Proposed Purchasing Ordinance Updates

Proposed Change:
Change to add virtual bid openings*

Proposing to allow for virtual bid openings in addition to in person. This will allow for participation from
more vendors, stakeholders and interested parties with less effort than travelling to City Hall for an in
person.

F. The Manager shall not solicit a bid from a contractor who is in default on the payment of taxes,
licenses or other monies due the City.

Proposed Change:
Add the restriction from including vendors who have been debarred from participation in any
State or Federal program

Proposing to add debarment as an exclusion for participating in the City’s bid opportunities to ensure we
are selecting “responsible and responsive” vendors to work with.

Debarment means an action taken by a Federal agency or official to exclude a person or business entity
from participating in transactions involving certain federal funds

A debarment may be based on convictions, civil judgments or the agency’s independent evidence proving
by a preponderance of the evidence that a company or individual were involved in fraudulent conduct on
public contracts, such as, contract and financial assistance fraud, embezzlement, theft, forgery, bribery,
poor performance, non-performance or false statements as weil as other causes.

§ 5-84Speclal purchase procedures.

A. The competitive bidding process shall not apply to the following special purchases:

(4) Sole-source procurements, where the proposed purchase is manufactured by only one company or
where a sole company’s product offers proprietary features or technology necessary for the City’s
requirements.

Proposed Change:
Add the following janguage: “or where a sole company’s product offers proprietary features or

technology necessary for the City’s requirements.”

Proposed change is proposed to include technology based items where there are multiple produced
options but where technology needed preciudes ail but one company/option.

(7) Purchases under extensions of contracts when no price increase exceeds 10% per year.

Proposed Change:
Add: “and where a market change has not reduced pricing in the product category”

Proposed change is proposed te more clearly define to a best business practice
