management Director
Proposed Change:
Change threshold from $1,000 to $10,000
Proposing to increase the threshold for contract signing from Sik to $10K. There is no good way to
quontify impact for this change os there is currently no automated contract process and no central log
for contracts.
